If the defendents plead guilty, there is no trial. Only a sentencing hearing.

A Thai judge or judges has full authority to reject a guilty plea by defendants in any criminal trial.

I agree on not naming what nationality or country they are from, I also believe they should not use migrant, they should just say the "The People or Person of Interest"..... In the USA migrant means from Mexico or people who are USA citizens that travel around the USA harvesting crops in season that can't be harvested by machine. The witness has retracted his statement that had confirmed they were still on the beach at the time of the murders. We only have evidence that they went there just after 11pm from the CCTV and that they drank a couple of beers, smoked a couple of butts and sang Rakhine dialect songs from that time. BUT we there is no evidence that they were still on the beach at the time of the crimes which was at least 4 hours later after 3am. We don't know what time they left the beach and went to bed. The witness now says he woke up the next morning and found his friends uninjured and quite normal as if nothing had happened.

How about the two mens sperm that matched their DNA , the hour is irrelevant .

Actually, yes, rapists will use condoms to prevent DNA Identification.

What I haven't heard of is Thai men using condoms. According to my wife and her friends, Thai men seldom wear condoms. And if you recall the claims by prostitutes working the protester camps, the men would not use condoms and refuse to pay for services rendered. Not sure about Burmese though.

Currently, no-one can be convicted of murder without a confession, because there's no other evidence to support that. Suspects could be sentenced for rape, if DNA matches, that's about it if they keep shtum. One murder weapon, no fingerprints, no DNA. No witnesses of the murder.

Even if Mon was tested and found to be a match his lawyer would say he didn't commit murder, he left the beach after committing rape. Maybe an unlikely scenario, but possible.

It would be up to a Thai judge or panel of judges to determine reasonable doubt; if they decide there is not sufficient reasonable doubt, they can declare guilty as charged.

Actually, yes, rapists will use condoms to prevent DNA Identification.

What I haven't heard of is Thai men using condoms. According to my wife and her friends, Thai men seldom wear condoms. Not sure about Burmese though.

I simply responded that rapists have been known to wear condoms in order to avoid being identified. Thats not rocket science.

As for who buys condoms at 7/11...well, I have never given that the thought you apparently have. Its good to hear those are bought by Thai males. Are you suggesting that because some condoms are worn by Thais that all Thais wear condoms then? I suppose I had better correct the Thai women friends of my wife and tell them that a guy named farang knows quite alot more about the Thai male sexual practices than they do.
