  1. Hi all,

     

    After a meeting with my work in trying to change my yearly extension stay based on employment to a yearly extension stay based on marriage, they have denied it to me.

    I'm thinking in opening a company with my wife as a shareholder but not as an employee, for now.

    I understand that if they don't let me change to this new extension I could not open a company like I'd like, since 1 million in registered capital is required to set up a company having a extension stay based on marriage.

    My actual company told me that if I want to leave the company in a future and I want to change to a new visa without having to leave they country, they could help me.

    My objective is to don't let any gap between visas, even in the work permit, since I gonna apply to Thai nationality.

    I think I won't have any problem in changing my extension based on employment to a extension based on being married to a Thai wife in a future BUT I don't want let have any gap between my actual WP and the next one. I don't know how to open a company if they don't let me change the extension neither.


    Any suggestion in how to do it? Could I change the WP the same day without any gap between them, already having the required documents prepared to be employed in my new company?

    This is what I understood.

    Once here, I don't want to lose Spanish nationality. I had thought about losing my nationality (since it is one of the requirements to apply to Thai citizenship), but after 3 years I'll recover it again. Then I would not end up losing my nationality and as I understand it, I could get Thai citizenship in this way, being Spanish.

    When I left the Thai company I was working at to set up my own business, this gave me a lot of flexibility, but also added significant cost.  I figure it costs me about 5,000 baht a month on average to pay an accountant to do the paperwork, audits, and file the work permit paperwork for me, not to mention the initial 30,000 baht to get everything set up in the beginning.  This can be done cheaper if you do all the paperwork on your own.

     

    My Non-Immigrant O visa through marriage to a Thai has nothing to do with my business and I renew them separately.

     

    I have successfully applied for Thai citizenship under these circumstances, but I wouldn't recommend doing this unless you are ok with the cost and really committed to working for 3 years at your own company (while paying taxes) and waiting an additional 3 or more years for your application to go all the way through the process (while still paying taxes) all while at a cost of 5,000 baht per month just to have your own business.

    And yes, I'm going to hire a lawyer or an accountant to handle everything. I am glad to know that I can apply for Thai citizenship in this way. I think the best way is for my wife to open a company and hire me as an employee. Actually, we are starting a motorcycle rental business. I know that I cannot legally work on this with work permit and I take the opportunity to ask if there is any type of work in this branch where to request one.

     

    I am not worried about the paperwork payments, the most important thing for me is to get citizenship, but i'm glad to know how much it can cost me everything.

    I would offer your company an incentive to increase your salary, even if it is on paper only. Much easier than starting a company.

    My company will not do that for me. I know them. My salary is 30k + extras, total 35k maximum. I prefer to open a company in my wife's name and start from scratch. Anyway I'm not happy there and I'm thinking to finish with them in a few months. Thank you

    For some time, being able to apply for Thai residence is an objective. The problem is that I cannot fulfill the salary requirement. Also, the company where I am working will not help me with the documents. The only thing I can think of is to open a company in my wife's name and that she hire me with a salary higher than 40,000B. Do you know if it is possible? Could I get a work permit with a Non O Marriage Visa in my wife's company with a job that a foreigner is qualified to work? Do you think this may be a good idea? Do you have a better idea? Could I have problems in the application when they see that I am working in my wife's company?

    My advice is to tell your employer to pay you 40k a month(surely as an expat you can't be far from that). Just explain why and offer to do extra work or some other favour for them.

    Whatever, you'll have to wait 4 years before you can ago apply.

    I am thinking about applying for Thai citizenship but I have several problems. I don't reach the enough points. One of the problems is that in my work I do not reach the minimum of 40,000 baht to get the minimum 15 points of salary and I don't think I can get it in the future. I am considering to open a company, with work permit for me and a salary of a minimum of 40.000 baht.

    Could this be a good idea?

    I would like to know, if there is any way to apply to citizenship being Spanish, I just realized that only Spain accepts dual citizenship with Latin American countries but not with any country in Asia. Do you think that the best option would be the permanent residence and forget about citizenship or can I dream and still there is any way to apply?

    In the meantime get the yellow book right away to establish residency. I think if you moved to Bangkok you'll have to be on a friend's blue book unless you buy a condo there.  I think that's the only two options if you are going to apply in Bangkok.  Either way the process of moving residence should be fairly easy in Bangkok.

    What do you mean "you'll have to be in a friend's blue book"? Could a Thai person add a foreigner in his/her own blue book and that means being registered in the place where he/she is registered?

    I have been reading several pages back and I see that to apply in Chiang Mai for the citizenship, that is where I live, it is going to be much more complicated and the process much longer. I'm gonna apply for the yellow house book since my purpose is to apply for the citizenship in Bangkok, what advice do you give me to be able to register in Bangkok and apply there? I have no close friend who helps me to register in his house, any recommendation? Do you think it would be better to register in Chiang Mai, get the book, then move to Bangkok and change the address there would be easier?

    Same for registering your marriage at an Amphoe. Photos are not needed for that.

    If you apply for an extension of stay based upon marriage at immigration you would have to use the address where you are living. The photos needed would have to be at that house and show the house number for it in one of them.

I will register at the address of my girlfriend's mom house, but at the same time I live in a house for rent, what would the process be like? What address should I have on the TM30? In the case of getting married, where should I register my marriage and take my photos? Will I have a problem if I am registered in the house of my girlfriend's mom and at the same time I have a rental contract in another house? The registration at the address of my girlfriend's mom house would only be to get the yellow book and then apply to the pink ID card.

    The problem is in Chiang Mai there isn't Spanish Consulate. If finally I have to traduce this document I have to do it in Bangkok because later the Spanish Embassy has to check and seal it.

    I also need to know if the passport translated into Thai has to be collated and sealed by the embassy or it is not necessary and I could do it in any translation office in Chiang Mai.
