  1. 9.3.6. Income under Category F or Category G can be combined with income from salaried and non-salaried employment, non-employment income and pension income in order to meet the financial requirement. However, unlike with other Categories, these sources of income must fall within the relevant financial year(s) in order to be included. Under Category F or Category G, all sources of income must fall within the financial year(s) relied on and must still be a source of income at the time of application. For example, to count income from property rental the income must have been received during the relevant financial year(s) and the property must still be owned by the relevant person at the date of application.

    9.3.7. Where a couple are using their joint income to meet the financial requirement, all of this income must fall within the financial year(s) being relied on and must still be a source of income at the time of application. For example, if the applicant is in the UK with permission to work, to combine their salaried employment income with their partner’s self-employment income, they must provide evidence of the income received from this salaried employment during their self-employed partner’s relevant financial year(s) and evidence of ongoing employment at the date of application.

    i found this but as the bold points out, i can't use her income to combine as she doesnt work there anymore. she has a better job where she earns more.

    judging by what im reading, we cannot meet the financial requirement :/

  2. i started as self employed last year. so my earnings was low. my wife was working as well. between us we only managed to earn around £21,000 (yes, i know, we was poor but keep reading)

    this year i have more than tripled my earnings, obviously starting a new career i had to get threw the ranks.

    my wife started a new job threw an agency in may, went direct for the company in august.

    as i am newly self employed i have to put in my earnings for previous the year, minus expenditure it comes to £13000, was £19,00 until expenditures was taken off.

    so, can i count her employment in 2014 towards the income with my self employment? this isnt covered in the guidance notes, it all talks about this year. (the last 12 months)

    Her job wont cover the requirement because she hasnt been in it long enough (last job finished in november 2014)

    mine wont as my income for last year is what it is based on, even though i have covered the requirement this year

    i feel a bit stuck, we have earnt the money but it doesnt seem to fit into their requirements? what can i do?

  3. Thanks guys, been in a bit of a flap over these few issues. You have put me at ease!

    one more thing, we have to give letters addressed to us (joint accounts etc) or separate. We only have contract for the house with both names on and nothing more. So i trying to gather 6 letters to each of us, not a problem for me as i pay the bills, she has minimal letters to our address.

    do i need six to both addresses we have lived at or just for our recent address? It does say letters spread across the term she has been in the UK.

  4. i have to apply for FLR for my wife soon.

    A few questions...

    We dont live at the address we applied for the original visa at, was i ment to notify them of this? If so, who and how?

    Looking at what i need for FLR, it mentions BRP card... never even heard of this before. Had a look at getting one and it says I should of been sent a letter with a barcode on to get one. We never received one of them. Do i need it? Again, if so, how do i get the barcode letter to get the BRP card.

    again with the BRP card, we need to get a new passport, i read we need the BRP to move the visa into a new passport?

    With regards to NHS surcharge, this didnt exist when i applied for the visa, do i have to pay for the last 2 and half years (settlement) and the next two and a half years (FLR)? (£1000)

    english test! my wife did a bulats english test in bangkok when we first applied for settlement, can i use this or does she have to take another test?

    sorry for all the questions, when i applied for settlement, it was nice and simple. now its all jibberish to me :/

    The NHS surcharge. It was only supposed to be paid prior to attending the appointment but UKVI told my MP that as many people were turning up for appointments having not paid it that they had introduced the payment prior to making the appointment.

    Bearing in mind this only came in in April you would have thought UKVI would have given some lee way until the process had settled down. If someone hadn't paid it they could have just taken a credit card payment or not let the appointment go ahead.

    sorry but im a bit confused. why is there a £500 NHS surcharge? i never heard about this until now.. who, where and why do i pay it?

  6. chill out lads, yes i asked how far in advance i need to book for an appointment with premium service. is the answer 28 days? also how late can i do it? if the passport arrives just before the visa expires.

    anyone had positive experience with premium service?

    but mainly i wanted to know if i could apply now with the old passport and then get the new one after i have used the premium service?

    i already have the appointment booked to make a new passport

    Ok I was right, for once at least. So I refer you my first answer but I am afraid my experience is not positive. It seems negative responses are frowned upon here.

    Well if it is right that you can't make a premium appointment until 28 days before the visa expires then I will find out in about a week and a half.

    I can only reiterate the problems that I had before. To access the appointment system the UNVI web site forced me to pay the £500 NHS surcharge before even booking the appointment. The system gives you three attempts before a security protocol throws you out and then you have to start the whole saga over again.

    I suggest that you put in the widest range of dates and locations as possible and hope for the best. I did, it cost me £1000 and no appointment. What can I say.

    what is the £500 for??

    couldnt get an answer about appointments, all the premium service places dont have phone numbers! always helpful

  7. She needs to have a valid passport or other travel ID when she submits her FLR application. See 5. Documents you must provide.

    If it's any help, when my wife last renewed her Thai passport at the RTE in Kensington, her new passport arrived within two weeks. That was in March 2014.

    Sorry, I don't know how far ahead you can book an appointment at a PSC; all I can suggest is that you try to book an appointment and see what dates are available and how far forward.

    Her current visa/LTR should still be valid when she submits her FLR application, so the latest she can do so is the day that her current visa/LTR expires. I'm afraid I can't say whether there is a grace period after this expiry date and if so how long it may be.

    i called them today and was told the same thing, have to have a valid passport. they did tell me i get 28 days after the visa expires to put in for FLR.

    im just hoping the passport doesnt take to long, if its two weeks ill be very happy!

    oddly the immigration people couldnt tell me about appointments, said its nothing to do with them! how does that work? but they did say, what you said, try and book one and see

  9. wifes current visa ends jan 2016.

    passport ran out in may 2015.

    obviously we need to apply for FLR but in the mean time we need to get a new passport, made the most recent appointment we could at the thai embassy and get a new passport. which isnt till november 10th.

    embassy website says it takes 6-8 weeks to get a new passport. over the phone they said it might just take 4 weeks. MIGHT. we are goign to be cutting it fine to get an appointment (for the same day service)

    what i would like to know, is can i apply with her out of date passport till the other arrives? how far ahead do i need to book an appointment to get on the same day visa?

  10. Bear in mind how extended periods of absence from the UK will affect the impression and intent of future applications to your wife's desire to be a naturalised resident.

    My wife has been resident one week short of three years and we have ensured only two holidays per year at no more than three weeks duration.

    No problem with ILR last November and total absence for the last year will cause no problems for citizenship application.

    Keep it reasonable and play the game. When your wife has gained citizenship and ultimate British passport then you can holiday to your hearts content.

    same question as above to you. i believe your wifes was granted before the new rules. my wife has 5 years to wait till she gets ILR :(

  11. There is no specified maximum time allowed out of the UK whilst qualifying for FLR or ILR. However, when the time comes your wife will need to show that she is a UK resident and has been for the entire qualifying period.

    This may be difficult to do if she had spent more time out of the UK than in, but holidays, even of the length you are asking about, should not be a problem.

    The residential qualifying period for naturalisation is more strict. For spouses and civil partners the applicant must not have spent more than 270 days out of the UK in the three years prior to applying with no more than 90 days in the final year.

    it will be under 90 days and the last time we travel for a extended amount of time.

    Am i right in thinking that she can't apply to be a UK resident until she has ILR? If so then that will be in 4 and half years time. Making this holiday outside the prior 3 years or can i get it before ILR? (hope this makes sense, ive just woken up lol)

  12. My wife is on a Uk settlement visa (been here for 5-6 month) and we have got a break from work of 6 months.

    we have enough in the bank to go back to thailand for a few months (2-3, 6-12 weeks) but im not sure about the rules on here leavign the country.

    i've heard she cant go out the country for more than 90 days. will leaving for a long period affect our application for FLR? (not due for 2 years)
