  1. I would recommend that you call a few law firms in Bangkok regarding your Thai labour law case. Some firms such as ours (Siam Legal) will do these type of labour cases on a "no win no fee" type basis. However, this really depends on the facts of the case and the evidence you have available.

    Then go to the Labour Office with someone who can help with translation. They are very helpful and will contact your employer on your behalf. If this fails, they will arrange a date for the labour court to hear your complaint.

    I wouldn't bother with a lawyer for three reasons:

    1) They don't care about the case as much as you

    2) The labour court will appoint a lawyer to prepare your complaint for free

    3) The labour office officer phoning the school is usually effective and will cost you nothing

    If you are more specific about the complaint, I'm sure there's someone here who can help with a particular aspect of labour law.

  5. Property Development: Profit from a Property Stimulus Package

    The property development sector in Thailand has certainly seen its fair share of ups and downs. Like all businesses, it is quite dependent on the whims of market forces and other prevailing economic conditions. However, despite these fluctuations, in the past decade we have seen property development making steady progress and it has consistently triumphed over all the challenges if faces. This has been fueled largely by two factors. The first being the rise in income levels of local Thais and the emergence of a sizeable middle-class group in the country. The second is due to the increase of international interest in the high-end luxury accommodation market, particularly in popular resort areas such as Phuket, Hua Hin, Pattaya and Koh Samui. These places have long been popular for its natural beauty and in its ability to attract thousands of tourists each year.

    Despite this, over the past year or so, confidence in the property sector diminished slightly due to the well-known military coup which ousted the former Prime Minister, Thaksin Shinawatra into a self-imposed exile. During the interim government’s tenure, we saw many prospective developers and buyers alike adopting a ‘wait and see’ approach although the market remained relatively strong. That wait is now finally over and although it is still early days, property professionals are confident that having a democratically elected government will benefit the sector greatly.

    New Economic Stimulus Package

    Indeed in early March, the Thai government approved a series of economic stimulus packages which will, among others, reduce some of the key taxes for property developers and their buyers. The Thai cabinet outlined the three main goals in introducing this package. They are, namely, to:

    1. Increase the income of Thai citizens;

    2. Promote and support the growth of SME businesses and;

    3. Stimulate investment in the country and to enhance its competitiveness.

    How This Affects Property Developers

    There are a number of measures introduced by the cabinet, however, only a handful have direct relevance to property developers. The first is the reduction of the Specific Business Tax (SBT) from 3% to 0.1% for transactions which are made within the year after the package is enacted into the Royal Gazette. This is expected to be in April 2008. This is good news for property developers in Thailand as this is often a cost which they have to absorb in every transaction. Indeed the reduction will only be for one year so its main aim is to create a short term boost to the property sector. For large scale developers, this will inevitably help their bottom line depending on their backlog of properties due for transfer up until the first quarter of 2009. Smaller developers who concentrate on smaller projects such as low-rise developments or small scale housing projects could also benefit as they are often more flexible and able to acquire, develop and sell a project within one year.

    Reduction of Transfer Fee

    The property stimulus package has also reduced the transfer fee for property transactions from 2% to 0.01%. This is a large reduction and is likely to have the most impact compared to the other measures. This is significant as this will benefit both the property developer and property buyer alike as this cost is often shared between parties. This reduction will also boost the property sector as buyers will be keen on buying in order to take advantage of this.

    Reduction in Corporate Tax for SMEs, Public Companies and IPOs in MAI and SET Markets

    Some smaller property developers may also benefit from this stimulus package in another way. Small to medium size companies with a paid-up capital of five million Baht or less are exempted from corporate tax on the first 150,000 Baht of their net profits. This should help smaller property developers but probably would not have much effect on larger companies.

    Newly listed property development companies or companies which are currently requesting for an IPO will have their corporate tax reduced from 30% to 20% for their first three years if they are listed in the MAI market. For those who are listed on the SET, this reduction will be from 30% to 25%. The reductions in the foregoing will only apply to companies seeking an IPO in 2008 and listed by 2009. Currently listed companies on the MAI and the SET will have their corporate tax reduced to 20% for its first 20 million Baht in net earnings and 25% for the first 300 million Baht in net earnings respectively.

    Increase in Salary Base for Income Tax Exemption

    Another fiscal measure which may benefit property developers and the economy as a whole is the raising of the base salary for which income tax is exempted from 8,300 Baht per month to 12,500 Baht per month. This measure may help boost the property market further by increasing low-income homebuyer’s ability to purchase property and therefore should benefit low-cost housing developers in general.

    Final Word

    So what does all this mean to the property development sector in Thailand? It is certainly a good sign and it shows the government’s commitment in the growth of property as the mainstay of its key economic policies. However, as is the nature of stimulus packages, it is a short term measure and property developers have to take this in mind if they wish to take full advantage of it. There are a number of things which may affect this. The major factor is timing. Developers must have the ability to execute a project from procurement to transfer within one year. For existing developments, success will mainly be dependent on the size of the current backlog of customers which are awaiting transfer. Depending on physical phases and contractual obligations, developers may also wish to complete any of the existing transfers by the first quarter of 2009. For new developers in the early and planning stages, it may be useful to consider smaller projects which can be completed and transferred within one year. Low-rise or exclusive housing estates may be ideal in these cases. Whatever the project may be, this stimulus is certain to help all property developers throughout the country. The extent to which they are successful may vary depending on circumstances. However, with good time management and planning, every property development should be set for further gains.

  9. Permanent Residence Status in Thailand

    Every year many foreigners and investors contemplate submitting an application for permanent residence in Thailand. However, the question is, do they comply with the required criteria for eligibility? What are the actual requirements and most importantly how long does the whole process take before approval is given? The annual quota for granting permanent residency in Thailand currently stands at a maximum of 100 persons per nationality. In the last cycle of approved applicants, only 196 passed the approval process under the quota system. The Interior Minister responsible for issuing the announcement each year notifies the applicants that the quota is open for submission, from October 2007 to the end of December. The Immigration Bureau is the government agency responsible for handling all procedures and applications for permanent residency in Thailand. This year's process will be most arduous for the paperwork preparation since the tax and company documents will need a verification signature of the person who prepared the documents.

    There are a number of areas where an applicant may satisfy the requirement for this status. The most common method of obtaining permanent residency permit is by the following:

    • A potential applicant must have received permission for a non-immigrant visa for at least three consecutive years prior to the submission of an application for permanent residency. Holders of multiple non-Immigrant visas do not qualify. You must have 3 straight yearly extensions in order to qualify.

    • An applicant must be holding a non-immigrant visa at the time of submitting an application.

    There are other categories by which a permanent residency may be obtained. These are based on an individual’s personal qualifications as outlined below:

    1. Investment category (minimum of 10 million baht being invested in Thailand)

    2. Working/Business

    3. Support of a family or for humanity reasons: The applicant must have a close relationship with a Thai National or a Non-Thai National that has permanent residence status either as:

    - A legal husband/wife;

    - A legal mother/father; or

    - An unmarried child who is under 20 years of age up to

    the submission date of application.

    4. Expert Category

    For an applicant to apply under the Expert Category, they must provide the

    following documentation:

    i. Graduated from a University with at least a Bachelor Degree, and provide a

    special service/ability to the Thai authorities.

    ii. Supported by the authority concerned, and be officially certified.

    iii. Certifying letter from the authority concerned confirming the applicant’s

    service, and their position up to the date of submission.

    Procedures on Submission of Application

    All applications are submitted for consideration by the Immigration Commission which has representatives from the Interior Ministry, the Ministry of Foreign Affairs, the Royal Thai Police Headquarters, the Ministry of Labor and Social Welfare, the Supreme Attorney, the Board of Investment, the Security State Council, the Immigration Bureau with the final approval by the Interior Minister. For the final approval for a permanent residence application, the Immigration Commission will take into consideration, among others, the applicants’ qualifications, income, assets, knowledge, professional expertise, relationships with any Thai citizens, national security, character, health, understanding of Thai language and other considerations deemed appropriate by government policies.

    The immigration officers will normally grant the applicant a 180 day extension of stay on the date of the applicant’s submission and the next extension will be granted for an additional 180 days until the final approval has been given. During the initial process, the applicant will receive an appointment card stating the interview date and time with immigration. The interview will consist of a verbal and written test in the Thai language.

    All applicants over the age of 14 must undergo a criminal record check. This consists of the following:

    - Their fingerprint sheets are sent to the Criminal Records Division for

    the criminal record check in Thailand

    - Their passports undergo a blacklist check to verify whether the applicant is

    a “prohibited person” according to the regulations as stated by the Immigration Commission.

    - The applicants are checked by Immigration as to whether they are classed

    as “wanted” by Interpol.

    Fees for Permanent Residency

    A non-refundable application fee for a residence permit is 7,600 baht. Upon approval of a residence permit a further payment of 191,400 baht is payable. For foreign nationals who are married to Thai citizens, this fee is only 95,700 baht.

    Submission Period

    Applicants can only submit their application once a year. Normally, the opening date for the applications is in October or November. However, we recommend applicants to begin preparation at least 3-4 months prior to the deadline, as at times; the collation of various documents may be substantial. Once the date is announced, applications can be submitted until the last working day of the year, which in this case is the 31st December 2007).

    The results will be announced by the Immigration Commission in May 2008 and the residence permits will be issued to successful applicants in December 2008.

    What Happens After?

    Once approved, the successful applicant will receive what is often coined a blue book. The foreign resident must then register their place of residence in Thailand at the local Municipal Office and obtain a house card. Seven days after receipt of the residence certificate you then apply for an alien book or a red book at your local police station.

    It should be noted that the Residency Permit never expires unless it has been revoked. If the residence permit holder decides to leave the country and return, the permit holder must apply for a re-entry permit which is endorsed in their passport. This can be easily obtained at the permit holder’s local immigration office.

    Also, as a permit holder, you must present yourself at the police station covering the area where you are resident once every five years to receive a stamp in your permit book.

    Advantages

    Applying for a permanent residency appears to be a costly and time-consuming process. It is therefore fitting to ask what the distinct advantages of getting one are. There are, in fact, various advantages to holding a permanent resident status in Thailand. These include, among others, the following:

    1. It allows the permanent residence holder to live permanently in Thailand, with no requirement to apply for an extension of stay at immigration each year.

    2. The permanent residence holder also receives an alien registration book and number, which is equal or similar to that of a Thai Identification Card.

    3. A permanent resident holder can have their name included on a house registration book (tabien baan).

    4. The permanent residence holder will still need to obtain a work permit to work in Thailand, but the requirements are much less stringent.

    5. The holder can purchase a condominium without the need to transfer money from abroad;

    6. Apply for Thai Citizenship after 5 consecutive years as a permanent residence holder.

    7. Their children born in Thailand can apply for Thai Citizenship.

    8. The permanent residence holder can become a director of a Thai public company.

    (e) They can apply for an extension of stay or permanent residence for non-Thai family members.

    Having permanent residency status in Thailand may not be for everyone. However, for those who are eligible, the time and effort in obtaining one can be a priceless investment for the future. To obtain permanent residency comes with it a desire to embrace the very core of Thailand and its way of life. For those who have made Thailand their home away from home, this is especially important as it helps to strengthen their connection to a country with a culture and lifestyle in which they wish to play an integral role. The advantages, therefore, it seems are both tangible and intangible.

  11. Now that the visa requirements are scheduled to be more restrictive inside Thailand starting October 1, we are beginning to see the changes in the regional Thai Embassies and Consulates for business visa application requirements.

    We sent our client to the Thai Embassy in Kuala Lumpur, Malaysia with the proper documents to apply for a non-immigrant business visa for 90 days. Now the Thai Embassy in KL is requiring a certified copy of the business registration documents for his Thai Limited Company BEFORE issuing the business visa. We are in the process of setting up his Thai company for him in Bangkok. Previously, we had provided our own company documents as the sponsor for securing the non-immigrant business visa for 90 days. Typically, the client will go outside to Malaysia to obtain a non-immigrant business visa (if they don't already have one) in order to apply for the work permit.

    Our staff made calls today to the Thai Embassies in KL, Phnom Penh (Cambodia) and Vientiane (Lao), and the Thai Consulate in Hong Kong. The visa officers in each Embassy/Consulate verified that the Managing Director of that company must be the person signing the "guarantee" letter requesting the visa, a detailed description of job in that company and that all company documents (every last one of them) must be included with the application. This is a significant change and more restrictive from the previous requirements. By the way, we attempted to contact the Thai Consulate in Peneng but the telephone was engaged all day long. Remember that the information given out by the visa officer at one particular Thai Embassy or Consulate can vary greatly from another.

    If you are interested in starting a business in Thailand it is still possible to obtain the non-immigrant business visa in a nearby Thai Embassy/Consulate, however, the company must be registered first and the Thai visa application comes after. Our ability to assist our Thai visa clients in USA and UK is unaffected by these new stricter guidelines so I highly recommend applying for your Thai Visa in your home country. Don’t leave home without it!

    Description:

    - Conceptualize, create and maintain multiple web sites

    - Shopping Cart creation and maintenance

    - Banner ad graphic design

    - Graphic design of online newsletters and other online promotional material

    - Design interactive Flash front ends for CD-ROMs

    - Optimize web sites and blogs for various search engines (Google, Overture, etc)

    - Graphical design of advertisements and multimedia

    - Network System Maintenance

    Qualifications:

    - Bachelor Degree or Masters Degree in Computer Science or related fields.

    - Minimum 5 years experience in IT (Software, Design, Hardware and Network)

    - Knowledge and skill in Database management i.e. SQL, Crystal report,Visual Basic and Navision is an advantage
