  1. The rule/law remains officially at 4 Thai employees per work permit. There is no official "exception".

    However, in the Bangkok area, they are currently accepting an "appeal" for reducing the amount of required employees from 4 to only 2. We have been 100% successful in applying with 2 Thai employees within the first year of company registration. In the subsequent years, it is at the discretion of the officer whether they allow a continuance of the 2 employees or ask for the increase to 4. We have seen both scenarios, with clients granted a renewal with only 2 employees and others asked to increase to 4.

  2. I would not recommend using the Thai consulate in Penang as they do no generally issue the one year multiple entry.

    Technically all embassies and consulates can issue the one year multiple entry B visa. However, in Asia, most do not. If Penang is a part of an existing travel itinerary you could certainly attempt the application, but the odds are very high it will be denied. Regionally, the most reliable option continues to be KL.

    You can make an application for a one-year multiple entry B visa in KL with the standard sponsorship documents from your employer and by presenting your valid work permit. Do not attach a re-entry to your existing visa. You will be making the application for a new visa at the embassy.

    The work permit is usually issued for one year and will not be tied to your existing visa, so there will be no effect when you leave the country to renew the B visa.

  5. "No" withholding tax.

    As the employer you are not responsible for submitting withholding tax on behalf of other companies the individual may be working for. So, if based on your calculations the annual salary is not over 150,000 (and the employee has not specifically asked you to withhold) - then no need to withhold. This does not mean the employee will not be responsible for aggregate taxes at the end of the year (from combined incomes) - but this then falls on them to be responsible for it.

  6. Part-time employees are not required to be registered in the Social Fund System. So, you can get a break on paperwork and it simplifies the process a bit.

    If the annual salary is under 150,000 THB per year then now withholding tax is due, also making the process easier ;)

  8. Condominium Juristic Person (CJP) must have a list of co-owners of the condo project OR you can consult the minutes of the meeting from the last annual meeting where it is required to list all co-owners.

    The Land Department only has the info of the registered owner of each unit. It does not have the updated list of present unit owners for the entire project. However, the land office has (read should have) the updated list of the registered foreign ratio.

  9. In regards to start-up costs, this can be split into two parts:

    1. The legal costs for the company structure that will be required for you to operate a restaurant/pub with the proper work permit(s). With limited details I would suggest that you are looking at expenses in the neighborhood of 75-100K including all government fees, work permit and licensing.     2. The cost for the actual establishment. This is really up to you. There is no minimum or maximum investment in this regard - the key is to have the right company set-up to remain legal.

  10. A personal checking account is most useful for people who are engaged in business activities as a sole proprietor or in a partnership. They are trading from their own individual name and thus have need for the corporate nature of checking.

    In other circumstances, it may be useful in scheduling payments of rent, car, or loan etc. It is a criminal offense in Thailand to "bounce" a check. The police can be involved immediately.

    Interesting note: post-dated checks are sometimes even traded as currency in Thailand - being sold to other parties at a 10-20% discount in return for the funds upfront.

    In terms of flexibility and functionality, you are much better to stay with a savings account. Some banks (not all) will not even issue passbooks for checking accounts and require you to request a statement from them directly.

  11. It is also dependent on whether Thailand has a double taxation treaty with the country in question.

    For example: when a payment is made to Google you are not required to withhold tax as Thailand has a taxation treaty with Ireland. However, you must submit the VAT - which you ultimately offset or claim back.
