    Finally my son has got a visa!

    Hi all,

    After all the fussy and crazy thing happened again and again...now my son finally got his visa (settlement, indefinitely leave to enter )

    He's due to enter uk on 15 May I'm so pleased!!! :) thanks god and Buddha !! ;)

    Now question::: As I am citizenship through married and my son's thai nationality!

    1) it's possible to apply citizenship for him?

    2) if so, how long do he has to live in uk before he entitle to apply?

    3) if not, then does he need to wait til his 18th birthday and then apply as a same way I did few years ago?

    Or any other way to apply?

    Any suggestion on this matter would be very much appreciated, thanks

    Thank you all for reply, yes this refusal had cost me so much!! But you know....I would like all the cost back but at the moment all I want is my son live with me.

    Even tho I still not even 100% sure when will my son going to get visa? When will home office contacting me?

    And I don't even know what to do from now...how long should I wait before I can contact embassy?

    I just can't believe a visa could messed with people life, emotional, nerve wrecking, financial so much?

    All I want it's them to confirm about visa that's it has granted!!! That's all I need.....

    As I read it, the respondent (UKVI) has withdrawn their decision to deny entry.

    2) An appeal shall be treated as withdrawn if the respondent notifies the Tribunal that the decision (or, where the appeal relates to more than one decision, all of the decisions) to which the appeal relates has been withdrawn.

    It is unfortunate that you have to go to all this but I assume you will now get a visa for your son.

    I hope you will also receive a refund of fees for the appeal and a good account of why the visa was refused in the first place and why it took so long for them to reverse their decision.

    Thank you, I hope so that's my son will get a visa stamp on his passport!

    But all the cost and time is 12 months that took them to made the decision!!!

    And now what can I do? Wait again? How long and how could I find out about the further information?

    Hi All,

    I've received the letter today says about

    Notice of withdrawal

    They ticked the box as below,(2)

    2) The respondent has withdrawn the original decision(s).

    And under box says...

    (The Tribunal is satisfied that this appeal has been withdrawn.)

    And the other letters say....

    Please be advised that the decision in the above appeal has been withdrawn by the Home Office.

    In accordance with rule 17(2)of the asylum and immigration tribunal(procedure)rules2005 the appeal

    Is to be treated withdrawn.

    The hearing listed for 2/4/14 may now be vacated

    So..the question

    1) does this mean my son get a visa to join me?

    2)or dòes it mean "NO" and then I need to apply a visa for my son again?

    3) where can I find out a bit more further details?

    Please help if anyone know?

    1.1) If his appeal is refused there is no reason why he cannot apply again; but unless all the reasons for the refusal are adequately dealt with he will only be refused again.

    1.2) If the aim is for him to live with you in the UK then a settlement visa is the only option.

    1.3) No, he cannot go to school while in the UK as a visitor; and a visit visa is only valid for 6 months anyway.

    Hi their,

    Long time I haven't return to the forum, as I am waiting for my appeal on 2/04/14. I know the judge does not answer straight away that is a "yes" or "no" they will sent letter in the two following weeks!

    Briefly: I applies a visa for my son to join me in uk on April 2013, the visa got refused so I files for appeal and due to appeal hearing date on 2nd April 14.

    Question?

    1), if the appeal visa is a NO answer, what can I do next?

    1.1, can I apply for visa again?

    1.2, does it's have other visa category apart from family settlement?

    My son he's 10 years old still in education

    1.3, does family visit allowed him to go to school ?

    Any body have a similar cases? Or any knowledge about this, any advice ? please help

    Rin, there is a lot more to sole responsibility than sending money to support him and calling him frequently.

    You need to have been the person making all the major decisions about his life, e.g. choice of school, over the last 6 years of your separation.

    The refusal notice says that when interviewed by phone, your mother said that it was she who did this, not you!

    As TonyM says, you must get a copy of the written transcript of the conversation between your mother and the embassy.

    But if your mother did say what the refusal notice says she did; you are going to have a very hard job getting this refusal overturned.

    You must get professional advice.

    How can I get copy of transcript ??? Pls

    Send a request by email. Send it to VFS ( the visa application centre) and ask them to pass it on to the visa section at the Embassy.

    Make sure you give the reference details from the GV51 ( refusal notice). Tell them that you require the transcripts quickly in order to submit an appeal.

    hi, everyone. thanks for all the comment...

    The sole responsibility thats i've got " its about im the one thats look after by sending money home to provided everything thats my son need, which it my mum and my sister who's sign the paper at the town offece, says thats its true...thats the child's dad never involved in his life! it only me whow support him on financial and visit him when ever i can and phone weekly." (but it hard to proof that it spend on my son)

    i've long time cos its will be better if he grow up in Thailand knew his own country first whice will be the best benefit for him

    i dont have enough docs since 2006 by phone because i dont realised thats i will need it, so i didnt kept it plus in the last few year we're opp in to paperless bill so we used all online, which it will no bill send to me! ( so im the stupid one that didnt keep it all).

    i dont blame anyone but some evident it hard to prove eg. things you talk on the phone which it hard to prove!! but anyway i'll do my best to find the record and the reson that they wanted whice it hard for the short time as 28 days!!

    I see from your previous topic that this is a UK settlement visa for your son and that have been living in the UK long enough to have been naturalised as British and so hold dual Thai/British nationality.

    In order to advise you further we need to know exactly what the refusal notice says.

    Can you post it here, first removing all names and any other information which could identify you or your son.

    hi their, need help please. im apply a visa for my son but we've got refuse as im leave him so long 6-7years but i send money home every month and go back every year, i have all the document but does not cover between 2006-2010 as it long time ago and i dont have the phone bill between these year....and all monies spended in thailand for my son its was no receipt as its all cash over there in the village!! which it i cant proof thats the money been spend on him??

    any advice please will help alot

    what is the best way i am appeal??? as ive got 28days for it
