  1. Is the foreigner husband married to a Thai legally allowed to remove his personal belongings and items which he paid for from the home he is living in after the divorce?

    This is a commonly asked question resulting from the often unclear final judgement of divorces in Thailand not overseen by long established firms like One Stop Legal Service.

    The short answers are:

    1) If the lease is only in your name then for sure you can remove everything that is yours and for which you paid.

    2) If the lease is in both names, then send her an SMS or email informing her of your intention to remove property you believe belongs solely to you and give her three days notice. If she gives a positive reply or no reply then proceed. Save that written communication for several months.

    3) If, on the other hand, she is upset with you and uncooperative, then go to the local police box or station and inform the police to make a report that you appeared there to inform them that you will remove items of personal property that belong to you. Ask for a copy of the police report and make sure it has a red stamp on it. Save that report for your records.

  2. I got divorced in Pattaya, got the house sold and received 50 % of the proceeds, even tough she had a Thai lawyer. In Thailand it's 50/50 by law, don't let anyone tell you otherwise.

    In our vast experience we have had more than 200 foreign husbands hire us to get property and other assets back from their Thai wife in a divorce.

    We have always received at least half of the value of the assets of the marriage and most of all of the value of the assets contributed by the husband with funds he held prior to marriage.

    We have been able secure up to 100 percent of the property in a divorce provided that

    1) the money used to pay for the property was a pre marital asset which the foreigner had and could prove by inbound bank wire transfer forms.

    2) the legal marriage was less than three years.

    3) the wife receives some compensation. Generally, land the husband bought upcountry for her family. Sometimes it is a bar or salon he bought during the marriage for her.

    More often than not, we have been able to mediate and negotiate with the Thai wife and settle the divorces within 60 days.In the cases that went to court, we have been able to conclude in generally 6 months in favor of our clients.

    If not more, we get at least 50 percent of marital assets less any child support necessary.

    It's a fair question to ask the fee schedule. At One Stop Service Center Co Ltd Legal Division we charge 40,000 baht for a divorce provided one person is Thai and both agree to divorce and are in Thailand. This fee includes a Thai lawyer writing any agreements required, i.e. Division if Assets, Child Custody/Visitation or Spousal Support, if required.

    As long as one person is a Thai if there is no agreement to divorce and settle all outstanding issues then the fee is at least 100,000 baht but not more than 200,000 baht and includes the above agreement, mediation and filing and litigating the divorce in court if required.

    We have mediated and negotiated more than200 divorces with a Thai wife and foreigner husband.

    Consultation is free for 15 minutes and a fee can be quoted after the facts are clear.

    We have another service whereby "after the love is gone" we get houses, land, businesses, bars and other assets paid for by foreigners but in the name of a Thai.

    We charge a small base fee and get 20% of what we collect.
