    Yes, tell that to the hundreds of thousands of new cases every year. Hiv is making huge new comeback. It's a hideous disease and public awareness needs to remain high. If hiv sufferers are stigmatised by that too bad.

    The fines that can be paid at the police station are listed in the criminal code. They are all in the section of petty offences. 

    Theft is a serious crime in Thailand and can't pay a fine at the police station. 

    The 30,000 is really odd and the way it was paid is odd. It would be interesting to see the receipt.

    As I have told,

    im in freedom not on the IDC, because my lawyer garante me, and I have to stay In Thailand for one more month, because the public prosecutor could contest the judge decision.

    the lawyer is not cheap, but a honest and decent guy.

    im here alone, and the lawyer knows that, so every day invite me to lunch or dinner In is house, with is family, always worry if I need something.

    in the prison have 2 guys who help me a lot, and because I don’t have my passport yet I can’t visit then.

    the lawyer arrange the things, and put me like is employee/ translator and Monday ill visit and bring food for the people who help inside the prison.

    maybe it’s important say, the lawyer, now a friend of mine is the Vice President of the Thailand lawyers Association

  5. I am sorry to bring you very bad news. Although you say you found it. You were at an airport where bags are all around. You made no attempt to give the bag to airport officials and you then attempted to leave the country with the items. In the criminal code it is theft. Your lawyer has misinformed you. Even if you paid 40000 baht and she dropped the charge, you have committed an offence under the criminal code 334 for theft. The sentence is up to 3 years and up to 6000 baht fine. 

    But you also are in section 335  (9)that the offence was in an airport, with sentence of 1 to 5 years. But if your offence is at an airport  (9) and at night  (1) the sentence is 1 to 7 years. So the least you should expect and prepare for is 1 year in prison. If you are very lucky the judge will give you a suspended sentence, however that will most likely depend on your plea. If you go to court with remorse and deep apologies and admission of guilt, then you save the court time and he most likely will give a suspended sentence. 

    If you go to court lying that you found it and didn't know it was theft  (at an airport ) as you are trying to do on thaivisa. The judge might decide that you need a stronger lesson about your wrongdoing and give you the one year. 

    Judges know truth from lies and we all aren't as stupid as you think. 

    Your best defence is to admit your guilt of theft, apologise very very much and show the judge you are truly sorry.

  6. Just a wee note to keep in mind.

    I don't have hiv, but after I had been here several years and had several liasons, I thought that I might be but chose not to know. Anyway, every year they had the free health check, but I refused the blood test. When the doctor asked why I said it was unhygienic to do that in the schools with so many people giving blood. 

    The yearly health check is optional. 

    As it turns out I did eventually have a test and I was fine. 

    But I can empathise with your fears because of my experience.

    3. Avoid flying in to Bangkok from nearby countries. Use land borders if possible.

    4. Avoid out-ins by plane. Do them at land borders but not Poi Pet.

    5. Choose a male Immigration Officer if possible.

    6. Have a flight ticket out if possible.

    7. Carry 20,000 Baht or equivalent in cash. This no longer seems to work though.

    8. Spend some time outside Thailand in other countries.

     

    I have to say, I well agree with number 5. 

    When I come to thailand, I will stand in the 2 hour cue for a male officer over the half hour cue with a female. 

    I find that whenever I have any official problem in Thailand,  the males are much easier to con. 

  8. After you deposit 10 million in your bank, the bank will inform the tax department. I'm not sure what the time frame of depositing the 10 million is. I went out to changwattana tax office and filled the forms to pay tax myself, even though I didn't have to. I use the roads, the health care, and many other services. It's only right to pay some taxes. I always feel better about it. At least I can say, I pay my taxes whilst criticising any government office.

    Well, I really didn't want to go into the whole story, it's long and complicated. 

    But because of the 90 day report mistake, there was also a misunderstanding on her yearly visa. So, in her case it all ended up to be quite a disaster. 

    So I simply recommended that he go and fix it immediately lest other complications arise. 

    Which is the main point of my post, which correlated with your own recommendation.

    Why not let them pay a fine and then deport them with ban from re-entering the country.
    I see the current process costing the state a lot more.

    It depends how much trouble the police want to make. It seems they do want to make trouble for him or they would have just let him pay the bicycle guy. 

  12. I don't think this is fake at all. 

    It's not funny. 

    334 in the criminal code says theft is punishable by up to 3 years in prison and a fine of 6000. 

    You could actually go to prison for stealing a pencil in Thailand. And stealing at night has an added 1 to 5 years with 2 to 10000 baht fine. 

    This guy is facing 1 to 5 years in prison depending on the judge. We've not heard from him in a while. He might already be locked up. But his lawyer has advised him extremely badly.
