1. So does this mean if I'm staying in my Thai partners rented accommodation, when I get there I have to go to immigration in Phuket and my Partner has to tell them I am staying with her? I have not done that before after being together 4 years, even though I'm staying 3 weeks.

In this situation, there is the owner, the leaseholder, and you as a guest of the leaseholder. Who is the possessor of the apartment? It is the leaseholder, ie your partner, and it is she who must make the notification under section 38 of the Immigration Act.

It's her friends condo she stays in, I'm just a staying there because she is.. if you get me.

4.

Could someone please explain these terms from the OP ?

1- "moving in to a new address" (ThaiVisa words)

2- "change of residence" (Hua Hin document words)

3- "temporary entry permit" (as only aliens with such "permit" must report)

- For me when I travel to see a friend 3 or 4 days, I have a "change of address" but not " a change of residence"

- Are owners of Tourist Visa or non-Imm Visa concerned? (temporary permit?)
1. This appears to refer to section 38 of the immigration Act and form TM.30 applies.

Section 38 : The house – master , the owner or the possessor of the residence ,
or the hotel manager where the alien , receiving permission to stay temporary in
the Kingdom has stayed , must notify the competent official of the Immigration
Office located in the same area with that hours , dwelling place or hotel, within 24
hours from the time of arrival of the alien concerned. If there is no Immigration
Office located in that area , the local police official for that area must be notified.
In case the house , dwelling place , or hotel where the alien has
stayed under provision of Para.1 is located within the Bangkok area , such
notification must be reported to the competent official at the Immigration
Division.
Making notification , in reference to the Para 1 and 2 of this Section ,
must comply with regulations prescribed by the Director General.

2. I cannot find the text "change of residence" in the document Prachuabkhirikhan Immigration Notice attached to the OP, but there is the text "change in residence" in the quoted English translation of section 37, clause 3 of the Immigration Act, Form TM.28 applies.

Section 37 : An alien having received a temporary entry permit into the Kingdom
must comply with the following :

3. Shall notify the police official of the local police station where such
alien resides, within twenty – four hours from the time of arrival. In the case of
change in residence in which new residence is not located the same area with the
former police stations , such alien must notify the police official of the police
station for that area within twenty – four hours from the time of arrival.

3. I see this as a reference to "the alien , who entered to stay temporarily in the Kingdom under Section 35, to remain in the Kingdom under any prescribed conditions". This includes every foreigner who does not have a Certificate of Residence, ie who is not a Permanent Resident, as per Chapter 5 of the Immigration Act. Therefore, foreigners with a "temporary entry permit" are all foreigners who have a permission to stay for a limited period, which includes all who arrive visa-exempt, with a visa of any kind other than an immigrant visa, or with a re-entry permit based on a permission to stay for a limited period.

Are owners of Tourist Visa or non-Imm Visa concerned? The OP says they are, with the text "There is also another reporting obligation, and this applies when a foreigner visits another province and stays for more than 48 hours. In that case the reporting of the new address must be provided to the police, or the immigration, within 48 hours."  This is a clear reference to Section 37, clause 4 of the Immigration Act, but erroneously mentions a stay of more than 48 hours instead of 24 hours as shown in the law.

Section 37 : An alien having received a temporary entry permit into the Kingdom
must comply with the following :
...

4. If the alien travels to any province and will stay there longer than
twenty – four hours , such alien must notify the police official of the police station
for that area within forty – eight hours from the time of arrival.

However, section 37 also says the following:

The provision of ( 3 ) and ( 4 ) shall not apply to any cases under

Section 34 by any conditions as prescribed by the Director General.

It was good of the Hua Hin immigration official to give the participants in the meeting a document quoting the text of sections 37 and 38 of the Immigration Act, but unfortunately this document does not also include the text of the the above-mentioned "conditions as prescribed by the Director General", whom the Act defines as the Director General of the Police Department.

5. Hi I was wondering if anyone can help me, I'm going to Thailand in 3 weeks for 3 weeks, I've had tourist Visas in the past, I stayed a gap year from Oct 2011 to Oct 2012,using single entries from Malaysia and a double entry from the UK then returned to the UK for 7 month then went back to stay with my Thai partner using a double entry and then applied for a single entry in Malay from July 2013 to January 2014. I have been back in the UK since January. I am arriving in 3 weeks and was planning on just getting a Visa Exempt when I arrive at the airport. I have a Thai partner who I've been with for 4 year. And I am planning to stay in her rented accommodation when i arrive. Do I or my Partner need to do anything? Apart from writing on my arrival card that I'm staying at the address of my Partner? Please help. I just want to do this right!

6. Can anyone please clarify these new rules for me...
I'm not living in Thailand and when I travel to Thailand I usually stay in the LOS for a thirty days, I will usually stay in Bkk for a few days before going on to Pattaya, Chiang Mai, Phuket, Huahin etc. I mix it up every time so it doesn't get boring, on the arrival form I write in the first hotel I stay at in Bkk, there is not enough room on the form to write in all the hotels/location I will be staying at, so from now on will I have to report to the local police station every time I go somewhere new?
What about package tours, will everyone on a tour be required to call in at a local police station when they get to a new destination?

7. So does anyone think I will have to apply for a Visa as I'm traveling after Aug 12? But for 3 weeks only.. then return to UK

No problem for you. As long as you have a ticket out within 30 day arrival.
Yes Ubonjoe I have a return ticket, it's just because I've read so many things about having a history of visas I've been concerned, I've been out of Thailand for 7 month now, so I'm hoping things are going to be ok for me

Most of what you have read may just be conjecture, Some people have written things that would make you think that visa exempt entries are no longer possible. Don't worry you will have no problem.

Thankyou! :)

9. these stories are the kind i want to hear, ive had back to back tourist visas in 2011- 2012 then back to the UK for 7 month then returning on a double entry in 2013 then lastly a single entry now ive been back in the UK since January, ive only ever had 3 visa exemptions. was worrying about my trip for 3 weeks end of august only going for 3 weeks but with past visas dont know if i would be picked out. only want a 30 day exempt..

Those back-to-back visas were back in 2011-12, thus a long time ago. As you have spent a lot of time away from Thailand what are you worrying about. The people who are being targeted are spending much more time in Thailand than out of Thailand. You aren't in that category.

Hmm because people are saying loads of different things, some things that make u think about your own situations, I just want things to be correct that's all..

10. There was an annoncement in the thai embassy in my country.

There are other official annoucement about that even it s not really clear about TR visa.

So yes, be careful after 12 august...

example : http://www.thaiconsulate.org/

That and everything else says visa exemption.

One of the problems is that some postings call exempt entries tourist visas which of course is wrong.

The aim is to avoid illegal worker with TR visa (and sure visa exempt as well). Nobody should expect to re-enter the country with TR visa (60 days) after 12 August without a proper "tourist" plan :

- Return ticket ( not just fly out to KL)

- Hotel Reservation or letter from thai host

- bank statement if you re unemployed.

Even in Ranong, they are already asking to show at least 20 000 THB....

It s maybe not really clear, but it make sens that it will get more strict regarding the aim of those rules.

Ok so if this is mainly people entering with visas staying more than 30 days, what about people like me who has travelled there and stayed there with Thai partner in the past and is returning for 3 week holiday. I've no idea what to do.. so stressful.

11. I've never had a red stamp and I've had like 6 tourist Visas altogether, not sure if it's just with.back to backs

That's like a totally useless comment without SPECIFICS of your 6 TR visas, such as where they were issued and over what period of time.Well in October 2011 to October 2012 I had 3 single entry from Malay and one double from the UK. Then 1 more single from MalayThen I returned to UK for 7 month,July 2013 I got a double entry from the UK then a single entry from Malay returned back to UK in January 2014. Still in UK now, but going back end of August for a 3 week holiday, planning on not getting a Visa.

Hopefully it shouldn't be an issue.

13. I've been emailing the embassy in London they told me to get a Visa even though I'm staying for 3 weeks and have return flight back. So confused because hull told me I'll.be fine, what to do? I've got visas in my passport from the past visits but now only doing a holiday! Do I get a Visa or leave it and get a 30 day stamp?

Sent from my i-mobile i-STYLE 7.5A using Thaivisa Connect Thailand mobile app

The embassy in London is not known to give good advice or to be a good source of information.

You can make your trip without a visa. You will the get the normal 30 day visa exempt entry without a problem.

Yea well that's what I thought but with all the carry on going on, I thought I'd ask, I didn't want to get turned away because I have back to back TV in my passport, but I didn't see the point in getting a Visa for 3 weeks, pretty disappointed about London embassy, for it being the main one anyway.
