No. Overtaking vessel will see stern light and than green light. Just because he sees green light he is still overtaking and he must assume he is the overtaking vessel and keep clear.

I don't know the circumstances involved but I know the law concerning Rules for prevention of Collision at sea, Bridge resource management and most importantly humans at sea.
It's never 100% one vessls fault

Poor navigation and piss poor bridge management pn both vessels. No comms between vessels sounds likely

Looking at the damage I'd guess the navy, but usually 75% and 25% at fault each unless restricted by draught etc but probably not at 56 miles at sea
