  1. Good Day,

As the title says I am looking to hire an Engineer or Technician with experience in installing and getting made-ready a German Plastic Film Extrusion machine.

Most of it is already installed, it is just a few minor problems with the electronics that need to be sorted out.

How it works (In a nutshell):

1.) Contact me, I will provide you an address and you come in person to inspect the machine. (Or we can do a video call to do a minor inspection of the machine to see if it is within your skillset, however a physical inspection of the machine will be necessary).

2.) Upon inspecting the machine you can give me a quotation on getting the machine ready. (The terms are negotiable and we are flexible, so please let me know any concerns you may have)

3.) Once we have settled on an agreeable contract for both parties, you will have open communication with the manufacturers of the machine to help guide you along the process of getting it ready. Any parts you are unable to fix or have fixed or cannot get replacements, we will handle.

    Kind Regards,

    IL

And I am amazed that you claim the container will be destroyed.

The contents yes, but the container?

By the way once goods are in a bond store you cant move them out prior to all fees being paid.

You are right I have never imported goods into Thailand.

    Australia is another story.

The onus is on you to ascertain  all paperwork is completed in the correct way.

Try and get responsible people to complete your show you how to declare your goods in future

If nothing else your misfortune has brought a smile to many faces

    Hello again,

When I referred to the container being destroyed, it was inferred that the contents would be destroyed and not the actual container. That is self explanatory ????

For example when you say that you drink a bottle of water, you aren't actually drinking the bottle but its' contents.

Another example is if you say you're going to eat a Big Mac, I would naturally assume that you would remove the wrapper or cardboard box before eating it otherwise I imagine it would pose a great choking hazard everytime you ate one.

Regarding your next comment "By the way once goods are in a bond store you cant move them out prior to all fees being paid."

My problem is that they would not let me pay any fees once the decision to destroy the container was made by Customs, so I was forced to wait without being able to release the container to them, hence the build up of fees.

Onto the next comment "The onus is on you to ascertain  all paperwork is completed in the correct way. Try and get responsible people to complete your show you how to declare your goods in future."

This is not the first time I have imported this exact container with the exact same wording on the documents, hence the reason why I was surprised by this turn of events. The broker I use is very good at what he does and is very honest, which is quite a rare quality to find amongst all people nowadays.

And finally "If nothing else your misfortune has brought a smile to many faces"

Well if there was a silver lining to all this... ????

  4. Hi,

Thanks again for taking an interest in this situation.

I've tried my best to answer your statements as seen below:

it's the container company which levies some of the charges and customs charges you for "hosting" your container. it is irrelevant whether the container is in the port or a customs warehouse.

It's my understanding that the entire reason for Demmurage charges was to prevent a buildup of containers on the port as having a lack of space can affect the efficiency of loading and unloading. So if the container is not on the port, then it is not affecting the loading and unloading efficiency of the port and therefore should not be liable to demmurage.

    4 hours ago, Naam said:

your problem is that you overlook that the shipping company cannot use the container and levies charges.

That's a fair assessment as the container is in use and the shipping company cannot use it, however wouldn't that be classified under container rental and not demmurage?

that means customs decided it's illegal.

Okay, if they decide it's illegal, then why not let me release the container to them immediately so that they can destroy it?

You didn't mention the size 20', 40' or where the container & contents originated, (USA?). As it was a temperature controlled container, who was responsible for maintaining the temperature level of the "can" after landing.

Where was the unit landed in Thailand, Bangkok or Laem Chabang?

"Frozen, pre-packed meat snacks" (Beef jerky style?)

    Hello Again,

Thanks for taking an interest in this dilemma of mines, I really do appreciate it.

The actual product imported is not a perishable item but is perfectly legal, I was only using the "Frozen, pre-packed meat snacks" as an analogy to help explain the situation better, but I see it may have complicated things. For now we can treat the product as something not perishable but legal.

The unit landed in LaemChabang and it was a 40ft container that did not originate from a first-world country.

The problem I have is that I am aware that in other countries when Customs takes a container for inspection or to be seized, they move it off the port and into a private bonded area. If this is the case I do not understand how I am liable for demurrage charges from the shipper if the container was not in their possession or using any of their space.

The other problem I have is why Customs would not allow me to have cleared the container first and then release it to them so that they could destroy it and I wouldn't have to accrue any demurrage cost.

I'm open to any reasonable suggestions as to how to deal with this problem.

    HI,

    Thanks for the response.

The situation I described was only an example.

You are that far up  ???? creek it aint funny.

You stuff up the import docs and cry about demurrage.

So the shipping company has to take a loss on your behalf.

And don't forget you will be hit up for the power to run the freezer.

I would love to be in the office when you get shown the real world

    Hi There,

This is an example I am using for explanation purposes only.

The import documents were a result of lack of information on my brokers end, but the product imported is perfectly legal.

Customs decided to destroy the container when they seized it, however once they made the decision to destroy it, I was unable to clear the container or move it to another bonded location  where it would avoid demurrage charges.

This is not first time I am importing this exact container with the exact wording on the documents and the only explanation customs gave me as to why the container was seized went along the lines of "Before Ok, Now Not Okay".

I've been on this forum for a number of years now and I know that there are people with high intellect and troves of experience here, but from your response I can tell that you are neither. That being said I would like to thank you for the response and the good chuckle ????

Was this a Reefer container by any chance, since the contents were supposedly frozen?

How many deceased animals made up the container of Pre-packaged meat snacks?

Is English your first language? After all, the meat freezers at Makro are packed with "Deceased animals, fish and birds:"

    Hi There,

    Thanks for the reply.

I'm going to assume by reefer you meant Refrigerated and not marijuana ????

For this example, I am going to say yes the container was refrigerated and it was all made up of beef (cow).

English is my first language yes but I am using this as an example.

What I would like to know are what are my options for removing or reducing the demurrage costs which Customs caused by seizing the container and not allowing me to clear it.

Also I assumed that when Customs seize a container, they normally move it to one of their warehouses until they can destroy the contents. Can anyone verify this?

Come on will you a full description of what would be in the container would help.

If it's illegal it would be seized of course.

You still have to pay the shipping agents.

    Thanks for the reply.

The goods aren't illegal, it's just bad documentation.

For Example, instead of putting on "Frozen Pre-Packaged Meat Snack" on the documents, I put "Deceased Animal".

As such customs saw fit to seize the container and said they would destroy  the contents.

After seizing the container and deciding to destroy it, they held it for quite a long time without doing anything. In that time the Demurrage costs built up and now I am looking at paying a substantial amount in demmurage costs that surpass the value of the container after which the items will be destroyed.

Hence the reason why I am looking to either Forfeit ownership of the container OR avoid paying demmurage.

Hope this clears up any misunderstandings.

  10. Hi Guys,

Thanks for all the great answers.

Was hoping to find something a bit closer to Pluakdaeng, but then again beggars can't be choosers :-)

I'll try it out Siam Physiotherapy Center in Pattaya.

    Thanks for the great answers.

  11. Hi Everyone,

Apologies if this is in the wrong forum as I wasn't sure where to post this.

Does anyone know where I can find a decent Chairopractor in Sri Racha or Bowin or Pluakdaeng areas?

If anyone knows someone please PM me or post in this forum.

    My back thanks you :-)

  12. Hi,

I've tried searching this on Google but alas the Google guru was unable to sufficiently explain what I needed.

The questions I have are as follows:

-Can someone explain to me what exactly does the DBD Certificate do, as in what it can be used for?

-Also what are the differences between the shareholders and the people listed on the DBD?

-Finally, the people listed on the DBD, what powers or rights do they have in regards to owning/controlling a company (as in owning and controlling a company's assets and bank accounts)??

Your answers regarding the questions above will be most appreciated.

    Thanks

    IL

Is this EEPROM from a VSD? Variable Speed Drives (VFDs) are not really that expensive these days (depending on the size of motor). They have so much functionality that they practically do away with having to build a motor cubicle.

    Hi,

    Firstly thanks for the response.

Secondly, thank you very much for this website, this has been tremendously helpful.

Finally, due to circumstances involving a Native Company that specializes in fixing Servo Drives and Inverter Drives, they had "unfortunately lost" the plastic covering for this board.

That plastic covering has all the information regarding the model number of this drive.

It is about 3 drives that are connected together, and they "unfortunately lost" all three of the plastic coverings.

All I can tell you is it has FELX302265GP2 and FELX302265GP3 written on the side of the board and it has CMS2 45/90 LC840TF 10V 2200CR on a sticker on a different part of the board.

  14. Hi Everyone,

Thanks for all the great answers.

    To clear up a few things;

I have already tried to contact the company for the Eprom, but they told me that a new one will not have the program on it as they do not supply the program for the EPROM.

This is done by the company who programs the drive.....

I contacted the company that programs the drive and they told me that they will not be able to help with the Eprom as they do not have the program.....

Hence the reason why I am looking to repair/Reprogram this EPROM.

  15. Hi,

Firstly thank you for taking the time to read this post, it is highly appreciated.

As the title says, I have a problem with an EEPROM.

7 pins/legs have been broken off from an EEPROM making it unreadable, but there are still metal pieces at the sides where it can be soldered.

Does anyone know of any professional places in Thailand that can repair the EEPROM and transfer the information to a new EEPROM?

The EEPROM cannot be replaced due to the information stored on it.

Any suggestions regarding the EEPROM you may have will be highly appreciated.

    Warm Regards,

    IL

  16. Hi Guys,

Thanks for all the great replies.

Okay, so I managed to find out that a signed note from a NURSE qualifies as a sick note but one signed from a doctor qualifies as a MEDICAL CERTIFICATE.

What I found out is a note from a nurse takes only five or so minutes as you can simply walk into a clinic and get it BUT a note from a doctor requires the doctor to first examine you before issuing a note.

So for all those employers I suggest setting a policy for accepting MEDICAL CERTIFICATES only as the work requires the employee to be in good health.

    Regarding johnatong:

    Hi There,

    Thanks for the replies.

Regarding the 3rd question ( How does one prove that they are actually sick and thus be entitled to sick leave), can a nurse issue someone a sick note which can in turn be used to get sick leave pay?

    Regards,

    IL

Why would you want to "prove" someone was sick ? Do you really think a "certificate " is proof of illness ?

A "certificate" is easily obtained if you insist on one.

I can obtain such a certificate for 50Bht and would do so if I worked for an a-hole.

Grow up and learn some management skills.

Why would I want to prove someone was sick?

Well from my perspective, if I am going to be paying someone money, I would require labour time in return.

No Labour Time = No Money

While it is unfortunate that people may not be able to come to work due to things out of their control, for example, being sick, I would actually expect them to be sick. HOWEVER, if they are using "sick leave" to get a day off AND get paid, well that's not fair to me or the other employees who now have to work harder in order to "pick up the slack".

Your other question " Do you really think a certificate is proof of illness"

Well not a proof of illness, but a proof that the person actually went to a doctor to be examined so as to make sure there is nothing wrong with their health.

If there is something wrong with their health then the doctor can prescribe medicine/rest and we will of course pay for work missed due to illness so long as that certificate is presented to us.

If there is nothing wrong with their health, then we know that the employee is in good health and can resume working but we will still pay for the work that was missed during the time the employee went to see the doctor, so long as that certificate is presented to us.

I can obtain such a certificate for 50Bht and would do so if I worked for an a-hole.

It is such a relief to hear that you are capable of navigating your way to a hospital/clinic in order to retrieve such information as this would be necessary in the event that you were to damage your hand (and/or computer) as a result from getting angry from a post on a forum.

Grow up and learn some management skills.

Normally when I have nothing to add to a conversation, I would remain quiet, but you sir....You are a true gent and scholar with such deep thinking and artistic wordplay......I am truly astounded by your level of critical thinking analysis and your ability to read.......

"Grow up and learn some management skills" a phrase that should have been coined in the halls of scholarly Gods where Shakespeare himself would have been dumbfounded by such skill with the written word.

    Thank you sir for your advice and to finish this post I would like to ask you a question which I am sure you are capable of answering given your vastly superior intellect of such things;

Do you happen to know the meaning of the word "sarcasm" ?

I can obtain such a certificate for 50Bht and would do so if I worked for an a-hole.

  17. Hi There,

Firstly thanks for taking the time to read my post and I hope that this post can also help other business owners with their questions regarding sick leave as well.

So an employee is entitled to 30 days annual sick leave as per section 32.

What I wanted to find out was:

1.) Can an employer request a medical certificate every time an employee takes sick leave?

2.) Can a medical certificate be issued by a nurse or must it be a doctor?

3.) In Section 32 it states "An Employee is entitled to sick leave as long as he or she is actually sick" ; How does one prove that they are actually sick and thus be entitled to sick leave?

If anyone has any answers regarding this it will be highly appreciated.

    Regards,

    IL

  18. Hi There,

As the title suggests, if a new person gets a contract for 10 months as a general labourer(or restaurant worker, or factory worker), what happens at the end of the 10 months after the contract is complete?

Does the Employer need to pay severance?

Should the Employer renew the contract (assuming it can the contract be renewed) will it be considered a new contract or an extension of the original contract?

    Reason why I am asking;

    Labour Protection Act BE 2541

    Section 118

    Paragraph 3

"The provisions of paragraph one of this Section shall not apply to an Employee whose employment is for a definite period and the employment is terminated at the end of that period."

Any guidance you can provide will be much appreciated.

    Thanks,

    IL

  19. Hi There,

Thanks for taking the time to read my post I really appreciate any help you can provide.

I wanted to know if there was any Yearly Tax that was to be paid to Social Office at the end of the year on the TOTAL wages paid to employees.

I.E if you paid all your employees 1,000,000 Baht/Year in total, does social charge you a 0.7%Tax on the total wages (7,000 Baht)?

    Thanks for your help.

    P.S. Happy New YEAR!!!!! :-)
