    When we bought the land, we thought going over the river would be easy: it s a rather small creek and our plan was to build a bridge over it to connect to the public road. What we didn't know then but that we do now is that the river flash floods a couple of times a year which destroys all the bridge locals have tried to build over it... even the neighbor we're talking about. He has seen two 700.000thb bridges destroyed over the last 10 years.

     

    Precision: the property in question is used by a non-profit organization that I run, an environmental education project.

    I live in Pai, Mae Hong Son.

    I am facing a problematic situation that I would like to understand from a legal standpoint.

     

    The property on which I have a 30 years lease has no direct access to a public road. It has not been a problem so far as the neighbors have been letting us use their pathway. Now they want us to pay rent: we understand why but can not agree to the price and conditions they are asking from us.

    We are looking into options to build access to the nearby public road, which means going over a small river: we first need authorization from local authorities and time to build the road and bridge.
    Unfortunately, our neighbors are not patient and have forbidden us to use their road anymore, literally from one day to the next.

    Of course we want to minimize conflict but at the moment I can not get to my house with my wife and two young kids without going over the river and walking more than 200 meters through fields, which is very inconvenient...

     

    What I would like to know is:
    - Is it legal for them to forbid us access to our property or require rent for their road if we have no other option?
    - Considering our goodwill to build our own road/bridge how can we regain access to their road until the construction is finished?

    I'm looking at insurrances in Thailand for me and my family. I'd like to look into AIA but can't find any direct contact on google... Their corporate website for Thailand is all in Thai and I can't even send them an email to get a quote...

     

    Does anyone know how to get in touch with them or one of their agent? Thanks a lot!

    I'm starting this topic because I can't find answers to my questions on the forum, and keep having different answers from people I ask around...

     

    So here is the thing regarding volunteering in Thailand:

     

    - There is a Volunteer Visa: non-imm O. Great thing. Allows you to stay one year in the kingdom and benefit from work-visa. I costs 22.500bht for a year (taxes) and I've heard that you can even have one only valid for 6 months for cheaper: (of course you have to ask the cost of the visa itself (80USD), plus extensions, plus other documents).

     

    - BUT : there are so many projects everywhere in thailand, especially up north around chiang mai, that depend on volunteer help (exemple work-away and wooff). It's usually shorter periods, more like 2 to 4 weeks I guess. I am wondering what the law has to say about that. Is it legal to have non registered volunteers work on a project for a short period of time? I asked the question to the people that run WWoof Thailand and they tell me you can have volunteers for up to 30 or 60 days (which doesn't sound like a clear and precise answer to me).

     

    Anyone has legal insight on the matter?

    I say 'Tour Operator' in the topic's title although it's not really my activity... I have a newly created foundation operating in Pai, MHS, to support organic farming and eco/agro-tourism. As part of my fundraising activities, I plan to bring my donators on tours to show them the projects they are making donations to. So basically I'll be touring different projects around northern thailand for 10 days to 2 weeks with up to 10 people at a time. We'll be driving around a mini-van from place to place, and engage in small farming and crafrs workshops.

     

    My question is: what kind of insurrance should I have to cover any risk of accident, on the road or on sites?

    I am french, so are my wife and son.

    We are actually in thailand, came in with a 30 days exemption and will go to Ho Chi Minh beginning of december to apply for a new visa: 1 year volunteer for myself and 60 days tourist for my wife.

     

    My question is: does my son need to apply for his own visa at the embassy or can he come under my visa or my wife's? We have had different versions of the story and would like to make it clear and stay within the law.

     

    Last year we were asked to pay for his own visa in Vientiane, but then the immigration officier when we did our extension told us it was not necessary. But when we went o na border cross to activate 2nd entry we were told he was on overstay and would have a red line on his computer file (although they told us they would be nice to us and not ask us to pay the 15,000bht)...

     

    A friend also told us he could stay his mother's visa if we had the family book, which we do...

     

    Can anyone clarify the situation for us please?

    I am inquiring about setting up a foundation at the moment, and keep reading about Associations as being another common status in Thailand. Can anyone inform me as to the difference between both?

    - Can you apply for a work permit / visa through an Association?

    - How much money do you need to create an Association (250-500.000 bht for Foundation)?

    - What other practical difference are there?

    I am looking for information regarding setting up a foundation in Thailand to support Community Developpement and Environmental Education. I have found some basic information online and am in the process of getting in touch with some lawyers for professional legal advice, but I would also really appreciate first hand experience from the community!

     

    One of the things I've read is that it is to the discretion of the thai government and the ministries concerned by the foundation's activity to give a green or red light to the project. Do you have any idea what the chances are for a community developpement and environment edication project to be accepted?

    This topic might sound really weird to you but here it is.

    I have read two articles recently in the french media, both stating that french citizens would not be welcome anymore in the kingdom, starting 2017, because of the polemics about the burkini and the islamophobia in the country... The artciles state that only visa on arrival will be delivered for 3000bht, and that no other long term visas will be delivered. Residents would also be contacted "to be asked to leave the kingdom as soon as possible".

     

    My question is: is this true? It sounds unbelievible to me, but I couldnt find any info on the web as to wether it's an hoax or not...

    I am making research regarding opening a small business as a foreigner in Thailand and have met a few lawyers to answer my questions, but only one of them gave me a solution (an attractive solution) to scale down the charges and avoid having to need all 4 employees. Here it is. I hope someone can confirm the possibility and legallity of such an option.

    My lawyer assures me that IF:

    - I get a non imm B visa from Laos, and then a multiple entry from Penang

    - I get my work permit from labour office

    - I leave the country on a boarder run every three months (rather than extending the visa at the immigration)

    Then:

    - I can legally run my business without employees

    - I do not have to pay taxes.

    No other lawyers offered that option.

    My question is: is this legal? has anyone done it? how can i get a work permit prior to proving I employ 4 thai citizens? are there any risks in doing that?

    My interests lies in opening a small family run business of producing and transforming organic foods, and having 4 full time employees right from the start is too heavy a charge in my P&L. That is why I am looking for solutions to start small and safe and eventually grow in the coming years to employ more people.
