    I was added to the house book last year when I received PR. I tried to apply today (outside of BKK) based on marriage and children.

     

    The reason given for not accepting my application was that a minimum of two years on a tabien baan is a mandatory requirement.

     

    The officer said blue book or yellow book and changes of addresses do not matter, but at least two years house book tenure is required at the time of application.

     

     

  2. Serious question... Do schools here require parents sign permission slips or some other consent document for their children to go on field trips like this?

     

    There is no way I would allow my children to participate in this type of activity and I am sure most other parents, Thai and foreign alike, would be outraged if the school and local officials intentionally put their children in a situation where they could be potentially exposed to smoke from a wholesale marijuana burn-off. 

     

    The kids in the photographs look like they are pre-teen or early teenagers.

    I also live in Chonburi province and am trying to apply for citizenship.

     

    The special branch in Bangkok have told me I must apply at the provincial police HQ in Chonburi city. This is consistent with the information on the ministry of foreign affairs website and the accounts of other people on this forum and elsewhere that reside in the provinces. 

     

    However, the Chonburi city police HQ have told my wife and I that they do not accept applications for citizenship and that this must be done in Bangkok. My wife has tried to explain what is stated on the government website and what has been explained by the Bangkok police, but the reception desk staff at Chonburi police HQ are adamant that citizenship applications are submitted only in Bangkok and that they do not have application forms or an officer tasked with handling citizenship applications at their police station.

     

    Please share your experiences about applying in Chonburi on this forum or by PM as I would appreciate any advice you can share. I am sure there is a officer at Chonburi that can take citizenship applications, but all my attempts to find out who this is and how I can contact him/her have been unsuccessful.

    There are some work permit offices that still follow the 2 employee rule for marriage but not sure about PR.

     

    When I did my first work permit renewal as a PR last year, I was told that the 1M baht capital / 2 Thai employee regulation would only apply to holders of O visas or marriage extensions and that PRs and holders of B visas or employment extensions that are married to Thai nationals must have an employer company that meets the 2M baht capital / 4 Thai employee regulation.

     

    I am unsure if this is the actual regulation or the interpretation of my employer's Labour office branch, but as the company met the criteria of 2M capital + 4 Thais per WP anyway, I did not push for further explanation. If this is correct, then it is clearly one area where PRs are at a disadvantage to non-PRs.

  5. I got my permanent residence in October last year (applied in December 2013). I tried to apply for a pink id card at my local baan amphuer in Bang Lamung but they gave the usual answer saying this card is only for Laotians, Cambodians etc. Does anybody have experience in applying in Bang Lamung, Pattaya or Sri Racha?

    I got my PR pink ID card at Banglamung last year. I applied at the same time as adding my name to the blue house book, but had to go back a week or so later for photographing as the ID staff were not familiar with the software for the foreigner card. The card came about 1 month later. I was referred to the lady in charge of the house book section. She was very helpful with the house book and ID card.

    Yes, I got it from Banglamung last year. Mine is for a permanent resident. I needed to see the lady in charge, she was very helpful and knowledgeable about the card. The card was printed in Chonburi city and sent by post to Banglamung about one month after I was photographed.

  7. I will have completed three years on a single work permit in January of 2016.

    But, it seems that the annual application window closes at the end of January. Is it possible for me to submit an application when I have two years and eleven months on a work permit, then reach the three year mark prior to the review process? Or would I have to wait another full year.

    In the latter case, I would probably apply for an Elite Visa instead.

    you need to have 3 years on a single Non Imm Visa with uninterrupted extensions, not a single work permit

    yes you still need the work permit but the Non Imm and extensions are non negotiable

    Did they change the regulations? During my times, it was 3 years on the same work permit. If you were in the country on non-B for 10 years but just changed jobs and were therefore on a new work permit, you'd have had to wait until 3 years on that work permit were competed. Unless memory does not serve well.

    I don't think you get a work permit on an Elite Visa, but that is off-topic here.

    PH59 is correct. It does not need to be 3 years on the same work permit. I changed employers during the 3 year period before my application. What is important is that you don't break your extension for 3 years and that you are above the income threshold for all 36 months prior to your application.

    Also, you do not need 3 "full years" of personal tax returns at the time of submitting your application. I arrived during 2006 and applied in December 2009 using tax returns from 2006, 2007 and 2008. I was asked to provide my 2009 return in early 2010.

  8. I have previously tried to request 6 month extensions at Jomtien and Chachoengsao immigration offices. Both have told me I must do this in Bangkok. I have also asked Bangkok Immigration if I can request 6 month extensions elsewhere, they have told me I can only do it in Bangkok.

    I originally applied for PR at Chaengwattana in 2009 when I lived in Bangkok. For several years I have used my Chonburi address on my 6 month extension applications and it has never been questioned by the Bangkok Immigration PR desk.

    I have been able to get re-entry permits in other provinces. But I have not yet tried at the airport. Does anyone know if re-entry permits are available for people with "PR under consideration" status at the airport?

  10. I applied in 2009 under the business category. I changed jobs in 2011 and went to CW to confirm if I needed to leave in 7 days or do anything with my regards to my current or next 180 day extension. I was prepared to change to a marriage extension, but they told me no immigration processes were required.

    They told me I had the option to change from 180 stamps to a 1 year extension of stay based on employment or marriage if I wanted to submit all the required documents. The change would not affect my PR under consideration status, but would mean that only annual renewals would be required. I kept with the 180 day stamps.

    I got another 180 days in late February. I was told that 2009 applications were now back at the MoI and that they did not know when they would be approved.

    This translation of the regulations and everything else we have read and been told is consistent with 1m baht capital for a married foreigner work permit. My wife and I have found nothing in English or Thai to back up what the labour department officer said about directorship and shareholdings or the reversion to 2m baht capital per married foreigner for the 2nd and subsequent WPs.

    But arguing with the officer is futile, so we will start the capital increase process.

  12. Hi, I hope some of the experts here can provide some advice,

    We were told by a labour department officer that the relaxed work permit requirement of 1 million baht capital for a foreigner married to a Thai national would only apply to a company's first work permit and that the WP holder must be both a shareholder and director of the company.

    When the company applies for a second work permit for a married (or unmarried) foreigner, the requirements for both work permit holders revert to the normal case of 2m baht paid up capital per work permit. So 1m baht capital for 1 work permit but 4m baht capital for 2 work permits.

    In our case, we have a 3m baht capital company with 100+ Thai staff and currently one work permit for the company director/shareholder who is married to a Thai.

    To get a second work permit, we were told we would need to increase the capital to 4m baht regardless of whether the foreigner is married to a Thai or is a director or shareholder.

    In our case the foreigner is married to a Thai but will not be a director or shareholder. We are not a BOI company and the application was in a province far from Bangkok.

    I could not find anything on the internet that confirms or refutes this, so any advice would be much appreciated.

  13. Hello, Greetings! This is my first post so please be kind. :)

    My Thai company has to pay a Singaporean company for advertising advice and reimbursement of some costs that the Singapore company paid on my behalf.

    Must we also pay 15% withholding tax and 7% vat to the Thai Revenue Department?

    My accountant said that we don't have to pay the 15% withholding tax because there is a double taxation agreement between Thailand and Singapore.

    I read this agreement but don't understand if an exemption from withholding tax is allowed. We don't receive any income from Singapore and have no other business there.

    Could someone in the know please confirm if the 15% tax must be paid in Thailand?
