Thanks everybody for your help and your time! It's been really helpful!
To summarize:
-Go to the airport while avoiding being caught
-bring 20 000 thai money and I negative covid test
-go to the immigration desk, pay the fine and come back to Austria.
-no lawyer needed
Btw he is not my friend but a relative -brother in law- (For everyone who called him my friend). But that's just a detail
Ps : he is not the guy that police caught today, his flight is next week
Thanks again everybody ????????

This feels like one of those "I know a guy" or "I have a friend" posts ???? Either way, glad some good info was posted here, good luck!
I am not even living in thailand and never been there. But thanks.

Aint it better if he is in contact with a lawyer on phon when it's time for him to pass through the immigration?

No it isn't. The maximum fine is 20,000 baht.
He should go to the airport as soon as possible and fly out. He will get a 3 year ban and fine.
If he gets picked up by the authorities before he gets to the airport then things will get much more serious for him.
How can he avoid to be caught ? Asking someone to drive him to the airport?
Thanks for your answer

He will have to get some money ready possibly a minimum of 50,000 baht and any lower he will miss his flight for sure. Or to pay the overstay fine of a specified amount per overstay day..its gonna be a whopping big sum I am afraid.
Oh geez, I just looked and 50,000 thai bath is almost 1300euros.. but at least it's looking like he won't have to go to jail...

I think they will get some money and ban him from thailand maybe 1 or 5 years. He wont go to jail. Wait more people answer your post.
Also you can check this forum because have many posts about this too.
Thanks for your answer. Maybe I was looking wrong but I didnt find any topics about Visa overstay in this forum, but I'm new here so maybe I don't understand how the research bar is working.
How you can be sure he won't go to jail ? And how much will he have to pay ?
Thanks

Hi everyone,
I'm creating this topic because my brother in law is currently overstaying in Thailand for almost 2 years (about what I understood its clearly more than 1 year).
What charges is he facing ? Will he go to jail ?
He already bought a flight ticket to come back here (Vienna, Austria) but he looks like scared to be apprehended and maybe he will not catch his flight.
Thanks for reading me
