When national guards are federalized then they are in same category as the other regular active duty services. And the Posse Comitatus applies. However the Posse Comitatus act can be suspended if the president invokes the Insurrection Act

The president can federalize the states national guards. Then this combines them with the rest of the active armed services. So now the Posse Comitatus act apples to the national guards. The only way Posse Comitatus can be suspended is if the president invokes the insurrection act. Unfortunately Trump has not done that.

Good and military lawyers and judges should displace all the other saps for judges . That are sandbagging Trump and overreaching their authority.As well as releasing criminals on the public. And if Trump were 1/4 the fascist the left claims these judges/saps would not be heard.
