I can't count the number of people I know over the past 35 years that have been scammed in major property deals in Phuket!
Sadly, investors don't realise that they can't really own land in Phuket or anywhere else in Thailand and because of this it is only just a matter of time before it is all gone and they are broke and destitute and have to leave with their property now owned by unscrupulous Thai groups that specifically target expat landed property owners.
Police, banks, government officials and the legal system actively support this criminal behaviour because they make huge amounts of money from it.
Sad and you would think people learn but they don't!

After riding a motorcycle for 36 years in Bangkok, people need to know that riding here is not the same as the UK! Sadly many people don't have any real riding experience and just jump on an automatic motorcycle and just go and think the magic carpet ride will save them!!!! No the rules don't change!
If you have no helmet and you hit you head you will die!
I remember someone at an Embassy in Bangkok saying they take 1 farang a week out of Samui in a body bag!

Sadly, identity theft is so common in this country that government officials at times lose sight of the humanity necessary to show respect to an individual who is not able to present themselves in person. Land title transfers are a particularly difficult act as a whole families property assets are effectively changing hands and DO end up in the wrong malicious hands defrauding generations.

The guy in the photo is Police Major General Archayon Kraithong nickkname (golf) who is a deputy commissioner of Immigration, but is on loan to RTP headquarters to act as their chief spokesman! Nice guy, that has been my friend for more than 15 years. Speaks almost perfect English! Very straight in what he does personally with me.

I have just driven back around this bend today coming home from Srisawat and have done hundreds of times over the past 30 years. There are Huge Signs warning people in English and Thai, telling people to use engine braking and not to rely on brakes as they do and will overheat and not work!!!!
There are guardrailings and cements bolsters which the bus rolled over this time again! Sadly I have seen and continue to see many Thai bus driving heros that ignore the signs and crash at this last bend less than 300 meters from the flat road at the entrance to the Srinakarin Dam.
It will never end!!!

After 20 something coups and 30+ year of watching Thai politics, the populist present elected government is as always subject to the whims of the military elite, who WILL step in, if they feel their power is diluted or the elected government doesn't serve their needs.
The only thing that has changed now that was never present in the past is, that we now have second by second social media coverage which is very powerful!
Does it have the power to limit bad actors, or is it going to be the same, the people with the guns can still run the people with the social media?

In modern times Chinese criminals escaping has been going on since 1946 and the reason the re-entry permit system was instituted. This allowed Immigration to check with police head office if Chinese triads leaving Thailand had outstanding criminal cases against them before leaving.
With the inception of an online Immigration computer database, Immigration can now see all and knows all. Sort of rendering the re-entry permit system pointless! I have pointed this out to a deputy immigration commissioners and suggested that it should be scraped!

From my observation, there are 2 types of lawyers in Thailand : litigation lawyers and mediation lawyers.
99.99% of the lawyers are mediation lawyers. These are the "best" lawyers in town because they always claimed they have "never" lost a case. Of course, if you don't fight in out in Court you can never lose a case. That is what they will not tell you.
After 36 year living in Bangkok and having been to court as an interpreter hundreds of time I disagree! There are only 2 types of lawyers in Thailand honest not rich lawyers and crooked rich lawyers!

This is not a legal precedent, as there have been many cases in the past, in which the court has found that the person who invested the money to purchase the assets while in a relationship, retains the right to use the asset or to liquidate them and retrieve the money.
Sadly, it also takes an honest and competent lawyer to do this! This is where the problem starts as the woman will often cut a deal with your lawyer to mess up your case so she wins.

I have been here so long and got so used to jumping through immigration hoops, I am prepared for any and every eventuality. After 32 years residence, the majority of which are on 1 year extensions of stay, with the same wife and son for more than 20 of these, I don't ever expect to be on anything else. The thought of have permanent residence or Thai nationality is still so far away I can't even think about it!
Living abroad permanently requires us to be prepared if there are any changes to local sovereign laws!
I am certain I will die here.

From experience with friends who have gained Thai nationality, they give you back your passport or send it to your embassy!
There is no requirement for someone acquiring Thai nationality to give up any other nationality, as there is no requirement for a Thai person having acquired another nationality to give up their Thai nationality.
Yeah the big one for my son and for every Thai man is, if your son will be drafted at the age of 20. There are options to avoid this and they are well known to most people.
I believe the army doesn't want you to be drafted if you are more than 30 years old?

I have 3 nationalities and will acquire another shortly!
Having more than one nationality is normal and not illegal, even in Thailand.
In this world of regular world travel and people living in multiple countries, it is inevitable that people are going to qualify for multiple nationalities.
Unless it is specifically against the law in one country, that you are a national of this country and cannot be a national of another, as in Myanmar and The Philippines, it is normal.
Having more than one nationality allows ease of visa free travel and the ability to move at will and work and reside in any country that you wish!

From real experience this is how it works!
Your Thai parent should go to the Thai Embassy or consulate in your country of birth with you, to show their Thai ID and to confirm that you are Thai by descent.
You should bring your original birth certificate clearly showing your Thai parent's name as in their Thai ID card of Passport as this is required.
Copies of your Thai parent's Thai ID card, Thai house registration and Thai passport will be required!From experience, being in London is going to complicate your application process.
Its never easy and its never quick to acquire the nationality of any country by descent, as the issuing government will wish to confirm that the info you give is true and that you do indeed qualify.

All Thai people born in the last 75 or so year have a registry in the central citizenship computer, that can be accessed on line from all government offices anywhere in Thailand. Its called the tabian rat ทะเบียนราษฎร์ in Thai.
I have seen people older than 100 registered there, so it will get 99% of people who have Thai nationality.
You just need to go to the district office near where your parent was born and allow the required investigation to be undertaken to verify that you are the legitimate child of this person, to be successful in recovering your Thai nationality.

There is a record of your mothers birth at the Amphur and, as such her Thai nationality is still in existence.
You will need to present this to the Thai embassy in NZ and after several months they will issue you an temporary ID and Thai passport!
I have dealt with several cases like this and it is not very difficult to retrieve your Thai nationality.

If a foreigner is arrested or surrenders themselves to Immigration on an overstay charge, as long as it is before 8:30 am they will go to court that day and a judge will give decision that day.
A denied entry is a bit different!
You are not at the IDC you are at the airport. The system is stacked against you, so unless you are on good terms with a lawyer and he is willing to act for you, you are dead meat!
Yes immigration seems to be clamping down on things at the moment.

The reason we have a bit draconian overstay punishment is that many people overstayed and broke the law and complained about being punished for it!
The reason people are not just sent to Singapore or Hong Kong anymore is, because of one British gentleman who was being deported back to the UK but not under guard to serve jail time for human trafficking, but decided he would jump ship at a transit point and fly back to Cambodia where he still lives. This upset Thai Immigration and since then it has been flag carrier only to country of origin, with passport in hand of captain!
Some people were deported on reasonable grounds but did it again and again. One Swedish man was deported after 3 months overstay, 10 years in row!
Immigration looked at other Western countries laws and modeled this new regulation after them!

Seeing as I live at the IDC and court I thought I should weigh in on the OPs post and dispel some rumor and misinformation. I have helped dozens of people through this process!
9 years is a long time to overstay and the courts are taking a dim view of this since the new laws regarding overstaying came into being.
There is but one legal option and it does not involve going to the airport with 20k and ticket in hand as that would waste the ticket and your time. Ask your embassy?
Get a new valid passport and then surrender yourself to Immigration Head Office at Soi Suan Plu in Bangkok, with your old and new passport.
If you surrender at 8am, you will go to court within 2-4 hours and be fined under the 20 limit. You have the option to pay the fine in cash or serve the fine at 500 baht per day (not been 200 baht for 2 years) at Pathumthani jail!
You will then be returned to Immigration, who will want to keep you 24-48 hours to check if there are any outstanding warrants for your arrest. Once this is cleared, you can only buy a ticket on the flag carrier of your country of birth and go home. Most airlines will not carry deportees but a flag carrier has the legal duty to do this.
Doesn't matter if it is surrender or arrest, if you go through the IDC now, you go to your country of birth, unless you have legal residence in another country!
There is also a transportation charge from immigration to Suwarnapum Airport on the day you are to leave. At the airport immigration will check you in and your friends and family can give you your belongings to check in. They will then take you into the immigration holding area till an hour before you are to leave. You are then escorted onto the plane and in most cases your passport is given to the captain of the aircraft who will return it to you on arrival in your country.

The process to retrieve your Thai nationality is a bit more complicated, because of the outdated nature of your documentation, but not impossible!
I have helped people resolve their Thai nationality on 2 previous occasions with similar circumstances.
It is best to start with visiting the District office where your mother's last ID card was issued.

Remember it is at the SOLE discretion of the immigration official who stamps you in to Thailand if you are given the right to enter and stay or if you are refused entry!
The lesson is, ALWAYS be polite and helpful to Immigration officers when entering the country.

The relatively recent imposition of black list penalties for overstay are a whole new animal.
I agree with Joe you can appeal but it is not going to be easy or cheap and there must be a genuine basis to appeal or it will get thrown out!

Blacklisting of a foreigner is only available to a police or immigration officer who has prosecuted you for a criminal offense. So it is not available to your typical boy in brown on the street.
Remember the only police officer that can institute a criminal case is a commissioned officer. That means someone with 1 star or more on the shoulders of his uniform.
When you are arrested it is standard required procedure to seize your passport. It is also common in Bangkok for the court to issue an order to the arresting officer, to send to your passport to the court to be held there for safe keeping.
Within 24 hours of your arrest the police officer will inform immigration that you are under judgment and you will be blacklisted from leaving Thailand!
If your trial is projected to go beyond the length of your visa, a court order at your request, will be issued to extend your visa beyond the projected court trial period. Normally this extension of stay goes for 1-3 months.
This blacklisting can only be removed by a court order on the completion of your criminal case. It is common and normal to get a court order from the court saying the criminal case is now complete and you are free to leave and return at will.
Then you have to go back to the case officer and continue to be friendly to him to ensure there are no further repercussions.
In the case of Phil he was re-arrested by the case officer at the completion of his court case and removed to immigration, thence to Bangkok for deportation.
When you leave Thailand on the completion of the case I have seen many people present the court order to Immigration and there was smiles all round, and they say come back again.
I have also seen people go to the airport and be turned back as they didn't have a court order and when they pressured the immigration officer, they will call to court and find out the case is complete, but as the case officer is not on side, immigration may black list you and deport you.
I am cutting in on this issue as it is not clearly understood and wish to dispel false information.
