  1. You've covered the main ones. There are a whole host of others though, many won't be relevant.

     

    Investment could be an option. But would be THB 10mn+ and a fair few hoops.

     

    If you're married to a Thai or have Thai dependents/kids, both of those are relatively easy options, and in my view the easiest solution. I've been doing marriage extension for years - you can then overlay a WP without changing your visa status if you get a job or lose your job. I would have considered the dependent route if anything happened to my wife while I was under 50.

     

    Of course marrying/ having kids just for the sake of a visa isn't necessarily the wisest of moves LOL

    There's no way to do TM28 online. I asked IO. I also asked if there were any plans for TM28 online or an app. They said no.

     

    I believe the whole antiquated concept of the rules was:

     

    1) You go in person as the alien so they can check and see you

    2) For the TM30 the assumption was that it would be a loyal Thai national somewhere along the line who would confirm as a check. So the nice loyal Thai person would help verify these potentially dangerous aliens LOL

     

    That aliens were subsequently allowed to buy their own condo, and such complications, so being both owner and alien, came with later.

    I confirm that at Chaeng Wattana when I did mine this year, the immigration officer specifically told me that they wanted to see the 400k proof of funds when I returned 4 weeks after the application was submitted, during that period under consideration

     

    They checked to see, when I went back to "hear the result" and get my full one year, that my bank book had been updated to show money still in my bank account. Once completed I asked if I could now withdraw the money if I wanted they told me yes.

     

    So BKK CW Wanted 2+1 months and checked it before issuing the final stamp

  5. Personally I wouldn't touch with a barge pole any agent that offers to defraud the rules for a fee, unless I've absolutely no choice. If absolutely no choice, then I'd seriously consider why I'm here.

     

    Just follow the rules as shown byDavid 555 in what's official. Find out what your IO office is doing and follow up. It's one thing making a mistake or breaching a rule. Completely different getting caught defrauding it as a criminal.

     

    For me, it simply isn't worth the risk of getting charged with fraud and deported, and potentially black listed from returning to Thailand. The result would be severe: losing access to my home, kids having to leave school, UK resettlement visa needed for the wife for us to be together, and a major upheaval to life generally.

     

    BTW: I do extension based on marriage. 400k instead of 800k. 400k is only needed 2 months before and 1 month after. Very easy. Main downside for marriage is 2 visits to immigration to get it done each year instead of only 1 for retirement. Tying up 400k for 3 months in a designated account is a small price to pay for leaving here. I'd keep more than that in cash normally anyway regardless.

    On the first one you will see that it is for "Notification TM30" or "Change Password" 

     

    It's the second one you want that is "Search TM30" . This one let's you search data.

     

    6) Click on the sub-line where it says "Search TM30"

     

    7) That takes you to a search screen showing the user name and address. Put in the check in a range of check in dates, eg 7 Sep 2019 to 14 Sep 2019 and (max 7 days range. Both beginning and end is needed)

     

    8 ) Click on the magnifying glass/ brown icon just below which says search in Thai. There are 2 icons just below the date. Left is search. Right is a cancel.

     

    Click search/magnifying glass and it will show basic details: Name, passport ID, landing card no. sex, date in to stay, date (expected out) etc

     

    Do a print screen of this in landscape format and it can be shown to Immigration

    Not sure what you mean by still not correct. It correctly reflects the Immigration Act 1979 Section 37, and clauses 3 and 4 which are the 2 reasons you notify change of address :

  8. The way the extension based on marriage usually works:

     

    1) 400k is needed for 2 months prior to extension

     

    2) When you apply they will give you 1 month extension pending approval. During which they do various checks like checking you are still married. 

     

    3) New rules are you need to keep the 400k in the bank account during that 1 month pending approval as well***

     

    4) When you go to "hear the result" and get your full approval for the remaining 11 months, you can do whatever you want with the 400k once full approved for the year and withdraw any time

     

    Next year start at setp 1) again. So the rules are now 2 months prior to applying and 1 month after applying (during the pending approval period) until you get your final stamp

     

    *** By new rules, I mean for me in May 2018 I didn't have to keep the 400k in the bank during 1 month pending approval period. It was only required 2 months before. May 2019 under new rules I had to keep the 400k in the bank account during 1 month review period as well as 2 months before. This is the new bit

  9. If you are on any kind of non-imm visa now, there will be no need to leave the country:

     

    1st: go to immigration and change your extension of stay to based on marriage to a Thai wife. You are just changing your non-imm visa/extension status (assuming you have one)

    You need 400k in the bank 2 months before and one month after;  or 40k a month income

    If you aren't comfortable doing the marriage extension yourself then reputable agents can and will provide the service to do the marriage extension.

    I did it myself first time. Got a couple of things wrong as my case was complicated because of an ex-employer messing up. But they just told me what I needed to do to proceed

    and I made the corrections

     

    2nd: Once successful they give you 1 month extension pending approval. If you leave the country during that month you need a re-entry permit. If not, nothing more to do. 

    During that month they check at the ampheur you are still legally married. After 1 month you come back again to hear the result and they give you the other 11 months. You also need to show them the 400k is still in the bank account 

     

    3rd: Once you have that. Your visa status is sorted. If you are going to leave Thailand for any reason in the next year then get a re-entry permit same day. I just do a multi-re-entry every time so no need to make another trip

     

    4th If and when you get a job. The company should look after your work permit. Any agent who knows what they are doing knows that as long as you have an extension of stay based on marriage to a Thai (and most other non-imm extensions except retirement), then you can apply for a WP.

    The agent I gave in the link above did a great job for me getting a work permit knowing I had a marriage extension already (and of course now had a job)

    They will need your original passport and copies of the key pages of married to a Thai wife. The labour/WP department doesn't mind what extension of stay or visa (whether marriage or business) it is as long as based on non-imm status; and not a retirement. All they want to see is you're legally here for visa purposes. The rest of the stuff the WP department need is all company and job driven. That likely will require an agent or a very competent employer.

     

    5th The beauty of the marriage visa/extension is that it doesn't rely on you having a job/WP, it relies on you being married. If at any time you stop work it's still valid if you're still married to your Thai wife. So you can take a job as and when you feel like it, without leaving the country for all the visa stuff, as long as you get a WP, every time you get a new job.

     

    The only thing I'd seriously recommend is don't go for any agent who promises to be able to do a marriage visa without 400k in the bank or 40k a month. That's a legal  requirement. You may well cheat the system and may never have a problem.

    But if it did go pear shape (and the risk of it doing so these days is increasing as their systems improve), you have trouble with immigration, fraud, your employer etc etc

    Maybe I am not understanding you. You are saying these companies will do an extension and get you a WP without a job ? If so, why are you needing a WP, you dont have a job.

     

    Of course there are agents that will provide "the service" of running around and take care of extension, WP, they will pick up your dry cleaning if you pay them. But As Above, "There are not any agents selling extensions that include a WP"

    As I say any of the major accounting firms will have a paralegal department that does this.


    The company I used in Bangkok which I was very happy with was Apisith & Alliance. The company I worked for before the last one did that. Their service was excellent in contrast to PwC. They would do WP only with me doing the marriage visa - they just wanted copies of my passport.

    For all other expats they did WP + extension + 90 days etc etc. The lady who used to help me 3 or 4 years ago is still in the paralegal team at the bottom

    There are loads of agents that offer a package of business visa extension + WP. All the major accountancy firms have departments that do this, eg PWC, Mazars etc.

     

    All it is doing is pricing together two separate services in a combined price as a package.

     

    My last company used PWC. I was on a marriage extension. They wanted to change it to business extension + WP. I refused so they did just WP. Following year they wanted to do business extension + visa package again. 

     

    By packaging the two services into a single price they were saying if you want our services as an agent you must pay for the package and effectively buy both. I didn't want that. For this reason I would not recommend PwC to anyone on visa services.

     

    I actually had to find another agent for my employer (so used the one my previous employer did) and get approval not to have someone do all services and pay the full whack when I needed only one.

    But most expats will be happy with agents combining all the services in a single package price. Particularly if the employer is paying.

     

    There were something like 20 expats in the company and PWC were charging a package price to virtually all of them to do both services (and others) of business visa extension + WP.

    I was the exception being on marriage visa I was doing myself + agent doing WP. For everyone else the agent did all Visa stuff, original, extension, 90 days etc + WP

     

    Absolutely no need whatsoever to set up a company

     

     

     

     

  13. Just to add, there are plenty of agents that will help you thru a legit marriage extension, if you really aren't comfortable doing yourself. You could then use a separate or same agent to do your WP if and when you get a job.

    A lot of agents don't seem to understand or don't want to understand that you can have a WP on top of a marriage visa.

     

    One reason for that is that agents like to sell combined packages for visa extension + work permit, so they can make more money out of you. If HR get back-handers they will also go along with it too. 

     

    So my recommendations would be:

     

    1) Just do the marriage extension completely + legally and above board yourself. Keeps you in control

    Then whenever you work anywhere get your company to do the WP which they usually outsource to an agent.

    I know that it is possible to use the marriage extension for a work permit, so this is what I do. Most employers and agents are fine when you say you've done in the past, even if they aren't familiar with it and you're the first to do.

    WP is a completely separate process. They only need a copy of your passport which of course shows the relevant pages for extension stamp, re-entry, etc

    The advantage is if you leave your job you carry on life as normal

     

    2) If the 400k is an issue. Get your employer to do the extension based on business + do the WP as a package. Some even throw in the 90 days in theat package and also cancellation when you leave

     

    Disadvantage is when you leave your visa extension gets cancelled, and you have limited time to either leave the country or extend based on something else. This is why I chose marriage extension.

    I did once in the past and it was a bit messy when I once switched from business to marriage, and I ended up with a small fine for petty stuff, but again not rocket science.

    You could also go back to retirement.

     

    Both options are much better than paying an agent to avoid the 400k, which is not legit. Even if the agent claims to be or appears "reputable" the practice isn't reputable or legit at all.

  15. If you are not complying with the 400k or the monthly income rule, for money in your name, then it's not legit.

     

    I've no idea how safe it is, as I wouldn't touch it with a barge pole. As someone who's also been here a while like yourself, t's just not worth the risk that somewhere along the line it causes an issue - unless you're desperate and no other choice. 

     

    Immigration has also had a real push with compiling electronic data and linking data/ matching data in their systems in recent years. As they do that, automating data checks, audit trails and inconsistencies becomes easier for them too, as they claim in the interests of national security.

    Example: look at the TM30 where they are capturing everyone's address electronically now. It would be easy to cross ref that digitally to where a visa has been issued, and generate an exception report for those that don't match as to location and even specific date. That's the type of thing they could do digitally if they chose to, when they talk of data collection being in the interests of natural security. Visa done on 13 Sep in Nakorn Nowhere, but you are shown as living in Udon Out There on 13 Sep = exception. They could also pin the visa details input into the system down to a specific user ID too.

    We live in very different times than when all these stamps were paper and manual only. Sure they still collect a lot of paper, but key fields now get input and there's a lot of digital data around, making checks much easier.

    I've been looking for another trading platform and from the demo I tried recently IB looks OK.

     

    Other criteria I'm looking for include:

     

    - being able to open joint accounts, which I believe they can facilitate. I assume that's OK even if different nationalities? eg Thai wife and UK spouse as long as we both have Thai TINs

     

    - being able to borrow against the portfolio, which I believe is possible via a portfolio margin account and in joint names as long as over USD 110k

     

    But I wasn't aware of the requirement you mentioned about needed to being working or retired. How do IB define retired? and how would they want us to evidence that?

     

    In our case we are under official retirement age for pensions etc. But we "retired early" and live off investments, so what would they be looking for?

  17. I was looking at this recently, but decided that a 10M investment in condo; cash deposit or government bond in my name doesn't suit us. THB 3 million like Firefan did would have been worth considering, but none of those appeal as an efficient investment if THB 10 mn in my name.

     

    As for what the website says:

    The English version isn't worded very well as often the case. But it does seem to say:

     

    A) Condo or Deposit or Gov Bonds of 10M

    B) Or a combination of these 3 that exceeds 10M

    C) On the subject of fixed deposit route or not it's a bit inconsistent in English and not well written, but the Thai is quite clear in the requirements that a fixed deposit is needed.

     

    At the end of the day though I guess it's still only what they are writing on a website, and no doubt different officers and offices will do different things for different people on different occasions as per usual. Practice often differs too to what should be done when it comes to these guys LOL

Funds deposit is a very ambiguous term, not to mention it isn't used properly the way they have used it, and "funds deposit" isn't good English. "Funds deposited" yes - "certificate of funds deposited" yes, but not funds deposit

    The Thai version is similar to an extent if you toggle to Thai language at the top. But in my view generally clearer with the Thai actually being properly worded unlike the English.

     

    There are different words in Thai specifically for fixed deposit, current account, savings account, just as there are in English, as well as the general word deposit

     

    In the requirement section of the Thai lang version it quite clearly states that evidence of a fixed deposit (การฝากเงินประจำ) is required rather than just saying deposit or any other type of account. It isn't a word for word translation, as the Thai says it in a different way than we do in English, but it's definitely referring to making a fixed deposit.

     

    In the documents required it doesn't specify either, but it is grammatically correct and simply says a certificate of deposit (หนังสือรับรองการมีเงินฝาก) as a correct Thai term. 

     

    Given they told you earlier it should be a fixed deposit, there's no need to specify what time of deposit it is in the certificate plus it would sound odd anyway, Same way in English you wouldn't usually say a certificate of fixed deposit. Trouble is when they translated it they have translated into something that sounds odd in English

    I was under the miss-knowledge that Thai Immigration was a national body. Silly me.
    I registered in the app in the Kalasin province. After 4 weeks and not yet getting my username and PW, I went to see the Kalasin immigration, but my GPs got the location wrong. (Sometimes wifey does get things wrong).
    So, being pressed for time for an appointment in Korat on our way to our other house in Pattaya I thought I would just get the username and PW from Pattaya imm when I went to report for my Pattaya stay. After usual confusion, they said I can't get the username and PW for the app from Pattaya as I registered in Kalasin.
    My thinkin is that the app TM30 submitted go to each Changwat and then someone has to manually upload them into the national system. Seems like a security flaw to me.

    My wife got the username and password for TM30 via email and all online same day. It was around 9pm, and immigration aren't renown for staying late on a Saturday night.

     

    Who's details, ID and what language did you use when you tried to register in the app BTW?

     

    Wouldn't surprise me if there is a manual approval behind the scenes as one route and they have deemed that approval for your registration is the responsibility of the imm office where the place of stay is. 

    But at the same time, it's possible it could also be automated, as our user ID contains some elements related to our moobarn.

    So it's possible there are 2 routes or more to get into the national system:

    1) if you do all the stuff in Thai, with Thai ID, moobarn number etc they can link in and automate it, and it all flows nicely. not quite sure what they'd do with the uploads.

    2) if you start entering non-Thai data a manual process is needed. So you become a manual exception and not an automated process.

  19. Our girls have dual nationality.

     

    Getting a Thai ID card was relatively easy. Go to the local ampheu and register. My wife took them (as their mother), and if I recall took her Thai ID and the girls' birth certificates. Nothing from me as the father. So might help if you have a relative go with you.

     

    Similarly entering them in the Tabian bahn was done at the local ampheu and easy

     

    So probably do these two first

     

    For Thai passport (as children/minors):

     

    Before they had their Thai ID cards (before age 7) then mother and father had to go, with their passport and ID cards, + Thai birth (originals and copies of) certificates of the girls. Plus Tabian bahn original and copies if I recall

     

    After having ID cards they take those + Tabian bahn. Father and mother still needed to go with their docs. But assuming you are an adult that wouldn't be required.

     

    All 3 processes were pretty easy, and didn't take long. Thai ID card at ampheu just depends on the queue. Thai passport takes a little more time. Depending on queues. Then receive via registered post or pick up in person just under a week later

     

    Once you have your Thai ID card of course no worries about working.

     

    Working before you have an ID card may be an issue at many places of work. The reason being is that the employer will want to see your ID card as part of their process of initiating you into the company and setting up all your HR records. They will also need your personal details in systems for so many things, eg either a Thai ID card number or a tax number to put you into their payroll reports (submitted monthly) to the Thai revenue. Every single person employed and paid will be on that report, and will show the ID number of each. So likely to be a lot of issues - mainly driven by the company without the ID card. So as the ID card should be easy, it'll be much easier to get it first.

  20. Fletch's solution to TM30 and TM28 and 90 Days

     

    1) Find yourself a decent Thai partner who you trust

     

    2) Get married. Optional, but Helps with so many things. Bonus: you can then get extensions based on marriage

     

    3) Buy your own home. Either in your name (condo) or wife's name (condo, house etc).

    Bonus: No need to worry or whinge about exchange rates on Thai Visa

    Bonus: You lose cheap Charlie and farang kee neaow status

    Tip: Review you've done steps 1 and 2 properly first

     

    4) Register for TM30 online, and receive your ID and password.

    Tip: Online can be either via the website:

    or

    Download the mobile app called "Section 38" with a description "Notification of Residence" onto your electronic device. Particularly suitable for Thai wives who are always on their phone

    Tip: Best done all in Thai, with Thai ID, Thai documentation such as Tabian Bahn. So getting your Thai partner/wife make things easier. Mrs.Smile received same day access

    Tip: TM30 is the responsibility of the house-master, owner, possessor or hotel manager

    Tip: If you successfully completed steps 1,2,3 above then you have the easiest solution of either you or your partner/wife doing it online in minutes

     

    5) Log in and report TM 30 online. as and when you see fit in accordance with your morals and view of life. Online really is very easy.

    Tip: Make sure there are no spaces after your user ID or password. Otherwise you get told wrong password.

     

    Bearing in mind:

    i) make sure TM30 is done as a minimum:

    A) when you first arrive in the country from the airport and

    B) just before you do any official visits to bureaucracy, such as extension of stay or getting a cert of residence for a driving licence etc. Print a copy of your recording it in the system using the search function or when you input it as your evidence a TM30 is done.

    Otherwise you leave yourself open to bureaucrats not progressing your official business, so causing hassles for staying, driving etc

    Tip: While it is not necessarily your responsibility to record the TM30, that may not stop immigration officers causing hassle for you if it isn't done. They can and do sometimes decide that without the TM30 you can't proceed


    ii) if you stay in a hotel, they will update you in the system from their records, so it could look odd if you/your partner don't record the return in the system, so if you want a complete nice looking audit trail you'll need to update your TM 30 details on return.

    TIP: This is in contrast to a trip to nakorn nowhere where you stay at a private residence and nobody does anything for your temporary visit, so there is nothing to do for your return and so they match nicely. 

    TIP: Official law is that TM30 needs updating every time you change where you're staying even if just visiting for a few days. Until recently this was ignored by more or less everyone except hotels etc

     

    6) TM 28 then nicely follows on:

    A) No need to do anything on first arriving in Thailand. They already have your TM6 arrival card

    B) If you travel and stay somewhere outside your main normal residence. This then depends on your views on life:

    i) go and say hello at a local police station every time you go anywhere. This is the official law that until recently everyone ignored

    Tip: Take copies of the TM28 form and a copy of the Section 37 poster (or show your iPad phone etc) in Thai explaining <what TF> you're doing and why you are there as there's a very good chance they won't have a clue.

    Downer: TM 28 has to be done in person or Power of Attorney for someone else to do and is a manual paperwork exercise. As well as copying your passport page photo, visa page, entry stamp etc. There is no online, no app for TM28 and no plans for either
     
    or
    ii) Ignore it and pay a fine which could be around THB 800, as part of your fees for the "privelege" of being here, in the event they take an interest
    In the knowledge that your TM30 is all in order and they have your address in their systems anyway, so you didn't think you needed to. Particularly if your wife has done the TM30's online
     

    7) 90 Days reporting. This runs in parallel.

    Register and do it online not more than 15 days before due to report and not less than 7 days. Otherwise they won't let you use the system, and like you go go and say hello in person:
