  1. Why not build your own hot air balloon and balloon all the way back to your homeland?

    All you need is a small wicker basket (you could make your own out of bamboo found in the country side) and some large strong plastic bags (Mackro do some really strong ones for 7 baht each).

    All that is left is some hot air, now I wonder where you could find that?

  2. If he is on the blacklist then I can't see any reason why Thai officials wouldn't tell him over the phone. If like you say he is wanted by them then that maybe a different matter.

    Who told you that you were blacklisted and how do they know?

    If you haven't committed any crime then don't worry too much. The police here will need some proof and confirmation that you have in fact committed a crime.

    Lets say that you left some incriminating evidence in a room/house that could be linked to yourself and the police may have searched there, then there is a strong possibility of them wanting to follow/speak to you next time you enter the kingdom. However a lot of people do slip threw the net so to speak.

    You will have to make that call yourself.

    The long story you mentioned will please most TV members as they like a good yarn.

  3. Could not find anything Thai specific but this site (http://www.automotive.com/2006/12/ford/ranger/warranty/index.html) sums up the Ford Ranger Basic, Drive Train and Rust or Corrosion Warranty as:

    Basic Warranty: The basic warranty covers everything except items that are subject to wear and tear or replacement in the ordinary course of vehicle ownership, such as oil and air filters, wiper blades and brake pads. Tires and batteries are often excluded, but usually have their own warranty provided by the manufacturers of those items. Emissions equipment is required by Federal law to be covered for five years or 50,000 miles.

    Drive Train Warranty: In some cases the drive train warranty continues after the basic warranty has expired. This part of the warranty covers most of the parts that make the vehicle move, including the engine, transmission, drive axles and driveshaft. Like the basic warranty, "consumable" parts such as hoses and belts are not covered. However, most of the internal parts of the engine, such as the pistons and bearings, which are also subject to wear and tear, are covered by the drive train warranty.

    Rust or Corrosion Warranty: This warranty covers the vehicle's sheet metal, and protects you from rust and corrosion that are severe enough to cause a hole - surface rust is not covered. However, if you keep your car washed and waxed rust shouldn't be a problem.

    I'm sure someone can confirm whether this is the same as the 100,000km warranty in Thailand.

    In answer to your question 'Why so cheap?' It could well be in need of some repairs as the price you've mentioned 350,000 baht with only 42,000km on the clock is surprisingly low, even after you take into account that Ford's are not that popular here.

    Proceed with caution, but it must be worth a closer look.

    Either way I think the Ranger is an excellent car and if it 'checks out' I would buy it!

  5. The problem with a forum, is that you can't trust all information. But sometimes, you find quickly some REALLY nice information.

    On the first reply, someone wrote that you can't do a usufruct only on LAND. That's false.

    You must make a difference between usufruct and superficies. Anyway...

    After, when you use a form at the land department, do you understand what is it written?

    Can you read Thai? Does it have clauses that says if you build or ameliorate the land, all constructions will be yours? Because the foreigner can own the buildings!! There is also a theory called UNDUE ENRICHMENT in civil law that can be used. But every case is different, depending on your age, if you have children or not, if you are married or not, the money you want to invest, your future plans, etc. Using a form is, to me, fast food. And when you make a major investment, like building a house, it WORTHS it to double check with law firms. Prices of law firms in Thailand are cheap if you compare to western countries.

    Remember one thing: Contracts are agreements between people and they can have everything inside, except what is illegal. Some contracts needs a special procedure to be valid. Using a form could be OK in some circumstances... be careful. 2 clients this week came to me after losing more than 2 million baht on houses. Love is blind. :o We all know these stories...

    I think I fall into the category "using a form could be OK in some circumstances". But I'm no expert!

    I appreciate that lawyers charge for consultations (in most cases) but since you have joined the OP's post discusion could you help him/us and put forward a senario of when it would be OK to go ahead and by-pass the services of (in a lot of cases) rather expensive (even compared to western lawyers) lawyers and use the land office's standard form. Also the variables you mentioned; being married, having children etc, could you clarify what you would do differently in each case?

    Are you implying that the 2 clients who lost their investments recently were using the standard 'fast food' forms? Or was the problem in those cases the fact that they had no protection at all?

    Has an usufruct case ever made it to court and if it did, in your opinion as a lawyer, what loop holes/clauses would you use to discredit it (supposing that you were hired by the land owner and not the farang usufruct holder)?

  6. I would keep all of these injections up to date if I were you. They were/are all free from most practices in the UK:

    Hep A

    Polio

    Typhoid

    Tetanus/Diphtheria

    My clinic in England also offered free Hep B.

    I had to pay for these, and they're not cheap!

    I would also pack a first aid kit with the usual antiseptic plasters paracetamol etc.

    An on board computer that clearly states the worst course of action to take in any situation. So that the driver is assured to be the worst driver by far and in doing so will gain respect from the other wanabe morons who are driving at the moment. Don't just do it wrong do it really wrong!

    The sections 3 and 4 from the list above could come in to play here. If you issue a warning and her un-professional/ethical performance continues then section 5 could be used.

    We still have not solid evidence however that because she has no contract if any of this count?

    My own thoughts are that employees have these rights contract or not. So the sections above could come in useful if you were to try and avoid compo.

    Me I'd warn her, give notification of a wage drop and if things continue sack her and give her the correct amount of compensation. She's been with you for 5 years that has to count for something.

  9. I notice on the link you have posted singa, that compensation could be avoided if he can prove any of the following:

    An employer is not required to pay severance pay to an employee whose employment has been terminated for any of the following reasons:

    1. Resignation

    2. Dishonest performance of his duties or the intentional commission of a criminal act against the employer;

    3. Intentionally causing loss to the employer;

    4. Performance of gross negligence which result in severe loss to the employer;

    5. Violation of the employer's work rules or regulations or order which are both lawful and equitable when the employer has already issued the employee with a prior written warning, except in a serious instance when the employer is not required to give a warning.

    The written warning shall be effective for a period of one year as from the date of the commission of the violation by the employee;

    6. Neglect of his duties for a period of three consecutive work days without reasonable cause, whether or not a holiday intervenes;

    7. Imprisonment by reason of a final judgement.

    8. An employment contract shall be terminated when the specified period in the employment contract expires, the works related are as follows:

    8.1 Employment on a special project, which is not in the normal way of business or trade of the employer, where there is a fixed schedule for commencement and completion of work.

    8.2 Work of a temporary nature with a fixed schedule for its commencement or completion.

    8.3 Seasonal work in respect of which employees are only engaged during that season; provided that the work most be completed within a period of two years and the employer and employee have entered into a written agreement at or prior to the commencement of employment.

  10. On the whole most of the Thai people I've worked with have been hard working (long hours) and conscientious. Although some have been lazy and happy to take credit for ideas, work that is not their own.

    My current Thai boss, works longer hours than most, her predecessor worked less than most. The secretary works as hard as anyone.

  11. Not sure if any real good will come of this, but I'm happy for anything to happen in the Kingdom that may directly or in-directly make the roads here safer. Thailand will in time I'm sure adopt more road safety laws and enforce them to generate more tea money if nothing else.

    In my opinion they should start with a far more comprehensive driving test that if at all possible (TIT) is bribe free.

  12. I'm no expert in this field but as your employee has no contract I'm sure you can terminate her employment at any time.

    You may be obliged to pay compensation due to her termination, but this again may only count when an employee has a contract.

    It seems a shame that after 5 years it may have to come to this, though. Why don't you do as madjbs suggests and give her a warning and an opportunity to redeem her recently un-professional behavior.

    If she doesn't shape up consult a lawyer and get rid. For 25,000 baht per month you will have no shortage of keen workers to answer emails and shuffle files etc.

  13. Does your friend have any living relatives? If so she could ask to be put in their house registration book. I think that she could also enter her name on to a friends TB book, with that friends say so of course.

    If your friend has no family or friends willing to do this then I'm not sure of her other options.

  14. Classic series from HBO, I've just recently watched all 6 seasons from start to finish. I like the way Tony has to nail anything with a heart beat.

    The cool one legged Russian maid/come house nurse who smokes out of the side of her mouth is a particularly cool garl. I like the way she rejected becoming Tony's Gooma due to the fact he was high maintenance.

  15. I was driving along the 30 km stretch of road between Phan Korn and Wanoni Wat in Sakon Nakhon and nearly had a major accident with a bus. As the bus approached us he viered off the road slightly on to the dirt track and must of hit a pot hole because all we heard was bang! The bus driver lost control and swerved off the dirt track back onto the road coming straight for us on our side of the road. I was doing about 70kmph and he must have been doing between 80-90kmph. I had my wife in the front next to me and our 2 children in the back. I slammed on the brakes as the bus approached us and steered the car off the road I thought "he's going to hit us", the bus driver turned his wheel in the opposite direction and swerved again to narrowly miss us. As he passed we could see him clearly and he was smileing. We sat in a daze for a few minutes and couldn't belive how lucky we had just been. As we sat there rims of the wheel hub rolled by us and when I looked in my mirror the bus driver kept on going with a flat tyre for about another 200-300m.

    When I had thought that the bus was going to hit us I wasn't scared, I didn't shout to warn my family (not that they weren't aware of what was going on), I just saw the bus coming straight at us and thought 'he's gonna hit us'. After the event I must admit my heart was thumping but at the time I was quite matter of fact about the whole thing.

    Has anyone else had a similar experience where they thought they would have reacted differently to what they did?
