  1. It is not the first time an office being reported for not doing it you have to use the transfer option.

    It is certainly allowed in the police order.

    Do you have a year of transfers to show?

    Yes I had all the financials in order but she she bought out a similar copy as above, I tried to explain the embassy letter was not required if the funds were from a government pension and were bought in to a Thai bank monthly. I even bracketed the two parts of the order ( annual earnings and wrote in the amount 488,000 baht ) and ( funds deposited  335,000 baht ) totalling 823,000 baht. I had a bank letter and statements. She took a heap of embassy letters on a file the top one being from Switzerland Embassy and said "you have to have the same as this, everything has changed now". I had the bank letter for the deposit 335,000 baht which had been there all year and a full year of statements 488,000 baht (1st Dec 2018 to 30 Nov 2019) from BKK bank for the income. She didn't say anything more, I said OK thank you and walked out.

Can anyone from USA, UK, or AUST who has had a recent successful 1 year renewal using the Combination Method of Foreign Transfers into a Thai Bank a/c plus Thai Bank Deposit for 2/3 months which totalled 800,000 baht and DID NOT require an Embassy letter please advise from which Immigration Office supplied it. On Wednesday I was refused an extension based on the above at Nong Khai after 6 previous extensions at that office which I had previously had the Stat Dec from The Australian Embassy. The only condition which they denied the extension was not having the embassy stat dec. I have approx 16 working days left on my present extension.

    I really appreciate your efforts. Would you be able to request uniformity of Immigration Law throughout Thailand Immigration Provincial Offices be strictly enforced and adhered to under threat of penalty to the offending office and a Call Centre number provided specifically to report any office not complying. Maybe worded/composed by an expat lawyer who is already respected by Thai Immigration heirarchy and maybe an expat media station who could request an explanation publicly from Thai Immigration Head Office. I find it hard to believe that the top brass in TI are aware of the "Own rules system" applied by individual Provincial offices

    I believe this problem has only got progressively worse and needs to be addressed asap.

I have not been unduly affected by the TM30 requirements but I would like to offer a suggestion that I believe would be extremely beneficial to all Thailand expats that a petition to the Prime Minister and Head of Immigration requesting uniformity of Immigration Law throughout Thailand Immigration Provincial Offices be strictly enforced and adhered to under threat of penalty to the offending office and a Call Centre number provided specifically to report any office not complying. Maybe worded/composed by an expat lawyer who is already respected by Thai Immigration heirarchy and maybe an expat media station who could request an explanation publicly from Thai Immigration Head Office.   6. After splitting up with my girlfriend I started making moves to get my House back,the House and land were in her name.

    After suffering from all the Doomsday know all’s that I had no chance of getting my House back I visited a Solicitor explained everything to him and he was happy to take the Case on.

    To cut a long story short after just under a Year at our final Court appearance I was awarded the House but as in Thai Law I could not have the Land in my name,we retired to the Chambers the Judge,Solicitor,Translator and the Thai Manager of the Village I lived in,after discussing this for a while the Land was put in the Village Managers name and the House in my name and this ended in a satisfactory result for me.

  7. Some Australians have reported that they are being asked to show documentary proof of the stated income on their Statutory Declaration at the Australian Embassy in Bangkok.

    The Australian Embassy has clarified that if you complete and are signing a Statutory Declaration claiming an income amount in support of a retirement or other visa, you are not required to provide proof of that income. It should be noted that it is an offence to make a false declaration on a statutory declaration

  8. I would like some information from a legally qualified or experienced person on foreclosing on a private mortgage contract which was registered at the local Land Office. The mortgage was for one year which finished recently. The borrowers have paid their agreed monthly amount mostly on time but for the last few months have started lagging behind. I have seen online where a new foreclosure law 729/1 of the Thai Civil & Criminal Code was approved and is now in effect. This law I understand eliminates the need for Court involvement and can allow the Borrower to authorize the Lender to sell the land if they can not repay the debt. If the Borrower refuses to repay the debt and does not authorize  the Lender to sell the property for which the Lender has the Title Deed (Chanot) what course of action does the Lender now have.

A friend of mine has an non-immigrant OA visa and wants to apply for an extension based on retirement.  She believes that she was told that she could apply for the extension at Changwattana (Bangkok) when she has 45 days left on her visa.  This would suit her better than having to wait until there are only 30 days left.  It true that she can apply when there are 45 days remaining?  Thanks! 

    She can apply for the extension during the last 45 days of her current permit to stay from her last entry from the OA visa not the visas expiration date.

    If her visa is still valid she could leave and re-enter the country to get another one year entry on or before the enter before date on it.

The Head Officer of Nong Khai Immigration is now requesting photos of the expat applicants in front of, in the lounge room, and the bedroom of their residence, as well as a map showing the location. Would it be possible for ThaiVisa to inquire from Immigration Head Office in Bangkok why Nong Khai is the only office in Thailand requesting these additional conditions, Last year they were the only office in Thailand requiring expats to sign their special forms for retirement income to be brought in to Thailand. This requirement was later squashed by Immigration in Bangkok.

No previous convictions does not mean they have not been in trouble with the police before as on numerous occasions I have personally been witness to payments being made at the police station by relatives to prevent any records put on file. These payments have not done anything whatsoever to prevent further occurrences and only cause the relatives to lose their homes, land and life savings. The persons committing the offences re-offend over and over and these events are never bought to the attention of the media. The only way to curtail the re-offenders is jail time but this only happens when the money pit runs dry and the relatives are left in poverty with the released culprits left to go on their unobstructed ways.

  12. Although not a response to the OP this query is related to retirement in Thailand. Recently I went for renewal of retirement extension in Dec 2014 at Nong Khai Immigration they were requesting people sign paperwork (which they have obviously designed themselves) to transfer any pension income whether it be 65,000 THB per month or part thereof to be brought in to a Thai bank on a monthly basis. This appears to only happen at Nong Khai Immigration where as previously an affidavit of monthly income was sufficient with the money being allowed to stay in their home country until they require it. Has anyone run in to this elsewhere in Thailand.

  13. Hi Tassie Norm,like you I am also an Aussie and have used the statutory declaration method of 65,000 baht per month which consists of social security pension plus a private pension. I have done this at Nong Khai immigration the last three years and the most recent was 3rd December 2014 when I produced the required stat dec showing 70,000 baht/month and supported by income statements from both sources. I was given three forms to sign which stated that the next time I renewed my retirement extension for Jan/2015 to Jan/2016 it would need to be supported by evidence of the 65,000 baht or above monthly income being deposited into a Thai bank every month and not held in the home country bank. A friend told me an American and a German were also required sign the same forms at Nong Khai immigration prior to my renewal. I was given the extension as previously for the Jan/2015 to Jan/2016 year. As you said you were going for your renewal in December could you post your outcome. This will be an expensive change for the future renewals.

  14. Foreigners can own a house in Thailand but not the land. You can purchase the land in her name and then have full control of what goes on the land by way of a Superficies which she grants to you for your lifetime free of rent and you can erect any dwellings you wish and if the relationship goes south and you don't want her to stay you can ask her to leave and please yourself what you do with the land and dwellings. The Superficies should be registered at the local Land Office and your name is put on the title.
