  2. As non married father you can have your child's name on the property document. No problem.

    However, the Thai mother, as the legal guardian,can do with the property whatever she wants till the child reach adult age.

    If you do not want this scenerio, then, you go to a layer making a ..20/30 year lease agreement with your child. Deposit this lease agreement in court. The judge will act for the child, and agree on your lease. Making sure the mother cannot sell the property. You will have to pay (minimal) taxes for the lease period.

    Bottom line, you need a lawyer and you need to pay (minimal) taxes.

  3. At Grand Diamond, all maintenance fee's remain the same. We condo owners are getting only all the mess, the developer the benefits !

    Among others, the situation continue to escalate, visitors are now walking, uncontrolled, up the 8/F swimming pool, as now part of the 8/F Building B, is labeled Grand Diamond Plaza Shopping mall Office.

    Visitors leaving their Starbucks mess at the 8/F for residents enjoyment. Daily whistling contest of the security guards. Laundry Shop installed at Building B 8/F.

    Daily, goods are being moved in the personal lifts of 8/F Building B.

    At purchase time it was clearly mentioned that 8/F was clearly labeled "child care"

    And Building A 8/F Office NOT Building B !!!!

    Safety and Security, as predicted initially, is declining in our building.

    Grand Diamond Developer, Petboonma, continues abuse, has also taken up recently part of Ground Floor Building B to install Grand Diamond Renting Office !!!

    As they have complete control over Juristic, as a matter of fact the Juristic Manager is a .... Grand Diamond Project Manager !

    Get this...any Grand Diamond Plaza visitor can visit the office Building B 8/F private floor...but owners cannot have their pizza delivered at their floor...for security reasons !

    Update court cases, initiated by the developer against myself,....court case 1 "stealing property" was dropped by the judge, as I did NOT stealed the Plaza posters, but rather, removed them from our residence entry view ! More than propably the court case 2 insult case will be dropped also. (the lady who initiated the court case....has been in the meanwhile dismissed for $$$ theft from building management ....!!!). Hope that the court case 3 destruction case also will be dropped on the grounds that Juridistics didn't handle after several verbal and certified mails requests.

    Case is being also escalated to the Thai consumer organization, but sofar, after 2 years, no result whatsoever !

    The developer owns over 33 % of all property, so it is extremely difficult to obtain a majority !

    Also unity is lacking in the building as the majority Thai owners, although very much enjoyed with the situation, don't want to rock the boat, as this is very..."unthai"....May pen Rai.....

    The point here is that Residential property was changed to Commercial property, What was presented and made to believe a purchase time as common property was changed to private property, how can this be ????

    Condo Purchaser is clearly not protected in Thailand. First priority is to get legal, affortable assistance to kick the developper's Grand Diamond Plaza Office out of the private owned Building B 8/F, relocating him as per purchase plan to the Hotel Building A 8/F.

  4. Joined by a bilingual senior member of our “No Grand Diamond Plaza” opposition group I visited the police station.

    The Project developer was identified as the complaining party in regard with the removed advertisements.

    Requested for fingerprints, we asked and obtained a waiting period, during which, we will negotiate that either the project developer drops his complaint or to identify and return to the police station with proper legal representation.

    On another note, if it is proven that the property developer can not claim ownership of the 8/F Tower B, as per brochures upon condominium purchase time, then, it can be claimed that the posters removal reflect this reality, and therefore completely legal.

    As a novice I had no clue where to start for assistance.

    FYI, poster removal happened at the reception of my apartment (private area), following up a registered letter send two weeks before, but not answered by, our Juristic management.

    Poster, I believe, is an illegal invitation to a private 8/F common area, for the general public.

    By removing the poster I only had the intention to protect the residents families.

    Understand, I am on thin ice !

  6. As Hotel owner, Petboonma Co Ltd has automatically 33% of the votes Tower A (Hotel). Furthermore he and some of his staff owns also condo's at tower B and an nbr of condo's, unknown to us, is unsold. Therefor, Petboonma can reach a 50% of the votes based on AREA ownership. It is not one mean one vote that's being promoted, for it's own benefit, by Juristic department.

    But even then, I strongly believe that,

    1. You cannot change overnight a residential to a commercial area by transforming more than 50 % of the parking space in a shopping mall because the property developper would like to see his profits increase. (on the back of the condominium owners).

    2. You cannot change what was originally announced, advertised and planned as common area at building B, by claiming later on that it is the property development property.

    On both counts, regardless, there is clearly without a shadow of a doubt serious inconveniences and financial ramifications for the residents opposed to property developper Petboona Co Ltd., for it's ONLY and sole financial greed , plans without a SINGLE benefit to it's condominium owners.

  7. I purchased a condo 11 years ago in Pratunam Grand Diamond. The project consisted of an Hotel Tower A and residential area, condominiums at Tower B.

    Today the G/F to 7/F area is being transformed to a commercial area. 50 % of Parking space is being changed to a Shopping Mall and the 8/F Common area at Tower B is being transformed as public Office !

    Can Petchboonma Company limited, owned by the Chaiyapatranun family and the owner of the Hotel at Tower A and the initial Grand Diamond Building company change the area from residential to commercial without consent and value for it’s residents condominium owners ?

    Can he take away a labeled common area as his own office property although on purchase it was clearly labeled as common area ?

    Hidden upon purchase but claiming today he is the rightful owner of this common area?

    Letters to the juristic department, which is a puppet from Petboonma, and to Petboonma Company limited remained unanswered. FYI Juristic Department management is also on Petboonma’s payroll.

    How can we condominium owners, get justice and proceed economically to ensure legality and common sense prevails so that our properties are not transformed to a commercial area against our will and how can we get back our common area ? How can we recover, once the mall is established , our financial loses due to reduced condominium value, property degradation and damage, environment degradation, and increased security treat as a result of a Shopping mall at the transformed parking area.

    It has to be noted also that residents, as per condominium act are not allowed to, install any commercial activity at their residence. Furthermore, residents also are not allowed to have their ordered meals delivered at their doorstep, for security concern. Petchboonma Company Limited seems to be exempt from this rules as he invites openly the public to enter to visit his office at our residential private building !

    How can we get justice ?

  8. 15 October 2009 I went to Malaysia and requested and received two months TR visa.

    14 December 2009 requested received at immigration Bangkok extension till 13 Jan

    16 December 2009 presented at immigration Bangkok my complete retirement file and papers requesting a retirement visa.

    9 January 2010 received at Bangkok non O visa …until 13 March 2010 !!! I expected to recieve my retirment visa !

    I was informed to request then again…...an extension......

    When will I get my retirement visa ?

    Of course on 16 December 2010 at my initial request I had more than the required 800 KBth in the bank. Do I need to keep it above 800 KBath till I get my retirement visa ?

    FYI I meet all retirement critria's.

  9. A retirement visa (non-oa from overseas) does not net you a 90 day stamp, you should get a 1 year entry stamp on this visa type, however if the visa was single-entry you would have been stamped for a year but would need a re-entry permit.

    If you have an extension or single entry visa and left without a re-entry permit everthing is toast, 'Go back to Old Kent Road' :)

    I extend my visa every yar at Suan Plu, since 4 years.

    I have the one year stamp till January 2010 in my passport.

    The visa doesn't say single entry.....

    When I left I was OK with my 90 days reporting....

    How can I recover ?

  10. Since 4 years, without a single problem, on a retirement visa running out January 2010, today immigration informed me that I am in overstay since 5 days, have to leave the country and reapply for a retirement visa. Can this be true or do I have a nightmare ?

    Upon my return from my home country vacation on September 1 st., immigration stamped my passport for 30 days, instead of the usually 90 days.

    I did notice this only this week, October 6 th. (after 30 days), and went immediately to the immigration office to get the entry stamp corrected. However, instead they told me that this can not be done, but that I am in overstay since 5 days, have to leave the country and reapply for a retirement visa !

    I have to mention that previous years, I had a multiple entry visa. This year, I didn’t because I will not travel multiple times but only once, and assumed (wrongly ??) this could be done with the one year visa!

    Question, What steps can I undertake now to correct this problem, without having to go through all the retirement visa process all over again 4 years later.

    Any sound advice would be highly appreciated as I am totally at a loss and have no clue how to proceed from here.

  11. If the Air Asia cancels your flifght they will do their best to accomodate you.

    My experience ? A while ago our flight to Ubon Ratchatani was canceled. Air Asia rebooked us without additional fee on the next Tha Airlins flight, 40 minutes later, to Ubon ! :o

    I believe the previous writer Rangoon experience was du to the fact that ALL carriers canceled ALL their flights.

    Let's give the Thai government a break. It's without a shadow of a doubt a great idea. Too hot for farang ? Sorry you are in the wrong country, go back home without going through jail hahhaa. I would recommend government officials to take a look at the Netherlands, on how they did it and were succesfull. I believe this is a great idea, and guess what, it could work even in Bangkok. This, understand, will be excepted for all services related businesses, but all others should not have a problem. How ? Drive to BTS, create car security parking, take BTS, take bike at BTS stop station to your office, create bike security parking. Make bycycle lanes (FAST). Next step would be same as Singapore, to implement toll gates to enter town during business hours, with taxis excepted. Impossible no, Easy to implement no, a real chalenge, but not imposible. Just make sure rules are implemented and followed up properly. and again this is NOT difficult to do. It is just the power of the mind, the desire to suceed.

    As a long time resident in Thailand, here are my 2 setangs.

    If you are from Antwerpen (I am), go to the Anterp consulate, negotite and apply fror the longest possible visa, and put your cards on the table.

    Come to Thailand, and enjoy. However long term, a Belgian job will be much more rewarding. It is correct that your girlfrind will have very limited job opportunitis in Belgium. However you will be able to bring your gf to Belgium because they know you at the Antwerp consulate. Middleclass Thais nowadays will understand you need to make GOOD money. When kids are at the age of university, you must have saved enough to move to Thailand. Be sur your family travels yearly to and vacation in Thailand, and maybe get your wife twice a year to Thailand, just to see her folks and eat her papay salad. Learn Thai fast, to be considered one of them, this to avoid being locked in as a farang. Be patient, appreciate Thai values although they may be quit different than ours. Unfortunately some people in Belgium may look down on your wife. Dont worry, her attitude will determine how you frinds and family may percieve her. And believe me almost of them are extremely positive !

    It's going to be a challange for both of you, but with the right mind and perseverance a rewarding one. As a matter of fact, I did it all before.... and it works !!!

  14. By this I want to let you know and to congratulte immigration office for the fast and profesional approach in regards of retirement visa extension job well done.

    Visa visit went as follows;

    For retirement one year extension visa I went last Tuesday at Suan Phlu at 11:30AM with the following:

    1) Visa application form with photo.

    2) One copy of relevant passport pages.

    3) A Letter of Guarantee from Bangkok Bank that I had deposited the money from an overseas account.

    4) One copy of my Bangkok Bank passbook, updated Friday, to show the money was still in the account.

    5) 1,900 Bath Visa extension Fee

    6) 3,800 Bath Multiple entry Visa.

    After I went to the application window and paid B 1,900, I was sent back to room 102. I waited about 20 minutes and then sat down in front of a very friendly enough lady. She looked through each of the documents. No problems.

    After double check with other officer I receivd immediately my one year retirement visa extension.

    Next I proceeded to counter 9 for multiple entry visa.

    At 1.30 PM I left Suan Phlu with the new one year extension retirement visa.

  15. At the present time I am holding a one year retirement visa that is due to expire next month.

    I presume I need th following docs,

    1. Passport.

    2. Bank Passbook

    3. A bank statement that I hold account 800 KB in my account.

    4. A bank statement regarding this year incoming foreign banktransfers

    5. 1,900 Bath Fee

    Are there any other requirements you know off ? For instance do I need again a doctors certificate, copy of passport, passbook and or anything else ?

  16. Let me ensure you, according to thai law, kids up to 18 years old, can stay with their mother, Thai national, without visa renewal. The mother will be able to get dual citizenship, and a Thai passport for her daughter. Indeed, qas Thai administration is slow, she will need to insist. As for public schools, she will have to pay higher fees and the kid may be be refused, based on the fact that she is not (yet) a thai citizen.

  18. I own an apartment since quit some time in Bangkok.

    My (longtime) girlfriend would like to register her residence in Bangkok, so she doesn’t has to travel to her hometown for any administrative issues.

    This, apparently can be done by requesting “a blue book” that goes along with the apartment, in Thai, sam now tambia baan and put her name in it. Second, she requested also to sign her in this blue book as “boss of the house” in Thai, chaw baan.

    What if I register also her brothers and sister in the same "blue book" ?

    My questions are, what are the legal implications to get her name into the blue book, and to register her as Chaw Baan ?

    It is my understanding that an an equivalent "yellow book", that I dont have is available to farangs only. What is the need for it ?
