What does me having to provide documents to immigration when I rent a property have to do anything with tax?

You mix and blend things from here and there that you dont seem to have a clue about.

because if you earn an income more than 20,000 baht you are libel for tax so when its on a computer that you are renting 5 or 6 properties they will come knocking for the tax

I dont need a work permit to be tax resident in Thailand.

    1.Taxable Person
Taxpayers are classified into “resident” and “non-resident”. “Resident” means any person residing in Thailand for a period or periods aggregating more than 180 days in any tax (calendar) year. A resident of Thailand is liable to pay tax on income from sources in Thailand as well as on the portion of income from foreign sources that is brought into Thailand. A non-resident is, however, subject to tax only on income from sources in Thailand.

you are earning an income from rental on property without paying tax you are breaking the law , This is why now you have to provide documents to immigration when renting a property, new regulations

I know that I can get a work permit and I know the rules for such BUT should it be necessary to register a company, hire a bunch of Thais, etc just to rent out your condo that you have invested in and brought money into the country to pay for if it is in fact considered work and a work permit is required as you claim it is.

you are not paying tax on your income

  4. I have a feeling we will hear more about this. I would like to know how he got the drugs. That stupid man will sing like a canary when he is sentenced. wai2.gif

This man already sang like a canary , when he was arrested 4 months ago for possesion, did 2 weeks in Nong Plue prison did a deal with the police grassed both Thai and Falang up and then released after paying some tea money, so you cannot say he was new to this. He put himself on the radar when he was caught in possesion, did he not think then they would have him under observation. He was also a director of MyGirl massage upto 2 months ago , when he sold his shares, was mygirl massage a money laundering operation? seems it could have been

  5. My statement is correct.

For a regular school you need a degree as you need a teaching license and for a (waiver of the) teaching license a degree is required.

For a language school no teaching license is required, thus also no degree is required.

Of course there are some labour offices that never the less require a degree. But in general you only indicate your highest education.

It may not be required by the school but it is required for your workpermit

  6. Step 2: Obtaining The Thai Work Permit

    Employee provided documents:

    • Passport - copies of every page. Each copy must be signed by employee.
    • Non-Immigrant Visa
    • Departure Card TM.6
    • Education degree (signed copy) *
    • Transcript (signed copy) *
    • Certificates or licenses held by applicant (signed copy) *
    • CV or Resume - describe in detail the applicant's past positions, duties, performance, length and place of employment.
    • Photos, three (3) in quantities which are 5 x 6 centimetres in size (not passport photos) with full face and taken wearing business attire (no hat and some jurisdictions require suit and tie). This must have been taken within six (6) months before the application for the Thai work permit.
    • Marriage Certificate (if married to Thai National). This includes the original and signed photocopies. Also include wife's Thai ID card, birth certificates of children, and household registration.

*Thai government officials may require these documents to be certified by your country's embassy (this requires bringing your degree, resume, license or certificate to your embassy to declare it is a true and original document. You are required to pay an authentication fee to your embassy. In addition, they can require you to translate these documents into the Thai language from your foreign language.

    Employer provided documents:

    • Commercial Registration Department Certificate showing that the organization for which the applicant is going to work has been duly registered as a juristic person, giving the name of the Managing Director and/or Director, and its objections and registered capital. *
    • Shareholders List certified by the Commercial Registration Department. *
    • Factory License (if required) issued by Factory Department, Ministry of Industry. *
    • VAT Certificate - Phor Phor 20 *
    • VAT filing - Phor Phor 30
    • Withholding Tax - Phor Ngor Dor 1
    • Social Security Payment filing

*Thai government officials require that all documents to have the seal of the company stamped on every page and the true and authorized signature(s) of the Managing Director and/or Directors next to the seal. In addition, government officials have in past requested official copies of registration, shareholder, licenses and certificates to have been issued by their respective agencies within the past 90 days of your application for Thai work permit.

There must be four full-time Thai staff per every one foreign employee.

  8. There is no reason to call the school

    • if you are a new customer then your visa is valid and you follow the previous procedures for extending the visa
    • If you have already done more than 12 months on a student visa then new visa extensions are ok up to the 29th of August, after the 29th even if your visa extension is in the first week of September , your visa will not be extended, we have to apply again to the education department get new approval for our customers and they must leave the country to obtain a new student visa.
    • then every 12 months they will be required to leave and get there new student visa's at a Thai Embassy or Consulate outside of Thailand.

we are contacting students now whose visa's will be up for extension in September and October to come to the school quickly so we can do applications again, normally the paperwork takes 2 weeks to come back from the education department, This will dramatically increase as every school will be sending paper work to the education department,

This is a nightmare for everyone and we do say sorry to our customers

There is simply nothing we can do about this, this is not the schools doing, But it is simply a nightmare, the amount of paper work that our staff will have to do for our customers to renew there visa's will be a challenge on its own, without having phone calls that will take them away from doing this paperwork i ask for your understanding

  9. The new regulations start on the 29th of August

    1. If your visa extension is due after the 29th , you must re-apply for the student visa, even if you have only done 1,2 or 3 of your extensions.
    2. This will involve another visa trip outside of Thailand to obtain a new ED Visa.
    3. All new applicants on a tourist visa can apply for the student visa but will loose the length of the tourist visa from the length of the ED Visa ( for example if you have 30 day tourist visa you will loose 1 month from your 12 month ED Visa, if you have 60 days + 30 days then you would loose up to 3 months of the visa dependent on entry stamp and when you got the ED Visa
    4. Students that go from year 1 to 2 or year 2-3 ect will have to re-apply in the same way but unlike now where you just continue to go to immigration , you must now take the documents outside of Thailand to a Thai embassy or consulate for them to issue a new student visa.

They are also to investigate all visa shops , law firms and bars with visa booths offering student visa's and will require them to name the schools who are doing the paperwork for them.

  10. Signed up to CTA mainly for the English football 5 days before the start of the season around August the 12th 2013 . Paid for 10 months up front with the special offer of pay for 10 months get 2 months free, Today they have cut me off saying there payment system has crashed. But i have a copy of my contract dear that runs out on August 11th 2014. We don't believe you, can you fax it to us no but i've faxed it to my lawyer.

  11. anything is possible in Thailand

If they are a MOE licensed non-formal school, they are exempt from the TCT teacher license requirements and obtaining a work permit is far easier for them.

As of 3 years ago it is a legal requirement to obtain a teaching licence , non formal schools are except as the poster above states , but to work in any other school you will require a teaching licence and without a degree you will not be allowed to take the Thai Culture course which is the first step in obtaining the teaching licence as you have to provide a degree certificate

  12. They can refuse to board anyone, for any reason. The question is, will they? What Air Asia Bangkok says and what their staff in Phnom Penh will do are not necessarily the same thing. I generally find them more flexible in PP than in Bkk.

That you have an onward ticket to the Netherlands should help. Suggest when you board, you show the onward ticket and tell them your destination is the Netherlands. If you are checking in luggage, make sure you have anything you need prior to arrival in the Netherlands with you in your carry on, in case they are able to check your luggage through (they probably will not be able to, but just in case).

No guarantee, but my guess is you'll be able to board.

It is the Airlines responsibility and is a massive fine for them if they allow you to fly.

  13. Since you have a multiple entry visa you do not have to do anything at immigration. You can just do a border run and get another 90 day entry just before your current permit to stay ends.

If you do not want to do the border runs you can get the extension of stay during the last 30 days of any of your 90 day entries you get from the visa.

Sorry this advice is wrong , you get only a 3 month visa to be renewed at immigration , your multiple entry visa will finish when you get a new visa stamp it is only good for the length of your visa , The multiple entry visa is a waste of money on a 3 month student visa you would have to leave Thailand 4 times in 3 months for it to be cost effective

  14. It seems amazing to me that you did not check the rules before you sent the money to Thailand, All money that comes into Thailand first of all goes through Bangkok Bank, before it is redistributed to other banks. A large amount of money that is, you then need to take the transfer slip to Bangkok Banks main office, who will issue you with a certificate of proof that this is foreign money and tax has already been paid on this money. When you want to leave the = amount of money can be moved free from tax. If you have more than you arrived with then you will be required to pay tax.

If you have no certificate, it will be looked upon that this money has been earned in Thailand and will be liable to tax

  15. "Anuwat said that the red-shirts wanted to just observe the ruling, without any intention to put pressure on the Court which should have liberty in its deliberation."

    smile.png biggrin.png tongue.png laugh.png cheesy.gif

Looks like troops of advance red shirts are being assembled and moved for the battle to come.

That is what all the excess baggage was when Thaksin's daughters flew to England a limit of 40 kg first class i believe they both had over 110 kg , must have been cash to pay for the protest

  16. He would not qualify for any visa other than tourist but if he starts school here he would then qualify for education and likely one year extensions of stay. But to stay here he does not have issues until age 15 as overstay payment is not required for minors. He would have to make any entry into Thailand with either a visa or visa exempt status but once here, although beyond allowed stay, nothing more than a stamp on exit that has no adverse consequences.

Children under the age of 12 do not require a visa they would be covered on the parents visa, but you are not his parent so i do not know how you would stand on this issue
