People who go to court don't necessarily get what they want but what is the best for the child they do get
What is the best for the child in the mind of a Thai judge?
I would really like to hear some examples of court rulings in cases involving foreign fathers...
Does it pay to stand firm on the demand of 50% custody and the child staying 50% of the time with me the father?
And what if the mother chooses to disrespect the court ruling and again refuses the father to see the child?

Are there any lower 'age limit' regarding where the child should live?
I mean would the court always rule for the child to live with the mother if the child is under a certain age?
I'm talking about cases where both mother and father are suitable to be parents...

The normal rulling is that the court decide what would be in the interest of the child. Their is no bias towrds foreigners and in most cases the parents will have shared custody, with the child staying at one parent and the other having visitation rights.
What about having the child living with one parent say two weeks and then two weeks with the other parent etc...
Is that set up an option in Thailand? (As it is overseas)

You can have a DNA test done at certain hospitals.
However you need a letter from the court for the hospitals to accept to do it.

When going to court the judge will ask you about your income, right?
They question is what kind of prove of income will the court ask for?
And what if the income is from overseas, but I'm not doing any work here? Will they double check with my embassy?
If I have no steady income(not working), other than what ever money my family send me once and a while when I ask them for it, what will my chances be of 50% custody of my child?
Can I prove those money transfers to my Thai bank account?

I've now talked to two different lawyers in two different firms.
A said that the child's mother has automatically full custody and B said that the father and mother share custody automatically.
A said that custody is almost never granted to the (foreign) father when going to court. B said that father can go ahead, if mother refuses to let
father see the child, and make a complaint and the court will rule that mother has to let father see the child.
BOTH A and B looked like I was an alien when I confronted them with the issue that Father must be on the BC twice. It was as if they didn't have a clue
what I was talking about when I tried to get that clarified. ?????????
B said Thailand doesn't have any parental child abduction law.
B also said that going to court will cost 80.000,- THB in starting fees. The initial letter to the mother asking her to sign a child custody agreement is +10.000,- THB.

The lawyers are just as confused as TV and it's contradicting advices from more and less enlightened members.

That's the whole point by going to court isn't it?!
Interesting though that if she has (or will have) a criminal record I'll be able to obtain full custody.

Scenario;
Father
Let's say the father has no income, but has a substantial amount of money in a Thai bank account.
He's been living in Thailand for a number of years.
He speaks Thai very well.
Lives alone and no relatives in Thailand.
He comes from a country that offers world class education free of charge. However he wish to put the child in an international school in Thailand for a few years to begin with.
Mother
'Unfortunately' mother has a 100k monthly income from her business.
She lives in a large house (rented).
Many relatives but no parents. Some living with her in her house.
She will most likely put the child in a (worthless) public school.
She refuses to let father see the child for several weeks at a time.
When father went abroad for 10 days she moved out of the house. Took everything with her and disappeared...
Of course there are many more details to it, but that's the basics...

Let me get this strait;
If the father legalise the child by making a petition to the court, will the father then have shared custody of the child?
-If yes, does that mean that the father and mother have 50/50 custody?
If not then what does it take to get that equally shared custody? What documents are needed?

If you are not twice on the birth certificate, you can petition the court to be recognised as the legal fater and can also ask to share custody with the mother. In that case the mother can object to you holding joint custody with her and you won't get it automatically.
So how do I go about petition the court? The mother will definately object to me holding joint custody. What's the next step then and what are the estimated timescales and costs involved???
What are my realistic chances if the mother fights my right to hold shared custody???

I'm up to my knees here and can't think strait just out of misery, so excuse my foolish questions below;
If my name is on the BC and I went to register the baby at the ampur together with the mother, does that mean I have shared custody???
I remember signing that paper on the ampur but unfortunately I do not have a copy of it. I have a copy of the BC though.
How do I know if I'm considered as the one that has registered the child or if the mother is???
The mother and I have split up and we were never married.
Another question; If the mother dies or gets unable to raise the child, will full custody go to the father or perhaps the mothers family??? She has no parents, but has 5 sisters. The question is relevant as she recently went through major surgery.
What if she is convicted of a crime (fraud), would custody go to the father or her family.

Strangely they give free tourist visas with one hand, and then they go ahead and collect increased fees for work permits with the other hand.
Just one more clue that says Thailand doesn't want long timers, but only short timers and big spenders.

One thing is for sure, no matter if the British couple are thieves or not, I won't step into a store at the airport ever again.
Me neither.

Give the baby some water to drink right after the baby has finished drinking milk.
Doctors and nurses tell you this while still at the hospital after the new little person has come through to this world.

Why not just grant 60/90 days upon arrival?
It's less bureaucracy and a lot more attractive to tourists (and expats).
One of the major reasons for many expat farangs to leave Thailand and relocate, is the necessity of going on long and expensive visa-runs
for the sole purpose of getting just another stupid stamp in their passports.
Naturally the Thai authorities wants to keep some degree of control with foreigners staying in the country, but there has got be be a better way.
