  1. Has any TV member bought a 1 year visa ( or know of any one ) from Siam International Legal Group for £200 ? I am going to live in Thailand for 8 months starting in November and was going to get a retirement visa ( as I am 51 ) from Hull but the visa Siam seem to be offering looks less painful and they offer a work permit to boot. Any pitfalls?

    You cannot get a work permit with a retirement visa.

    Here are your options.

    1. If you are over 50 years old, you can go to the Thai Embassy in London and get a "O-A" visa for one year. You will need to get a police report and medical certificate in the UK. This will be good for one year once you arrive in Thailand. Hull cannot issue "O" visas based on retirement, they will send you to London. You will need to show you have pounds worth 800,000 Baht in a bank or a pension of 65,000 Baht per month, or a combination of the two.

    2. You get a simple 90 day tourist visa in Hull and then change this into a retirement visa here. Then the extension of stay is made. You will need to have 800,000 Baht in a bank or a pension of 65,000 Baht per month, or a combination of the two to do the extension.

    With any of these two options you cannot get a work permit.

    3. You get a one year multiple entry visa. No money requirement of 800K or pensions required but you must go in and out of the country, once every 90 days. You can get a work permit with this option.

    Every Thai consulate/ Embassy has their own guidelines on what they require to get a business visa. Most all require a letter from a Thai company with supporting documentation.

    Joe was a client of ours but also had became a great friend over the years. He or I would call up almost every month just to chat. I always looked forward to his chuckle, which was priceless. Joe you will be missed.

  4. Another newbie i'm afraid - just looking some freindly advice on the pros and cons of buying comercial property in the northeast.

    Land ownership rules in Thailand as they apply to foreigners are pretty straightforward. Foreign individuals and foreign companies are not allowed to own any direct interest in land with a few exceptions( BOI and IEAT)

    You as a foreigner or a foreign company however can own the structure 100% in your name.

    Can i buy in mine name

    or business name?

    With BOI approval or if the land is located inside the Industrial Authority of Thailand Estate then you could. If the objective is for investment purpose only, no. This has to be for your companies use or your use as the MD. You can have 99.994% of the shares in your name under BOI.

    If you have a real business and Thai parties hold more than 61% of the company's shares and more than half of the company's shareholders are Thai nationals, the company will have the legal right to hold title to land. Technically you may be able to do this if this is a real company but all shareholders will be investigated if they have the funds to invest and some land depts still will not allow the registration. The most you will have in your name is 39% of the shares.

    Can i rent it out?

    No. BOI would not approve it and neither would the Industrial Authority of Thailand.

    Second option with a real business, it depends how it was set up and your companies objective.

    Can i live in it?

    Yes with BOI approval and IEAT. Yes with a real company scenario.

    Many foreigners avoid these restrictions with owning land by leasing the land for 30 years. ( if you invest 20 million and its for commercial & industrial reasons, it can be 50 years)

    If your business is sewage removal and you enjoy this type of work. Your motto is " The smellier the better. You are happy and will not having any problems telling people what you do at cocktail parties.

    You have pride in what you do, the money takes care of itself.

    If you are a silent partner then it doesn’t matter, unless you are in say... the sewage removal. You are not comfortable telling the hot blonde your Porsche came from sewage.

  6. I apologize up front if this topic has been explored in previous detail but I just found this site and my excitment has the best of me right now.

    My present job situation has me thinking real hard about making a career change. I've been an employee all my life but I have an entrepreneural spirt I'd like to explore. At 50, I think I have about 10 motivated years left. Bottom line, I'm seeking some advice from those of you that know the Thai businees scene far better than I. I'm not a stranger to Thailand - been a guest about a dozen times over a 25 year period. I'm seeking advice primarily to know if investing in a business is likely to produce an income stream for me. I would not plan to live in Thailand so I would guess that such an investment would be very difficult if I were not there. Still, there is always the chance of falling in with a partner. I'm not tied to any particular type of business but certainly something under $100,000 initial investment would be good. Please let me know if I'm crazy or if there might be a future in this idea...

    For most people your post sounds very confusing but being in the business of mergers and acquisitions for almost 25 years, it is not at all. I know that 90% of the people that I met 24 years ago, felt the same and 90% of the people I meet today feel the same.

    It is normal that you want to be your own boss and call your own shots. However it is also normal to have second thoughts, five seconds later " is this the right thing to do as you are used to the job security?"

    You are scared.

    Owning your own business is not for everyone. Many people can't handle getting a check almost their entire adult life and now all of a sudden, having the responsibility giving those checks out plus all the other upkeep.

    Being a partner with someone else in business, is not for everyone as well. In fact 78% of all partnerships don't work, many for the basic reason, no communication on having a agreement beforehand( what about the profit...pay dividends or expand, hours to be worked, responsibilities, etc)

    Yes you should be scared.

    If you can know that people that did overcome that fear, that 80% of all millionaires in the World, became rich from owning a business and it was not from working for someone else. A number of the millionaires became one from being partners as well and even some billionaires with a small investment.

    If you have risk capital, money that won't change your lifestyle because owning a business does have risk. Then you may want to look at our website www.sunbeltasia.com

    This will not be magic where you point and click and you own a business. This is going to take work on your part to do due diligence.

    As for being a partner and you are not around the location. It certainly happens in business, more than most people would ever think it does. I know easily quite a few partners like this. You of course should get a monthly PL, balance sheet. Fly in from time to time to just check in.

    IMHO, look at opportunities for a partnership where the business can't keep up with the demand. They need to grow but don't have the cash because of the 90 day-180 day turn around. Of course you need to due diligence and everything has to check out.

    If you want to swing for the fences for a home run, look at something new and innovative. Invest in a partner that has a clear goal and vision who is incredibly focused and driven to make it in the business world. Look for someone that is “Hungry” Cash flow and not ringing the cash register right away, will be big concerns. A start up always has high odds of failure and you would probably have a 90% chance of losing your money. The reason people play this game is to hit the gusher, Microsoft, Subway, Dell, Yahoo, Mrs. Fields cookies all had partners that hit it big. It has very high risk but high rewards.

    The partnership that I would stay away from is one where the business has used up the cash flow and needs more and is raising capital by selling shares. High risk and I feel the probability of hitting the home run, is not high.

    The last advice is to have someone in your corner that is making sure all your rights are protected from a legal sense. Make sure you get the shares you are buying and your rights are protected.

    One more thing, in any partnership, you need to like the guy and vise a versa. You have to be able to trust them but protect yourself. That will not come from one or two meetings but over time.

    If you follow this advice and do your due diligence, the odds go from you flushing your money down the toilet, to good odds you will have excellent returns.

    Take your time and go slow.

    What are the consequences if caught?

    Another category of things we deal with are arrests and imprisonments. That is about 2 a week. You can go a month without seeing one. Some never go to court and simply spend a night in the cells before being released.

    What's the most common reason for arrest?

    Overwhelmingly they are visa overstay. Perhaps as many as 70%. People don't always want to go home. Staying here with insufficient funds and sooner or later they get caught.

    What happens to these people?

    Some people never get caught. We have had people here 4 or 5 years on overstay and eventually they gave themselves up. They may have slept rough on the beach, for years in some cases. Not many, but some. They got a bit desperate as anyone without money does. Maybe they try to steal from the supermarket, drink a beer and not pay for it, things like that.

    The people who get cheated that way usually call the police. And when the police arrive it soon comes out that they are on overstay and often have other problems, nowhere to live, no money etc.

    We can not pay their fines. We cannot get people out of prison or pay fines - even though that is what they often want!

    We can make them aware of this situation and whether it is serious or not. We can let them know where they are in the system, bail matters if applicable, legal advice, that is if they have money for a lawyer.

    It is not always visa overstay. There are others such as working without a work permit, the second most common reason for arrest this. Some people are naive. They do not even know this!

    An alien who receives a non-immigrant visa can work in Thailand after having received a work permit. Any violation thereof shall make the employee liable for prosecution and imprisonment not exceeding three months, or a fine not exceeding five-thousand Baht, or both penalties.

    An alien who performs work that is prescribed by the Royal Decree B.E. 2522 (1979) which prohibits alien employment in certain occupations and professions is liable for prosecution and imprisonment not exceeding five years, or a fine from 2,000 to 10,000 Baht, or both penalties.

  8. Has anyone gone for their Non B in Singapore? I am planning on going to get mine in preparation for a work permit and am tossing up between KL, Penang and Singapore.

    Its just a single entry B that I need in the beginning, and then it is extended when the work permit is granted, right?

    If anyone has a comparison between the three to make, I would really appreciate hearing about it.

    Sorry if my questions are dumb, but I dont have time to go through all of the posts in this section to get an answer at this stage as my future boss wants to know on Monday morning where I will be going.

    Singapore or KL are both good for a 90 day "B" visa with the proper paperwork.Take your pick, where you like to visit.

    Proper paperwork for these two locations are

    1. Letter of employment with salary from the MD signed and stamped

    2. The company affidavit signed and stamped( business registration)

    3. List of shareholders signed and stamped

    4. Companies objective signed and stamped

    5. Copy of the value-added tax registration or application signed and stamped.

    6. Your passport and copy of such with validity not less than six months.

    7. Two (4x6 cm.) photographs of you taken within the past six months.

  9. i'm supposed to pick up my 1 year non-imm O extension on July 14th (as stamped in my passport), problem is ...my wife booked a vacation (flight+hotel) on the 13th-17th. sooo ...i got a little problem. i figured i'd ask here since i can't call immigration before monday and its worrying me a bit. could i just go 1-2 days before (say on the 12th or 13th) to pick up my extension? would it be ready by then?

    Simply take your plane ticket and show Immigration If it is not ready, they will stamp your passport for another 30 days. Be sure to get the reentry permit before you leave.

  10. I think, by the book, you do not need Thai employees for a work permit if you do not seek permission to stay on the basis of the work permit.

    However, IT is one of those areas highlighted in the officials' operating instructions where Thailand is trying to improve itself. If they decide you are a foreign expert, they may put a stipulation in the work permit that you do knowledge transfer, which requires documenting some training at the renewal time for the work permit. They also pressure you heavily to have Thai employees for this... we do not know for certain if you can document training of a non full-time employee, e.g. a student or intern. I am stuck with such a requirement, to train two employees. We've found the work permit office to be unsympathetic to the idea that we do not need these employees for our current client workload. :o

    This means that you take your chances if you try to cover IT work or consulting in your work permit job description, as opposed to just director duties. Even with just director duties, I am wondering if they would still want knowledge transfer if they find out you are a "foreign expert"... (it is hard to explain how a company with IT services in its mission is not going to require some IT-related employees, either you or some locals).

    It seems like everyone expects you to operate in the gray area w/o a work permit if you have only foreign business for yourself as a consultant. Once you incorporate here, they seem unwilling to consider the possibility that you do not have a growing business that is going to involve a bunch of Thais... that is just my impression from personal experience.

    The Officers always have the discretion to use whatever requirement they like.

    As for the Labor Dept., we have processed now close to 5,000 work permits and we never had the Labor Dept require any Thai employees to get a work permit.

    As for immigration, if you your companies objective is "Consultant" if you employ one Thai employee, we can get you a extension of stay based on business.

    Immigration has different criteria than the Labor Dept. Hence why they would require one Thai employee and the labor Dept no Thai employees.

    Companies objective is "IT" then Immigration would require 4 Thai employees and the Labor Dept still would have a requirement of 0 Thai employees.

    Some people would say how could you not involved Immigration based on business, even though they have a work permit. If you had a extension based on marriage, education, investment then it would not be a problem.

    Otherwise you would obtain a one year multi entry visa outside Thailand and do visa runs every 90 days. When you came back into Thailand you would need to revalidate your work permit. You would be legal and have no Thai employees requirement.

  11. Take a good look on the lease contract, what has been stated before you engaged a lawyer to take legal action against the property owner. Good Luck.

    You are correct. The rights are going to be all in the lease. Depends if within the last 6 months, either party can notify the other on termination of the lease. Even if you have another option of 3 years, if you did not have a good lawyer representing you, odds are high, it will be nasty and the Landlord has the rights to kick you out. A option lies with both the Landlord and the tenant unless it has already been granted in the contract.

    It is true we help foreigners apply for extension of stays inside Thailand and even if someone qualifies help them obtain a visa at a Thai Embassy/ consulate. But in the Consulate/ Embassy case, the applicant has to go there themselves.

    Some people when they hear “Visa service’ ears perk up, mine too in fact, as its usually a service taking a duffel bag of passports outside the country. We never ever and I mean never will take a client or whoever passport it is, to a Embassy to get stamped or cross the border to do so. We strongly advocate never to use a "visa service" like this. It is illegal for both the visa service and the applicant.

    If you find a job with in 7 days of turning in your work permit. You can stay in Thailand and apply for another extension of stay based on business ( as long as the employer qualifies)

  13. My friend,UK citizen,is married with a Thai and has a visa thereof.

    Elderly people,both,no children of minor age,well,perhaps a marriage of convenience.

    Now thei're having problems living together.

    Should they separate or divorce,what's the outcome for my friend?Must she change her visa to a retirement visa or are there other solutions?

    If she decides to end the marriage and if she is over 50 years old, she can change the extension of marriage to retirement. In this case she needs to have 800K in a bank account or a pension of 65K per month.

    She could also change it to a extension of stay based on investment, if she has bought or owns a condo from a developer worth 3 million Baht. it can also be money in a Thai state bank.

    She does not need to leave Thailand for this change.

    Try all three stores. Do a taste test :D

    The ones on beach Rd are owned by the same owner, a nice guy. His Grand Opening for the first store was scheduled for New Years Day 2005. The tsunami happen 5 days before. All the equipment was brand new, never used and washed out to sea.

    The owner took care of his staff the whole time and even when the place was finally open and business was slow. He did not lay anyone off.

    The one on Rat U Thit was not affected by the tsunami directly and is owned by a Thai lady who is also nice.

    Sounds like a good reason to do a comparison test.

    Of course when we open in Junceylon, no more comparisons will be needed :o

  16. For my money Subway is the best 'fast food' option in Thailand.. Healthy tasty and instant.. sure people may contrast and compare with 'back home' but on the ground when you choose between McD's (wont touch it) KFC (one in a blue moon) or Subway (couple of times per week) I know which one gets my biz.

    Funny thing is here in Patong we have 3 all close however the times I have ordered on either of the beach Rd locations I have had poor or surly service (once was shocking.. When she girl tried to over charge me and I politely corrected her she called me farang kee nok to my face) yet the Rat U Thit operation is always a super friendly bunch.. No need to guess which one gets all my business. Wonder how much is the high turnover and less repeat custom at the touristy beach front locations.

    If I had any advice it would be.

    1) improve delivery services... Twice having ordered a sub they simply couldnt find my house despite explicit instructions, niether time they called back to fix it just left me waiting until I called to find out what was up and the delivery fella also had no phone so couldnt 'solve' the lost problem without returning to the store.. Hot sub delivered stone cold wasnt tasty. However to thier credit both times they really were genuinely apologetic and tried. If delivery worked better I would probably order more as I am both lazy and often hungry :o Also (this really is petty) NEVER in all times I have ordered delivery has anyone ever remembered the stamps, I nearly always have to prompt in store also.

    2) Website. Though I hate thier product 1112 pizza has a good e-commerce solution that a lot could be learnt from. Have the full menu online, have a system of checkboxes to customise the salad and sauces selection, allow the creation of a make your own sub (surprisingly the shops dont let you do this, I think becuase they dont know what to charge). Make sure the system promptly confirms via email and timestamps the order and pressurize stores to fulfill delivery within a fixed time frame. I would have thought that 30 mins would be ample time ?? But even if its longer state what it is and make a policy (thats adhered to) about delivery times. I wouldnt even care if delivery had a small charge or premium, just make it work perfectly. Make sure you store custmer preferences (address, tel etc) so that ordering is a few click process as possible.

    3) linking items 1 and 2 you could use (in Patong) the services of a cartographic mate of mine (or do your own servey or get a good map somewhere) who has spent a lot of time to produce accurate full street level maps of the area ( http://www.siammaps.com/patong/patong.html ) use this and at checkout make the orderer click house location giving exact co-ords to the deliverer.

    4) either increase menu selection slightly or introduce sub of the month or something to keep selections fresh.. I find the menu to be a little limited after a few orders.. More choice would have more orders (from me).. I understand staff training and issues but surely dreaming up a new combination or selection of stuff is not too tough.

    I hope that these sound like suggestions and not complaints.. ###### made me hungry now, will now have to go get a half sub for breakfast !!

    I am a student at ABAC. And I just joined a company to work for. The company has already given my the work permit. But my visa status is Non-Immigrant with 'ED' category. Now, I was being informed that the company cannot extend the visa if the category is ED. They have suggested me to go out of Thailand and get a new Non-immigrant visa with 'B' category. But this is something very much troublesome.

    Can I change the Category of my visa from Non-Immigrant Ed to Non-immigrant B type without leaving Thailand?

    Or the can the company can still extend my visa even though it is a Non-immigrant ED category?

    Any help regarding this will be very much appreciated.

    If you are continuing to be a student, then no need to do anything. Just extend your Non Ed again, when it is going to expire based on being a student, and your work permit will be renewed for that time period.

    If you are going to no longer be a student and now what to apply for a extension of stay based on business. You do not need to leave Thailand and are able to apply for the extension based on business. The visa itself does not need to be changed to do the extension based on business. As long as it is a non immigrant visa, you are able to do any type of extension.

  18. Btw, the letter issued by the bank has never stated that the money arrived from overseas (albeit it had anyway) and Immigration have never queried the letter.

    Just depends on the Immigration Dept/ Province and even the officer inside the Dept.

    Some officers in fact have been known to ask for two letters. One letter stating the current balance and this must match with the bank book. The second letter from the bank stating that the money came from overseas. Some cases are different because the officer is different than one that you may of had.

    This where the frustration lies as they are missing a doc. If the officer doesn’t ask for anything else, then it is very smooth.

    Any how, I have to say I have always recieved gracious service. My wife even went in on a visit several years back, I am not sure if there was a charge.... But her report was it is a top notch organization.

    What branch were you at? In our mergers acquisition department, first time I ever heard the word "pushy" We provide information in a confidential matter, we are their to acquire information from the seller solve problems but not aware of one time that anybody convinced or try to persuade someone to buy a particular business. We let the client decide what business they want and try get to the point the buyer, seller and even the landlord are happy.

    Follow up to a showing is unacceptable. That’s what we at Sunbelt value is being the best in client relations. While the lack of service you experienced on responding back on a question is unusual and not the standard of our firm, there is no excuse for a lackadaisical attitude on the part of any of our employees.

    Follow up after meeting a client is another thing. Sad to say, we simply don’t have enough time. That’s why I would never think we could be considered “pushy” We unfortunately only have a limited hours and on average only one person of 40 acquires a business. As a result we need to meet with a large number of people. Hence we simply don’t follow up, like we would like. We made a decision a long time ago, it was better for the client to follow back up with us rather than be “pushy” It is not how our company is based on.

  22. What does rent in the Paragon cost?

    20- 25% of your gross sales depending if you are local or international brand. ( A bargain compared to the Emporium which is 30-35%)

    33% of your gross sales if you have a retail store.

    You also could of paid 250,000++++ Baht a sq.m. up-front for a 25 year lease. It was quite common, many retailers putting up a million dollars or more for the lease.

    The fee for a twelve month extension is ฿1,900.

    Depends. Some people are comfortable the second year to do it themselves. Some even are the first year. But there are a certain number that if they paid 6,500 Baht the first year and if they like, 3,900 Baht on yearly renewals, it was well worth it to have everything go smooth. Making sure that they have a passbook matching the amt stated in the letter from the bank. That the letter from the bank is not more than 72 hours old. That the letter states the money arrived from overseas. If they don’t have the money, how there are other solutions such as a affidavit from the embassy. I have heard of one firm that charges 25,000 Baht and they average 2 people a day using their service. Its all relative if you want someone to make sure everything is cool.

    Here is a typical letter from a visa the other day who could not get the letter from the bank as it was in Pattaya and he was he flying out that night.

    I feel obligated to let you know how much I appreciate the assistance of

    "Koy" and your professional office. The cost is worth it to know I can leave

    on a moments notice should I need to attend to family matters.At times I can

    be somewhat pessimistic, possible from having had a careerdealing with criminals

    which seldom yielded positive results (retired Parole ofc supv.). Koy kept the faith

    and her perseverance paid off in the end. Without her presence of mind I most

    likely would have insulted someone and ended up in custody.

    Obviously, I still have a lot to learn about the Thai bureaucracy and

    expect to "obvious" to be acceptable, which appears not to be the case

    USA multi-entry visa for my wife, as soon as we recover from "taxi/bus

    lag".

  24. they are not going to be working at all. They are simply doing the training course that will take them up to instructor level. Hence the reason it is normal to get a non b ed visa.

    This is for a student not for the instructor thats training them..........

    Would KL, Singapore etc to issue multi entry non b's to people that are applying for the first time if they not from there?

    Sorry but the odds are VERY high, no Embassy/Consulate in Asia is going to issue him a non Ed one year multi entry visa.

    You have three choices.

    Choice 1

    Apply for the extension of stay based on education in Thailand( They get a 90 day visa in Laos.

    Immigration Form 7 (Tor Mor 7)

    Copy of passport

    A 4 cm. X 6 cm. Photograph

    1,900 baht application fee

    A certified document from the governor of the province in which the Private Educational Institute is located or from the Government Department or equivalent that takes care of the institute, document must contain details about the applicant:

    Name, Family name

    Age

    Nationality

    Passport number

    Total academic years - curriculum - funding

    Education transcript of the applicant - length of further stay

    School license (Sor Shor 2)

    The Permit / certificate to be school manager (Sor Shor 5) or Principal (Sor Shor 8)

    The officials reserve the rights to examine or ask for additional documents if necessary

    2nd Choice

    apply for the extension of stay based on work. ( I know you stated he is not working but if he is a intern. The Thai government has a category for this. I know as we have had a intern in our office for the last three years. They always get a work permit even if the salary is zero and a extension of stay as well( even though the salary is zero) If he is going to be a instructor once he finishes then a case could be made he’s working.

    Third Choice.

    He goes West to apply at a Thai Embassy/ Consulate to get a one year multi entry visa.
