  1. i think most employers (in the world) would terminate the contract (without warning) of an employee making such accusations

in most circumstances, blackmail is a crime - if that is what happened (and she has evidence) she should report it to the police

if not, she needs to be careful that any legal action she pursues with regards to the dismissal process is not counter productive

    good luck

You can find a legal definition of blackmail here :

    http://legal-dictionary.thefreedictionary.com/blackmail

If I'm not mistaken forcing someone to do something against his or her will is actually blackmail, forcing someone to leave without notice unpaid should be a case of blackmail especially when you try to negotiate in good terms to start with.

If this story goes up to court I have indeed plenty of content, my goal here is not to spread rumors about X or Y company, my goal was to seek help as I am not familiar with such cases in Thailand.

My questions have been answered tho, thanks for that and be sure I will post the outcome as soon as it comes to terms.

  2. Here is the sentence used : I just want you to take note that I am unhappy with the blackmail I just received from ***** (about the wages and their kind offer to pay the last month salary) I am tired of your repeated lies.

I fail to see how this could cause any damage on the company as, like I said, it was a private conversation in Skype, she did received a written warning tho, but the contract stipulate that the employee is entitled to 3 warnings before a termination of contract, I would like to point out that it was not sent by post with signature as the law stipulate either.

Actually leaving the company or being fired is not the issue, the real issue is the terms, and for sure we do not agree on the terms.

Will try to go by myself to the City Hall tomorrow (I am indeed in CNX) and if I cant figure it out by myself I would appreciate you to give me K. Krit contact.

    Thanks again for answering.

Was the private conversation on a company computer/system ?....the certainly not a private conversation then

Further given the "liable" laws in Thailand accusing people of blackmail and calling them liars in writing could be interpreted as gross misconduct therefore written warnings may not apply it could be automatic dismissal and no severance applicable

    Just my take on this

The conversation was from home to her team leader, they did blackmailed her saying she should leave immedialtly without any notice or severance while she was trying to negotiate, the conversation was in French and quoted in French out of context in the letter, the Team Leader choosed to report the conversation to the direction but again out of a private conversation on a media that the company does not own.

I would totally agree if that accusation was made public and/or made on an internal chat system tho.

  4. Just pops ut to say that they did not offer anything, I was not even aware of the severance and if they do they did not mentionned it, They just offered to pay her until the end of this month (if thats an offer).

They quoted a message out of context took on Skype from my wife to her team leader as proof of her misconduct, I have serious doubts it is even receivable.

I am printing all documents and will go City Hall tomorrow morning and I'll keep you posted.

    Thanks again for the replies.

  5. What a crock of crap.

1st this statement needs a 'bit' of clarification...

"... “However, we will not grant a person a 12-month B visa if the person is applying for their first-ever 12-month non-imm B visa and there is less than six months left on their work permit."

You can't get a work permit without having a Non Imm B so how can they be applying for the first time and already have a work permit? Even for the contract people we have come in, Immigration gives them temporary Non Imm with expiry for the duration of the contract (even 2 days - yeah I know - sheer stupidity - used to be 15 days)

2nd - It's not up the the individual Consulate to make a decision of issue of a Non Imm B by changing the rules. If you have all the paper, documents, offer to work and compliance details, Ministry of Immigration, Consular Section and also Labour Department work in collusion as is required for each to do their own thing. If one has gone rogue and is saying you can only get 90 days that seems a bit incongruous and not in keeping with their Consular obligations. If however they run you 90 days you can renew here as first year is 90 day renewals anyway. None to my knowledge gets 12 month day one. They get 4 x 90 days and then a 360 day year two.

I think the story has been misconstrued somehow.

A visa delivery is always at the discretion of the consul issuing the visa, no exceptions in any country as far as I know.

If the consul decided you wont get a visa there is nothing you can do to change that.

And again they never said that they wont issue visas, they said that they wont issue multiple entry visas without the presence of a work permit, that's 2 very different things and since a multiple re-entry permit is available in any immigration office I don't see where is the big deal.

    Simple steps :

Get your paperwork from the company you work for.

Go to KL to make a 90 days non-B visa.

After 90 days go to your immigration office to extend it for 4 x 90 days and ask for a multiple re-entry permit.

  6. They seem to be talking about those living in Thailand with work permits making application for visas in a third country. Not about business travelers.

Yes what about those of us that live here but don't work. I'm about to apply (in 90 days time) for my 4th 1 year multiple entry non imm B visa.

I'll be sending a new passport to Hull for it though as my current UK passport is full (2 blank pages or 4 sides left).

If it is going to be an issue I might consider applying for an education visa for the next year, although I'm unsure what that will me to do. Are Education visas Multiple Entry?

I don't want to have to go to immigration every 90 days, but I do want to be able to fly out of Bangkok whenever I feel like a visit to family in Hong Kong. I also don't want to go to Thai classes, I prefer to learn on my own in my own time.

    Thanks for any advice.

Then you need to get the approiate visa for your circumstance

Thanks, but which visa would that be? I want to live here but don't want to work. I'm far too young to get a retirement visa and I have no interest in marrying a Thai woman.

That leaves the education visa or another non imm B. Education is fine as I'd like to learn Thai but I was hoping someone could tell me if an education visa is multiple entry, or do I have to mess around with re-entry permits etc.

An ED visa is not multiple entry but you can buy a multiple re-entry permit in any immigration office.

  7. So that's it. A statement. No explanation why they no longer wish to perform one of the tasks embassies are made for. Tossers.

Embassies are not meant to make your life easier but to regulate immigration, they didnt stop to provide visas as far as I know, they just stopped providing a misused visa.

Like I said I had no problems getting my visa last time I checked in, I also asked for a multiple entry (while I had all the required documents for my non-B visa) and they said : we now provide multiple entry visas oinly to those who are carrying a work permit with 6 or more month of validity. Like Mario2008 said too many people were using the multiple entry not to work but to be permanent tourists in the country.

Once you have a 1 year extension nothing forbid you to buy a multiple re-entry permit from immigration.

  8. Why do they stop/change visas all the time down there? Every few months it's something else!

Because, basically they don't want you here! They want to make things as difficult as possible to persuade you that it's better to stay at home.

Of course, your money is more than welcome!

thats exactly the point.they want only our money!

we should do the same kind of stupid business or whatever visa for thais all over the world, but our politics are also stupid.

Do you know how hard it is for a Thai to get a visa for your country before speaking?

I know in my country it is far more difficult than getting a visa for Thailand for me, and thats just for a simple tourist visa, cant even start to imagine how messy it is for a work visa....

It is not like we didnt had any option to stay in Thailand :

    - Student visa 1 year

    - Marriage visa 1 year

    - Retirement visa 1 year

    - Double entry tourist visa 6 month

    - Work visa with work permit up to 2 years in some cases

I can understand that they dont want permanent tourists, no country does.

  9. You still have the option to get a 3 month visa that you

need to extend for one year on site with a work permit and then taking a

    multiple re-entry permit.

    I think Kuala Lumpur embassy

is right, they should deliver multiple entry visa only to Malays, if

you really are working for an oversea company you should get your

multiple entry visa from the embassy where your company is originally

located, makes plenty of sense to me.

    Why only to Malays?

Because the embassy is in Malaysia, makes sense that if you are actually working for an oversea company you need to report to them eventually.

I had no problem getting my B visa and 1 year extension as I am working for a Thai based company.

If I was working for lets say a French company asking me to come over in Thailand to do business it would make sense that the multiple entry visa should be delivered by a Thai embassy located in France as it would be easier for the said embassy to verify that what I am asking is the real deal.

Anyway this is not new, since already 6 month KL embassy is asking for a work permit beforehand to provide a multiple entry visa.

  10. Because it allows you to live and work in Thailand legally for a year.

Sent from my GT-I9300T using Thaivisa Connect Thailand mobile app

Not true at all. You always need a work permit to work.

You didn't understand his comment. Of course you need a WP, but you need a business visa to get a WP and there are two primary ways to obtain and keep a B visa. The extension the embassy is suggesting people get has more difficult requirements to fulfill, such as amount of capital, length of time business is established, and tax, which is why so many people like to get the one year outside Thailand every year then do a border run every 90 days which the 1 year visa obtained outside of Thailand requires. The one year extensions don't require the 90 days entry/exit, but you have to get a re-entry permit before you leave in order to keep the visa "alive".

I do understand his comment, but it's not relevant in this context.

The reason I say it's not relevant, is because many people (myself included, hence my interest) obtain a 12 month (and hence multiple entry) Business Visa for the specific purpose of being able to come and go within a 12 month period and conduct business here on behalf of a overseas business. In my example a 12 month Business Visa is the correct and only appropriate class of visa.

If someone wants to apply for a work permit, then my understanding (and please accept my apology if this understanding is wrong) is that they can get a single entry (3 month) business visa and apply for a work permit and extension of stay on arrival. That would be appropriate for someone who intends to work in Thailand, in my circumstance (and I suspect many others like me) I do NOT WISH TO WORK, and I don't want an extension of stay either, I just want to be able to come and go as I please and conduct business whilst I'm here, hence my 12 month business visa.

You still have the option to get a 3 month visa that you need to extend for one year on site with a work permit and then taking a multiple re-entry permit.

I think Kuala Lumpur embassy is right, they should deliver multiple entry visa only to Malays, if you really are working for an oversea company you should get your multiple entry visa from the embassy where your company is originally located, makes plenty of sense to me.

  11. How can you judge if they went to a temple or not just by watching this video ?

You certainly don't know any of them to get the full story, temple are part of the whole Thailand while things they did in the video are what you get in Chiang Mai.

When you travel in your country do you visit every single church ? You never went for a burger anywhere and you never went to a night club ?

We all live in this materialistic society, we are all part of it using a computer to read this forum for example unless you live like an ermit you shouldnt judge the materialistic society you get the advantage of everyday.

To change the world we have to start by ourselves, spitting on others behavior wont lead anywhere (you and them both).

  12. The power supply while good is way too powerfull for a single graphic card, a good 530W RAIDMAX will do the job for 1590THB (available at banana IT).

A radeon 6850 or Gforce 560 TI will run BF3 Flawlessly for 6000thb (or around).

You don't need a Caviar black to play BF3, any cheaper hard drive will do.

Stock Kingston RAM 2x4GB will cost you loads less and will do the job (4GB is plenty enough to play).

Good Oker gaming grade keyboard and mouse will cost you less than 1000thb, a very good balance between quality and price.

A 23'' Acer LCD with good respnse time will cost you 6000thb or around, in the meantime you can play on your LCD TV if you own one.

A 2 - 3k thb gigabyte motherboard will do perfectly aslo.

  13. It may not be the same in all countries but believe me in my country immigration laws are far worse than in Thailand.

Don't like the way it is here ? You are always free to find another place to stay, no one is forcing you.

Of course, beers and girls are usually more expensive elsewhere .... but if thats why you are staying you should really consider leaving.

You are right, when you don't like it leave,

it's not about the girls, I am still with my wife, since more than 20 years, the beer is here more expensive than in my home country,

and I spend the last 13 months in my home country, it was great, not to check all the time you passport,

anyway I am back in BKK, my son study here, we still have our business running and all my friend are here,

Well if your country is so great just why are you living here ? Please explain, I don't see the point of : "i'm living here because all of my friends does" it is not even valid.

And of course you don't have to check your passport in your own country it's your own ......

I wonder how simple it is for a Thai to live in your country.......
