    At least they are doing something.

    They have identified four Syrians overstaying.

    If these are not terrorists, well if that's clarified.

    Next step should be to check all Iraqis, Yemenis, Saudis and North Africans.

    The police can only form clusters when they have no concrete tips.

    Terrorists with EU passport will probably perpetrate an attack in Europe,

    on terrain they know.

    Also the media response would be greater.

    And that's one of there main objectives:

    Spread fear and terror supported by free PR in the mass media worldwide.

    I personally think that the Thai Authorities have done a good job, they have put it out there for there kingdom and the world the to see.

    I would recomend that you do the visa yourself,all an agent can do for u is fill out the forms and advice you on what documents will need.You will need to gather the documents yourself anyway so in my opinion this is where most of the work in completing the visa is.

  4. I got an email over the medical, but it did not clearly state that the sender was the case officer.  Could be a receptionist for all I know.

    I would guess that  she would be your case officer.

     

    This is the same lady that was the case officer in our application for a 445 visa last year.

     

    Our partner visa took 4months 2years ago.

    Mate you can still apply for a partner visa whilst her current visitor visa is still current.

    It will all depend on if you apply onshore or offshore

    If applied for in Aus as stated above she will get a bridging visa so i am unsure how this will effect her visitor visa if it will be cancelled or if her travel will be restricted.

    Mabey other TV members know more about this.

    If applied for in Bangkok it should have no bearing on her visitor visa until the partner visa is granted when granted it will be cancelled,but she will have her partner visa.

    The other thing is that she will have to be offshore for a partner visa to be granted if applied for offshore and onshore if applied for in Aus.

    yes the visitor visa is cancelled upon issue of a bridging visa. In the case of my Thai friend his de facto, upon granting of the bridging visa is not permitted to travel outside of Oz whilst the Visa 800 application is processed. If she departed Oz would require reapplying with a very hefty fee.

    AFAIK, the tourist visa stays in effect and once that ceases, a bridging visa A is automatically kicks in.

    If the applicant has to travel outside of Australia, they will need to apply for a bridging visa B which

    allows travel.

    I was not aware a bridging visa was an option until I read your comments. We would much prefer to apply for a bridging visa and then a partner visa in Australia. My de facto wife of 8 years says she would have no problems having to stay in Australia without being able to return to Thailand for any length of time. She has been to Australia on 3 months tourist visas with me in 2011, 2012 and last years and loves the place.

    There is an Australian Immigration Office in Darwin, where we will live in my unit, but the visa would be processed in Perth. It would be a lot easier for me to have the visa processed in Australia. Getting 888 Form Statutory declaration witness statements from Australian friends and having all other documents certified seems easier when done in Australia. I had problems when I thought I had a strong completed partner visa application late last year, after we returned from Australia. My 888 Form statutory declaration witness statements had expired after six weeks and the application Forms SP 40 (sponsor) and SP 47 (applicant of partner visa) had changed in November last year as well.

    If we should be successful in getting a bridging visa back in Australia, should she get a police clearance from Thailand before leaving? I will take all her original Thai documents and translations with us, just in case we will apply for the bridging visa. I suppose the health clearance checks will be done in Australia at a later stage. Thanks for the input from all of you. Regards

    Yes make sure that she gets the police clearance certificate from Thailand she will need this.And also be aware that she may need health checks for any dependent children as well if she has any. doesnot matter if they are on the application or not.

    Usually the VFS office in BKK will issue u with a form to take to the police but as u may be applying in Aus i am unsure if u can still get this form from the VFS

    Thanks for your reply. I thought the only option we had was to apply for a partner visa in Thailand and then wait until it was approved after waiting for up to 12 month. I was under the impression that after applying in Thailand, we had to stay in Thailand be here for notifications, interviews and the final approval of the partner visa. We are planning to travel to Australia next July and return in September, within the allowed 3 months period of her multiple entry visa, which expires in May 2015.

    I thought that if we decided to apply for the partner visa next September here in Thailand, we would not be able to use the multiple entry tourist any longer visa as we had to wait here for a decision on the partner visa.

    I didn't think it was possible to apply for a partner visa in Australia, as we could only stay there for up to three month, which would not be long enough to have a partner visa processed.

    I was not aware she could be able to apply for a bridging visa in Australia, when visiting on a tourist visa. Cheers

    It is totally okay to apply for a partner visa and visitor visas at the same time she will not have to wait in Thailand whilst a decision is pending for the partner visa.

    My wife in the past has been granted a visitors visa whilst waiting for a decision on her partner visa.

    The department will communicate with you via e-mail if u have given them permision to do so. Make sure u add to her partner application form 956.

    If any further information or an interview is required you could send the info from Aus or arrange for the interview when she arrives back in Thailand.

    In most cases an interview is not required.

    If clause 8503 has not been imposed on her visitor visa she can apply for a partner visa in Australia.

    Another thing your wife may be eligible for a permanent partner visa bypassing the temporary partner visa as your relationship is longterm

    You can submit a partner visa application and a visitor visa application at the same time,

    This way if your application is done honestly and "correctly" u will most likely be granted the visitor visa whilst the partner visa is being decided on.

    With all due respect, I would advise against this.

    OP has stated she wants her husband to apply for a partner visa onshore.

    IMO, lodging a visitor and spouse visa together will virtually guarantee that

    "No Further Stay" will be imposed.

    I would lodge a visitor visa and then take it from there.

    I also think that if the upcoming birth is mentioned on the s/c 600 application,

    8503 will almost certainly be imposed.

    I don't agree with simple1 in post 8 that Immi would be/are more flexible if an Oz

    citizen is having a baby with a foreign national (by not imposing 8503). My experience

    is that 8503 is more than likely anyway and giving Immi an excuse to stay in Australia

    and not return almost guarantee's the imposing of 8503.

    Just my version of things anyway.

    Just my 2 cents

    I have read on the D.I.B.P. web site that having a baby with an applicant can come under... compelling and compasionate circumstances this may not be so for a visitor visa but is so for a partner visa.

    Therefore the OP may still be able to apply for a partner visa onshore if the 8503 is imposed on her visitor visa.

  9. From what I understand Kris it is only a matter of waiting out the two years, or thereabouts for the PR visa to be granted. We have not been asked for any further paperwork nor money. Just hoping we don't get any unexpected or unwanted surprises!

    They will send you an email requesting more information for her permanent partner application.

    There is no further fee for this application.

    Just be aware that they will probably send this to your partner and not you even though you were the sponsor.

    So make sure she checks her e-mails.

  10. As long as u lodge the 445 visa before your partners permanent resident visa is granted u will not have a problem they will make a decision on the 445 visa before issuing the PR visa to your partner.

    I have just been through the exact same process and DIBP granted us the 445 visa the same day that they sent an email for my wife to apply for her PR.

    We lodged the 445 visa application in SEP 13 and they granted it in APRIL 2014 2 months before my wifes PR is due.

    When the 445 has been granted;

    You will also have to lodge another application for the children form 1002...( application by a subclass 445 dependent child for permanent partner visa )

    this has to be lodged with your partners PR application.

Thanks for your reply my wifes ex husband is working out of Thailand now and no one can contact him or has any idea when he will return.He doesn't have anything to do with his 2 children, lucky if they receive 2-3 phone calls a year.Thus being the case my wife will probably receive her permanent visa before getting any kind of letter from him,if he will write one.Can they come just on a tourist visa for a holiday or does the father still have a say?

    Sorry to say, but if the children are under the age of 18 they will still need permission to travel for a visitors visa, the same rules apply.

    I would advise you to send an e-mail to [email protected] and state your situation and any questions you have. I have done the same in the past and found them to be very helpful with information. They look after child visas in Australia

    It also would not do any harm to send an e-mail to [email protected] as they will be the department that you will be lodging any visa application with.

    I am in a similar situation, we lodged a dependent child visa (subclass 445) 1 for each child. This visa can only be applied for whilst your wife is still on her Temporary permanent visa. You could also apply for a tourist visa.

    If the children are under 18 and their bioligical farther is still living you will either need a court order that states that their mother has sole custody and very importantly can determine where they can live. (This could be a lengthy process!)

    or

    The father will have to give Written permission for them to travel, this will have to be witnessed by a person that has authority to do so. Must be recognised by the D.I.P.D.

    The Amphur office,V.F.S.or the Australian Embassy can witness and certify the document.

    In our case the childrens father went to the V.FS office in Bangkok and had the form signed,witnessed and certified there.

  13. Send an e-mail to the Australian embassy in Perth and Bangkok.(they will answer them!)

    Perth deal with the child visa applications in Australia. but they can be most helpful with information, state your circumstances and what u want to know i have personaly found the Aus embassy in Perth to be very helpful.

    My wife also has sole custody of her children( via court order) , but D.A.I.C. wanted the father to give written permmision for them to travel to Australia also.

    We got in contact with their father and he went to the V.F.S. in Bangkok with them and signed ,the appropriate paper work.

    I think that you will have to get court documents that state the children can leave Thailand and travel overseas if the father can not be contacted.

    This may take some time.

    Speaking as an ex Perth resident the above is good advice.

  14. we want to take our 'daughter' to Oz on tourist visa. i quote the daughter because although she lives with us, on her birth certificate, my wife's aunt and uncle are the birth parents.

    so if we can get a 1229 form signed by the parents, does anyone know how long that is valid for? for example, if we get next month, could we apply for the visa in say 9-12 months time and the 1229 still be valid? i can't find that info on the website.

    also, on the 1229 it says 'You must attach to this form:

    • a certified copy of the child’s/children’s birth certificate(s), (if it is not already lodged with the application.);

    • a certified copy of the personal details page of the non-accompanying parent’s, or person(s) with parental

    responsibility’s passport, driver’s licence, National Identity Card (ID card) or birth certificate; and

    • a certified copy of any relevant evidence making you solely responsible for making decisions about where the

    child/children is/are to live (if applicable).

    what do they mean by 'certified copy'? certified by who? can that be done at the Amphur too?

All personal documents such as Birth Certificates, Marriage Certificates, Household Registration Book, Educational Qualifications, etc. must be certified by the relevant local district office as follow

    Australian Visa Application Centre: Service Deliver Partner VFS Global.

    Or

    The Consular Section of the Department of Foreign Affairs and Trade at the Australian Embassy in Bangkok can witness and authenticate signatures and provide certain other notarial services (fees apply for these services).

    In Australia, copies may be certified by a Justice of the Peace, Commissioner for Declarations, or person before whom a statutory declaration may be made under the Statutory Declarations Act 1959.

    Please note: Photocopies of certified copies are NOT acceptable.

    In Thailand people who can certify copies include officers at:

    District Amphur office

    Visa application centre V.F.S.

    Visa and immigration office,Australian Embassy Bangkok (by appointment only)

    So will be able to get your documents certified at your local amphur.

    On another note you should check if you will have to have these documents translated as well if so these will have to be certified as well.

    The Aus embassy take child visa's very seriously for good reason. This is why the same applies nevertheless if the application is for a visitor visa or permanent visa.

    You are correct that everything should be translated and certified, including all translations,but some form of official permmision will be required if the biological father is still alive and living before D.I.A.C. will allow the children to travel to Aus.
