  2. As long as your Immigration entry permit extensions are based on marriage - such that you need no photos of you and  your company's Thai employees at work in the office  (which are required for a Class B extension), you may opeate as you are, with no problems.  

     

    What you cannot do is deduct as a business expense any address-related expenses (rent, electricity telephone, ADSL, etc) at the condo address - in order for such expenses to be deductible, the location must be a registered business address of the company.

  3. I have PR status - as of 2015.  The eligibility criteria to APPLY is that applicant must have been continuously on an extended non-immigrant entry permit for the three most recent years prior to application. That means unbroken entry permit status - period.   They make no provisions for an "alibi".

     

    Meeting the minimum qualification to be eligible to apply is a long way from having a realistic chance of being approved.  They use a scoring system - ten categories, ten points per category - and you have to achieve a certain cumulative score (rumored to be a bit above 50 points) - to be approved.  Age is one scoring category.   Education is another. Thai language capability (listening & speaking) is another.  Amount of personal income taxes paid to Thailand is another.  Health and fitness is another.   Record of DOCUMENTED charitable giving is another.

    For Belgian beers, look at B-delicious, and Belgian Beverage Asia - those two - along with http://www.brewberry.co.th/#our-beers represent about 90% of the brands of Belgian beers in Thailand. I 'm not sure why Brewberry is missing from the BBG website.

    Your comment is interesting, given that the original Whitepaper that outlined the Bitcoin concept was only published in November 2008, and the Genesis block of the Bitcoin blockchain was mined in January 2009.

    As to not being able to sponsor a foreigner WP, that is solely down to the decision of your local Labour office.  A sole proprietorship can legally employ a foreigner (in a qualifying role).  But your local Labour office might disagree...

    As of about 2012 (?), Labor Department changed the rules, and a business without registered share capital cannot sponsor a work permit.  Period.  A sole propreitoship has no registered capital.

     

    A sole proprietorship can sponsor labor-type employment for migrant workers (from Laos, Cambodia, or Myanmar), but not for "normal" foreigners.

     

    Foreigners who themselves had a work permit as THE sole proprietor, from the "old days" (as far as I know, they were all Americans, with Amity Treaty registrations), were "grandfathered in" - but no new such registrations have been issued for a least ten years.

    If your company will handle inbound international travel, the bond amount rises to 100,000 baht.  There is also a license fee of 500 baht.

     

    If your company will handle outbound international travel, the bond amount rises to 200,000 baht.  There is also a license fee of 500 baht.

     

    You deposit only one bond amount – whichever is the highest amount that applies to any of your company’s activities.

    You do realize that a  Thai sole proprietorship cannot sponsor a foreigner for a work permit - right?

  10. To the OP - if the prosecution is for operating a business as a foreigner in violation of the FBA, it would be a violation of Section 8, and the penalties would be as shown in Section 37 at http://www.thailawforum.com/database1/foreign3.html.

    But - I am astounded to hear of a case being prosecuted - and actually reaching court. To my knowledge, there have only been two prosecutions - EVER:

    1. Against Shin Corporation

    2. Against DTAC

    Both of these prosecutions were because of threats to National Security - in that both controlled mobile phone networks, and Shin Corporation controlled Thailand's only two satellites in space.

    To put in frankly, I find it hard to believe that any such case involving a small business could possibly be prosecuted without such a prosecution making the front page of every newspaper in Thailand - and probably Asia - and causing every foreign chamber of commerce in Thailand to go absolutely ballistic.

    Are you SURE that there is actually a court summons, with charge sheet attached? If so - have you contacted your home country's embassy in Thailand?

    Or - are you possibly being prosecuted for violation of the Land Act - for purchasing land USING a company whose Thai shareholders did actually pay for their shares? In that case, you are not being prosecuted under the FBA - you are being prosecuted under the Land Act - and to get out of prosecution, you just need to arrange to have a Thai citizen of Thai company own the land - and you can own the structure on the land, and use the land under a usafruct agreement - see details under Section 1417 of the Civil and Commercial Code of Thailand at https://www.samuiforsale.com/law-texts/thailand-civil-code-part-3.html.

    It is my understanding that the lowest Thai official who can approve a prosecution under the FBA is the Prime Minister of Thailand himself. And - that is never going to happen, except in cases involving national security, or billions of baht in profit.

    Also, in order to prosecute you, every Thai involved in the process - the Thai shareholders, any Thai directors, the lawyer who helped you set up the company - would simultaneously be prosecuted under Section 36 - and that would make HUGE news.

    This report fails my "sniff test" for credibility. It is virtually impossible. OP - are you sure this is actually in the Thai justice system? Or is this just about somebody threatening you, taking advantage of your ignorance? I've been dealing with the FBA continually for 14 years - including being involved with criminal cases involving theft of shares, and criminal misconduct by directors - and I cannot imagine an FBA prosecution being initiated without my legal network hearing about it.

    Finally - except when national security is involved - prosecution under the FBA will never be initiated by the government - it will always be initiated by a complaint by an injured party. Who is the party who initiated a complaint against you? In each and every criminal case related to business law in which I have been involved, none of them - ZERO - ever reached a courtroom. In every case, a settlement was reached, and the injured party dropped the charges.

  11. I don't like Cruz, but I actually felt sad for him, watching him try to justify his likely path to the party nomination: (paraphrasing) "No one has ever won the Republican nomination without winning one of the first four state primaries, and only two of us have accomplished that."

    Well Ted, no one has gone forward to the nomination without finishing above third place in at least two of the first four primaries, either.

    For everyone clamoring for several candidates to drop out, because they don't have a chance - that is unlikely to happen, because the four remaining "also rans" all have ambitions for 2020 or beyond, and their donors and their campaign organizations are all urging them to stay in a hopeless 2016 race, just to give their campaign teams more experience, and more opportunity to work out internal processes, in preparation for another run in 2019/2020.

  12. I'm a 60 year old American. I've watched a good number of US Presidential Elections (12) up close..

    Here are some things to think about:

    1. In the 2012 popular vote (which legally does not matter very much, based on the US Electoral College system), Obama beat Romney by just under 4% - 51.1% to 47.2% https://en.wikipedia.org/wiki/United_States_presidential_election,_2012

    2. In primary elections so far this cycle, Republican voter turnout has consistently set records, while Democratic voter turnout has consistently been lower than in the last couple of election cycles. I'm not going to go look it up - but I will propose that Republican turnout in 2016 has thus far been up 15% from 2012, and Democratic turnout has been down 10% from 2012. IF THIS PATTERN HOLDS for the 2016 general election, and IF ROUTINE PARTY LINE VOTING DOMINATES, then - applying these incremental multipliers times the 2012 election results yields a pretty comfortable victory for the Republican candidate - whoever he is.

    3. Now - in primaries, most voters come out to vote FOR someone. In the November General Election, there is more of a tendency for some voters to go out, hold their noses, and vote for someone that they don't particularly like - so as to vote AGAINST an opposing candidate that they ABSOLUTELY ABHOR.

    4. Despite what the pundits claim, the spectrum right now is roughly:

    Cruz at far right, Rubio at center right, Trump at just right of center, Clinton a bit left of left center, and Sanders out in orbit somewhere.

    All of these people have supporters, and some of them have rabidly animated opponents in either the opposite camp, or even their own party.

    No Cruz supporters will EVER vote for Hillary. No Hillary supporters will EVER vote for Cruz. Many Republicans will NEVER vote for Trump - but I have not heard of any of these anti-Trump Republican voters who will defect to Clinton, if she is the Democratic nominee. They may stay home on election day, but they won't defect. I HAVE heard of a significant number of Democratic voters who will never vote for Clinton, have no use for Sanders, and have climbed on board the Trump bandwagon.

    I haven't got a clue who Sanders' supporters will gravitate to, when he is pushed out by the corrupt Democrat Party process (if you want to see what I mean, take a look at http://www.realclearpolitics.com/epolls/2016/president/democratic_vote_count.html and then at http://www.realclearpolitics.com/epolls/2016/president/democratic_delegate_count.html) . My guess is - after Sanders gets destroyed by that corrupt process, at least half of a VERY large population of Sanders supporters will refuse to support Clinton - and they will either stay home, or vote for the Republican candidate. Now (important question) - which Republican candidate would 3,000,000 anti-Clinton, former Sanders supporters be most likely to be willing to vote for? My guess is: Trump could pull in 90% of these, Rubio might pull in 50%, and Cruz might (if he;'s lucky) bring in 15%.

    If Cruz is eliminated, initially, 70% of his supporters will stay home. 25% might go to Rubio, 5% to Trump. But - if Cinton is the Democratic candidate, half the initial stay-at-homes will go vote for whoever is the Republican candidate - just to block Clinton.

    If Rubio is eliminated. 30% will initially stay home, 20% might go to Cruz, 20% might go to Trump, 30% might go to Clinton.

    If Trump is eliminated, 20% might go to Cruz, 20% might go to Rubio, 30% will vote third party, 30% will stay home

    5. Remember something about all polls you read now: The pollsters are not paying much attention to voters who are not "for" anybody, but who would be motivated to go out and vote ":against" someone, regardless of who the opponent is. A fairly large population of both Democrats and Republicans will actively vote for ANYBODY to keep Clinton from becoming President. There is also a significant population from both parties who strongly oppose Trump - but of these, I think that not may will vote for Clinton, if she is the opponent. They will either vote third party, or stay home.

    6. All things considered, I suspect that the November election will be between Trump and Clinton - and Trump will win. That would normally scare me - but seeing as how the country managed to survive eight years of Obama with only 50% of its national power/morale/prosperity/respect/economy/freedom destroyed, it can surely survive Trump clumsily trying to get the train-wreck back on the rails.

  14. After seven years of no annual financial reports being filed, the company is liable to have been declared "defunct". You can check by going to http://www.dbd.go.th/Applications/cds/ and search the company name. Do NOT try to use the "Exactly" search function - that does not work. Use the "Begin With" function - enter the frist eight letters of company name in BLOCK LETTERS, and then search through the displayed choices. If the "Status" column shows "Defunct", then the company is not recoverable.

  15. This thread is full of incorrect information, provided by ignorant people who do not know what they are talking about.

    To be a Thai Notary Public, a Thai lawyer needs to specifically apply for and obtain registration as a Notary Public Attorney.

    I am attaching an image of such a regsitration, and also an image of a Thai notary seal. If a Thai lawyer does not have such a registration, and does not have the seal, then they cannot provide notarial services. The vast majority of Thai attorneys are not registered as Notary Public Attormeys.

    I have provided correct informatiom, as of 2015.
