  1. We knew before we came to Australia I was going to get sponsored and my wife was supposed to be included. All documents were in the migration agent's hands 8 weeks before visa expiry and she assured all was fine.

I knew she had a no further stay as I had applied for her visa in Thailand but didn't question her.

The migration agent stuffed up. She only found out about the clause when the system rejected my wife's application. Called us Friday afternoon had to be out by Sunday. You can imagine the drama that followed lol

Nothing much I can do about it but thanks for taking the time to reply.

  2. Did you speak to your agent about getting a waiver on the 8503 condition?

Anyway, there's nothing to stop your wife applying for another tourist visa.

Hi will thanks for your reply.

What grounds you reckon I can argue?

The migration agent was very apologetic about the whole incident and even returned the fees paid to her to my sponsor, for the distress caused. However, she seems certain that my wife will have to wait until the sponsorship visa is granted. She said there's not much she can do except to inform the department of our situation so they maybe speed up the process. But she didn't sound too optimistic.

I asked here about getting my wife a new visitor visa buy but she said if granted, it will still have the no further stay clause and she would still have to exit and enter Australia later on.

I'm going to Thailand over new year and coming back in January. And I want to try everything so I bring my wife back with me.

  3. Hi all, back on here looking for some insight.

I'm currently in Australia waiting for my 457 sponsorship visa to be processed. I was here on a visitor visa which automatically switched to a bridging visa.

My wife (Thai) was here with me but the migration agent missed the no further stay clause on her visa so she had to unexpectedly return to Thailand (2 days notice) so not to be on overstay and for her to be able to be part of my sponsored application as a spouse.

I have proved that I am in financial difficulties so I'm being allowed to work on my bridging visa but my wife has to wait for the visa to be granted until she can come back. This might take up to 3 months so you can imagine my wife's distress at being away so long from me.

Would she be able to apply for a visitor visa so she could come until the visa is granted?

    Hope my post makes sense.

    Thanks

  4. Last October a 2 young German tourists were stung by a box jellyfish.  Sadly, one of them didn't make it.

iirc they had gone swimming evening or night time which obviously  makes seeing the jellyfish near impossible.

  5. Good to know. thank you sir for your contribution. Much appreciated!

Without going into detail, I'm leaving because of certain decisions made by the owners regarding management personnel.  Which in my view were totally unacceptable and made me doubt my own job security.

  6. Hi guys,

I’m going to the Labour Office to check tomorrow but I thought I’d start a topic here to see what other people think and writing also helps vent the frustration.

I’ve been employed by the same company 1 year 5 months as a (per work permit) head chef – to maintain standard of quality for food preparation and cooking.

It was a given from day one (although on my contract states – the normal working hours shall be 9 hours a day) that I would not be compensated for overtime which I was fine with..

The then GM informed us (all heads of departments) (verbally) that since we would be scheduled once a week to work as a Manager on Duty, each time we did we would be entitled 3 hours as overtime.  So every 3 times you get a day off in lieu.  I accumulated 16 days of such days off in lieu which I used earlier this year (forms signed and approved by HR and GM).

Last month I gave them my notice and my last working day is on the 20th this month.  Today I asked HR to clear all my pending days off, public holidays and vacations.  They went in detail through the time logs and informed me that since sometimes I took a 2 hour break on the days I was duty manager, I was not entitled to OT and so they will be deducting the days used from my other accrued holiday days.  Seriously??  Each time regardless of the break or no, hours worked were 12+

I just called a lawyer now to check and she told me that if I wanted to I can even ask for all the extra hours worked each and every day since day 1, which I don't want.  I only want what was promised to me and now appears to be retracted.

I’m off to the Labour office first thing in the morning to see what rights I have.

    Rant over

  7. http://www.thaiworkpermit.com/thai-work-permit-process.html

Oh ok. i was confused cause I had read on here that the work permit will be valid as long as your visa is valid, as in your passport.  So I assumed that it will be invalid since the visa is expired. Good to know.

regarding immigration, apparently the new boss of Samui immigration is a very strict by the book guy... Or so I heard.

    cheers for your help!

  8. Thanks Ubonjoe for your swift response as usual.

So he has to go to Sri Lanka and start again from scratch. Get a new non b, come back Thailand and apply again for a work permit. After wp issued he will apply for one year extension. Correct?

Nothing nobody can do now from immigration as the visa has expired and he is on overstay.

  9. Hi I'm after some information. Me (Maltese) and my wife (Thai) wish to go for a month's holiday to Australia at the end of August. Main reason is to visit my wife's sister and family in Perth. We also would travel to Sydney to see some friends there.  My visa is no problem as I qualify for an e visa.  My wife needs a visitor visa 600.

last November we have already been to Australia basically for the same reasons and my wife's application was accepted first time round. We had an invitation letter from her sister and husband and copies of their ID cards, photos etc. Will we need these documents again this time round?  I will be fully supporting my wife financially as she's a housewife so do we really need all her sisters documents??

Also my wife's bank book hasn't been used since last year as I'm the sole working partner and we use all my accounts for everything. Will this be a problem?

Last time we applied by post but vfs told me we have to go in person for my wife's biometrics so I want to go to Bangkok asap and get the application filed because we life on Samui.

if I take these documents will they be enough?

    1419 application form

657 migration assistance form as an exempt person

    2 photos (wife)

    passport

letter from me stating I support her financially fully

    marriage certificate

    my work contract

    last 6 month payslips

    copy of my bankbook

    house rental contract

    car motorbike ownership papers

have I covered everything? If my sister in law's letter etc are not needed we could fly to Bangkok tomorrow.  Otherwise I have to wait a week or so until the papers arrive by mail from Australia and I worry timeframe for visa issued will be tight.

sorry for the winded post, any input is much appreciated

  10. Hi guys, would appreciate your input. I am asking this for my boss.  This is concerning Samui immigration.

    facts:

He had a non imm B issued for 3 months from his country - Sri Lanka .

    He got his work permit.

visa was expiring on 28th July so our hr manager went to Samui immigration to apply for an extension on the 25th of July.

immigration asked for business operating license to do the extension which was unavailable for reasons unknown to me. (well I suspect some paperwork is not in order but none of my concern)

anyway hr manager said he wasn't offered any alternative for example 1 week extension or anything until the best course of action is decided ( which I find funny).

the result is he's now on overstay and I read that his work permit will now be invalid and he has to start the whole process. Is this correct?

Can he get a new non b from any other country than Sri Lanka?

Where should he pay his overstay fines?

what a muddle - all because of trust put in an incompetent human resources offices.

this is the reason why I take my visa things so seriously and insist on doing all things myself.

any comments on his best course of actions are much appreciated as time is of the essence.

  11. me again ubonjoe,

My friend's work permit is valid for 2 years (one year more) but his extension ends on june 8 this year - someone told him he could use the same work permit and only change the company and address of new workplace. is this really possible?

or would you still advise the process discussed above as the best option.

    - cancel his extension in samui before termination date so it will be post dated

    - fly to phuket before termination date armed with all new paperwork apply for new extension

    - once granted apply for new work permit.

sorry for the many questions - not as clear cut as it seems!

he holds an egyptian passport (if it makes any difference)

  12. one last question - he is now based in Samui and got the extension and current WP from here.

He will be based in Phuket from June so i presume he would take all paperwork to immigration in Phuket directly.

    Correct?

Also should he apply for everything before he goes out on holiday from Thailand or after he comes? is there a certain number of days he has to have left on the extension?

    Thanks once again

  13. Thanks Ubonjoe for your quick reply.

i don't know if it makes any difference - my friend holds a managerial position (resort manager) and he is leaving current property with the blessing of the current employer. i'm sure i read somewhere here on thaivisa that if they liaise together (old employer and new employer) he would not have to go out and get a new non b visa only change work permit. maybe i did not understand this correctly?

if this is not possible what if he does not cancel his work permit and stays until may? then when he goes home gets a single entry tourist visa to come back thailand in june - apply for the new work permit and goes out to Malaysia to get a new non b?

    Does this make sense?

    Thanks once again

  14. Hi all,

I'm asking a question for a friend who's currently on an extension of a non b visa which expires 8th June 2016

He will be leaving his current company end of March and start a new job beginning of June - confirmed.

He needs to go for a holiday back to his home around 10th May and be back before the extension expires.

What's the best course for him to take? If he cancels his work permit end of March, he would have to leave within 7 days no?

Thank you for any helpful insight guys.

  15. Look out for the ++ or net after the price indicated. ++ means plus 10% s.c. And 7% vat. Net is what u see is what u pay.

Working in the industry I just add 17% to the selling price and display the final price on our menus. Gets most people's back up if you add it to the bill in the end and rightly so in my opinion

  16. Boredom isn't an issue for me that's for sure :) even tho I work long hours I find work rewarding both financially and most importantly mentally. I spent 10 months in Nakhon Nowhere without work and was going crazy (was drinking way more then) and ready to throw in the towel and trudge back home with my tail between my legs, but with sheer determination and forwarding hundreds of cvs from a small Internet shop (no 3G coverage where I was - 8 km to the nearest web connectivity) I struck gold one week before the ultimatum I had given myself to buy the ticket back home.

Keeping a healthy lifestyle isn't as easy as it sounds - way easier to sit back and get fat but as I said I've already tasted the feeling once you start looking at the mirror and see the blubber fade away - it's willpower at the end of the day and a kick up the ass.

Just think one year from now if you achieve your goals and look back at this Christmas how you'll feel.

    Best of luck!

  17. First of all chin up mate :) you can do this if you really want to.

This thread has resonated with me even tho my situation is a little bit different.

I'm also in my early thirties and I work 12 hour (min) days here. After work I have been religiously drinking 3 big changs a day. Eat then sleep. Worst thing regarding weight gain. I'm overweight by about 20 kg as well.

Make a new year resolution as I am going to make and stick with it. Drink once a week, clean up my diet and train at a gym 3 times a week. I've been here before and beat the vicious cycle (lost 30 kg in the process) but a car accident and complacency put the weight back on.

I've been wanting to start again these past few months as more people are commenting on my weight gain, I run out of breath easily and have started taking medication for high blood pressure (runs in the family).

My excuse is that I'm working too hard, don't have time for a 45 min training session and that the beer is well deserved after a hard day at work.

    ALL EXCUSES.

It's not easy but I swore to myself that 2016 will kick my ass back into action. It will be difficult for the first couple of weeks then it will get better.

There's nothing more rewarding than going out clothes shopping and not have people raise eyebrows when you ask for a 44 inch waist jeans.

Best of luck to you and shame you aren't on samui as it would have been great to hook up, slap each other's faces and wake the hell up.

When I read that 77 year olds are keeping fit, I feel ashamed and so i should be,

All the best to everyone reading this for New Years! God bless!
