If your 'friend' attempts to enter Thailand with a new passport in a different name and he does get caught, then he will be arrested most surely for attempting to enter Thailand whilst blacklisted using a fake passport. I think you will find that if death is a direct consequence of an illegal and violent assault, then they are guilty of murder.
