    They also say members can apply for a 1 year extension of stay. Try doing that at the end of year 5!


    Not trying to argue with anyone here. On personal experience, when we tried the 1 year extension at the end of the 5th year, the IOs said they were very sorry but to get 1 year extension it could only be done by leaving and re-entering the country before the visa expired, assuring us it was perfectly legal. So he did just that and got his 1 year extra.

    Now, things can change fast and as I said before I'll go to immigration this week and will ask for clarification.

  2. Hi everyone,

     

    I open this thread to gather all source of information concerning the issues (or non issues) regarding the "bonus year" from Elite visa.

     

    As we now know, things may be more complicated that they seemed at first. Elite is putting pressure for members not to go beyond the original 5 years and threatened that they contacted immigration to let them know of potential violations.

     

    The fact that immigration let the members come in with 1 year permit and that now these people can face legal issues, including a 1 year ban is scary to say the least. In our case, we were suggested by CW IOs to do it as it was entitled.

     

    If anyone in this situation gets any updates, do their 90 days report from now on, re entry permits, leave or come back to Thailand, please feel free to share it here so that it can help others as to where things stand.

     

    I hope we can gather a lot of useful information as we are in uncharted territories. This thread is not to open debates and insult each others but to gather concrete facts that will be helpful to people.

     

    I will go to CW myself next week to ask IOs about the situation and will report back here what information I get.

  3. Update:

    So I went to immigration today to file a TM30 and try to get a re-entry permit.
    TM30 went fine after 3 hours in queue (as expected).

    Then it was time to try for a re-entry permit, it was refused by split decision. One officer say ok, can do. But two of them said cannot. So in the end I did not get a re-entry permit.
    Will try it again in the airport next time I leave. Will update this tread when I do. Although I am not sure when that will be, stay tuned.

    Just to clarify, they didn't question the validity of your stay permit right? As it is uncharted territories, any info can be helpful.

  4. He is actually on elite visa but the elite team told him he has to do tm30 and tm28 before so that's why he didn't bother them to help on the matter. He is staying in a house rented to a Thai owner who lives abroad and doesn't want to bother with TM30 requirements nor send the tabien baan or chanote as it is "inconvenient". He actually really wants to stay within the line but it is a bit complicated at the moment. He also has some personal obligations at the moment that keep him from being absent too long. Anyway, the problem was solved for now

  5. Just a quick update that might be helpful to some of you:

    On my advice, I helped him coordinate my usual messenger (motorbike driver I use often for my bf's immigration affairs and my personal business).

    He came to pick up his passport with 90 days report form in the morning. By 1pm he came back with the 90 days report all done, no questions asked to him at immigration.

    I don't know if he was lucky or if they just did it as they know the Thai driver was unable to fill the tm30 paperwork for my friend and pay a fine, or if it's just not needed when doing 90 days report?

    In any case, all has been done easily and he is relieved. Hope that helps some of you!

  6. There are two scenarios. 
     
    1. You report late the fine is set at 2,000 baht. 
     
    2. You are caught having missed a report the fine is 4,000 baht, In this case immigration will also charge you 200 baht from the day you are arrested until the day the 4K fine is paid.


    That is what I read on Thai websites as well, so I'll assume that is the rule.

    4Question : What is the punishment in case of late/not notifying of residence every 90 days ?
        Answer : -In case notifying in person, the alien will be punished with a fine of 2,000 Bath.
                  -  In case of  being arrested for not notifying on the due date, the fine is 4,000 Bath and with an additional fine of 200 Bath for each day which passes until the law is complied with.


    Thank you for the info. From what I understand, it means that you'll be fined 200 baht per day starting from the moment you are arrested if you don't pay on the spot? Like elviajero mentioned? The wording is a bit confusing for me

  8. Thank you very much elviajero and all others for your precious information. If only a fine can be issued by missing out the deadline, it should not pose him any problem. Hopefully it will be 2000 baht and not more.

  9. Hi all,

     

    I have a question regarding a foreigner I know and who is considering being late on his 90 report.

     

    He has never done a TM30 and knows he'll probably have to to do it this time.

     

    He also changed his address a few month back and didn't do his TM28. To do his TM30, he guesses he'll have to do TM28 as well.

     

    All things considered, he thinks it will take him a long time at CW to get everything done and he is really busy at the moment.

     

    He considers doing it all together sometime next month or so.

     

    Aside from the 2000 baht fine, would being late on his 90 report give him more troubles with local authorities in the future visa wise?

     

    His exemption of stay expires mid of next year.

     

    Any helpful answer would be greatly appreciated!

  10. You say London, which airport?
    Invitatation to Fast Track is by invitation only and invitations are handed to eligible passengers by the carriers who buy them from the airport authority. Non UKBF staff direct those with invitations to the appropriate fast track lane, if your carrier doesn't give you one, you cannot access the lane, even with a Business Class ticket.
    I travelled with Thai into London last month in J Class as was given an invitation, though the invitation advised me that UK Nationals shouldn't use fast track but go through the EU Lane, I nevertheless went through the fast track and was through in minutes without a problem, likewise my Thai wife and I travelled in J a couple of months previously, were both given fast track invitations and through in moments.
    As for flying into Paris in Business five years ago, it depends if your carrier gave you an invitation, no invitation no fast track, though I'm not sure there if is a fast track in Paris.


    I understand all you say, my family flew business with Thai airways into LHR. They just had to go through non EU lane it took them over 2 hours. I am not debating that there is a fast track, they just didn't get it somehow. Maybe the fact that your wife is married to you helped, I honestly don't know. I'm just happy she got through fast.

    Also, my point was to say that non EU lanes in Europe can be as long as in Bkk.

  11. When they arrived in London and showed their tickets they were told to go in the non EU line (I don't know the exact name of the line as I wasn't there. They asked if they had a fast track because of business class but the lady said unfortunately no. Maybe not for some countries I guess? They said the queue was long but it took really long because it took a while for each passenger to get through IOs.

    I landed in Paris 5 years ago in business class and same thing, when looked at my passport and ticket they just directed me to the lane for non EU or something and I waited over 2 hours to pass.

    It's not that easy for Thais to travel to western countries. But I share everyone's frustration for Bkk immigration, they should have more staff considering the amount of foreigners coming through.

  12. I agree that Thai immigration at airports is a problem. I often pity foreigners who have to stay on these long lines.

    However, my family (Thai) recently travelled to London in business class. At British immigration, it took them over 2 hours to pass with no fast track. The IO told them it's not uncommon for non westerners to wait this long as they have to do more background checks.

    All things considered, Bkk immigration is not working at its best but neither are all other countries (found myself in this situation in Europe a few times waiting 2 hours + in the past).

  13. I'll let you know.  I did my first ever TM30 report in 14 years of living here and mailed it to CW last week.  I am waiting to see what I get back!

  14. I have one more question:

    If someone never did the TM30 application and decides to do it now by mail (with all proper documentation), is it going to be approved or is there going to be complications considering it was never done before? Could they deny it and ask to pay fines?

  15. Just a quick update:

    My boyfriend went to help his friend who has Elite visa as well to do yearly extension at CW.

    They did it without any queue number and there was no mention of TM30 at all. His friend lost his TM6 and forgot his Elite card but still they extended his visa and were very kind in the process according to my boyfriend.

    He also went to help him for his 90 report, they went to the counter on the left at the end of the room of section A without a queue and the lady proceeded in a few minutes. No mention of TM30 once again.

    They may have gotten lucky but it turned out much better than they expected!

    They said the staff overall were very polite and helpful.

    Hope this helps people going to immigration in the future for the same matters.
