It is all done in one visit to the local work permit office. Some offices will cancel the work permit and give it back to you while others will keep it.

You can just leave the country if you have a termination letter or go to immigration a few days before the date of termination and they will post date the cancellation to that date.

You don't have to cancel the work permit before leaving the country unless you plan getting another work permit.

The work permit cancellation rules are in a ministerial order that is not posted anywhere in a public domain that I am aware of.

I'm so grateful to you for all replies!

You or your employer can cancel the work permit prior to your termination date by submitting a work permit cancelation form.

Also, could you send me actual link to the law, which states that I can do it by myself, because my stubborn employer doesn't want to give me a letter and says that it's illegal doing it by myself...I shown him the cancellation forms from site, he said it's wrong.

Thank you so much! So, and where does the blue book go after? I don't have to come back there to collect papers (if any )? I'll definitely do it by myself since my employer seems very unwilling doing anything for that and moreover, they are trying to find an excuse to not giving me that letter...and, my nonb visa will be cancelled as well. So, I won't have an overstay, if immigration office will cancel my visa by 19th and I'll leave a country the same day(early  in the morning)

  4. Good morning! Can anyone please, tell me about wp cancellation process? I'll have a termination letter from employer with last day of my work 19 of Feb. However, I 'll not be here at this date, because I'm going to get tourist visa in Laos, and van goes on Sunday, 18th. The question is : can I cancel my wp in advance, on Friday? Will I need to return to the ministry of Labor to collect anything? Just don't know how the process goes. Thank you

I am a little surprised, especially as @ubonjoe (usually very reliable) indicated that the initial 90-day entry on the Non B would be treated normally (i.e. not canceled when your employment terminated). Are you sure immigration was aware, when you asked, that you are on the initial 90-day stay and not an extension of stay on the basis of working?

In the end, it will depend on the immigration office what happens if your employer shows them a termination letter. If immigration decides your permission to stay should be canceled, you had better attend as otherwise you will be faced with a backdated cancellation and overstay.

I shown that visa to the officer and he said that it will be cancelled. I'm confused a bit too. But, if it's possible to cancel nonb in advance, I'll do it and leave a country for a few days

Is it possible to apply for an extension at Imm', be refused and given 7 days to leave.

    1900 baht for that.

    Asking, not stating BTW.

One day overstay there is no fine. They may put a stamp saying one day but that doesn't cause any future problems.

Thanks! Oh, I don't know for a fact, but is it possible to bring the cancellation letter to immigration in advance? I heard that officers will stamp passport with the date of termination

Don't understand that about Imm' telling you to leave unless they are assuming you are on an extension of stay which you're not, you're on a visa.

Did your school tell you that's what Imm' said or did you ask Imm' yourself?

I've been at the immigration office, they told me that this visa will be cancelled since there is a name of school, provided this. My employer said the same. They need my presence. Only thing I concerned about is timing. Because if visa cancelled on 19th, and I will cross the border next morning, will it be overstay?

@ubonjoe Does the fact that this appears to be in immigration issued non-B (issued inside Thailand) have any bearing?

Thanks for commenting! Just updated with my employer. They are going to cancel my wp, since it has a name of the school on it. Now new question: how many hours I have to leave a country once it cancelled? Immigration officer told it depends on how I leave it. That's all they told.(((. So, if I have 24 hours, does it mean that if  I get my visa cancelled at 11 am. on 19th, Feb., I might enter another country (Laos) at 6 am on 20th? Or it would be too late?

  9. Good morning all! Still trying to figure out timing for leaving my job and not getting overstay. I'd hate to get it because going to apply for US visa next year and don't want to have any notes about any overstay. So, my situation is like that:

    1. Changing my job , resigning from a small tutoring school and getting ready to work in a gov. school. Gave the notification to my current employer in advance (30 days).

    2. Have a WP and nonb(which is 3 month - issued on 8 of Dec,2017, expires on 7th of March.). WP issued for a year on 17th of Dec.

    3. When my current employer received my resignation letter, he probably was pissed off and gave me threads that he will report about me to the education ministry and I might have problems in the future if apply for new job. But, this is not going to happen because I didn't break the law or school rules.

    4. In the beginning of the week employer told that they will cancel my visa and wp. In the end, they told that only wp will be cancelled and visa remains valid till March and I can stay in Thailand.

The problem is: I don't trust my current employer . That's why I need to know for a sure. Might it be an overstay if I cancel my wp on 18th of Feb and leave a country later, on 25th to apply for new non b abroad? Or I should take termination letter to the immigration and cancel that visa in advance? Also, I want to enter Laos by land. If it happen in the early morning of 19th of Feb, will it be overstay since my wp probably will be cancelled on 18th?. Thanks in advance! Hope, my description is not messy

Your visa will remain valid until it expires.

Your current work permit will have to be canceled and a new one issued. Work permits cannot be transferred.

And what about nonb itself? Does it expires automatically once you cross the border or i should go to the immigration office before my departure and cancel it in advance? I have similar situation and trying to figure out what to do with my nonb , because I want to go to Laos in order to obtain new one. Don't want any problems due to cancelled improperly visa and wp

  11. Good morning everyone!

Just came to work and my current employer told me "I hope you won't have any complications with new job, because we are going to write a letter for ministry of Education about the reasons, why are you going to leave our company"....I'm lost and so stressed out right now. What games are they playing with me? I never been late at work, always did my job in time (I'm a teacher of english). Are they trying to keep me at their place or what? Help me please....I really don't know what to do

You cannot apply for another non-b visa within the country since you already have one.

You can apply for a one year extension of the 90 day permit to stay you got from the visa. To apply for the extension requires supporting documents from your employer and a valid work permit.

Do you already have a work permit from your current employer?

Is your current employer that supported your non-b visa application mentioned on the visa sticker?

I have wp from my current employer , also 90 days nonb. Yes, the name of the school is written in visa. I wonder is it possible to collect all the documents for new non b(letter of approval from the Labor Department and other parties) and apply for it abroad? Hope, Ministry of education and labor departments won't reject the request from my new work place. Thank you

If your non-b visa shows the school that supported your application you will have a problem getting an extension and possibley the work permit application done. If you leave the current job on a friendly basis immigration may accept a letter from them allowing you to get an extension.

In order for you get another work permit for the new school your existing one will need to be canceled.

In the long run it may be best to resign from your current school and then with supporting documents from the new school to go out for a new non-b visa.

Thank you for reply! I wonder now about visa. Where should I be meanwhile? For example, I resign on 6 th of Feb, my visa expires on 7th of March. A lot of people told that if I have 90 days visa, then employer can't cancel it.

  14. Hi all! I started my work at private small school in December, 2017, but sooner found better offer and conditions of work. Want to resign and change the employer. I have a single entry non b visa(not extension to stay), valid through 12.8.17-03.08.18. Also, work permit. The question is, how to change the employer without big expenses and stress? Just obtaining new wp from new school and apply for extension to stay afterwards? Thank you.
