  1. Referring to my experience, DO NOT USE UPS THAILAND.

Your cargo will be hold at the custom and they will charge you more with broken information.

If you want to know how they would handle yours, google "UPS Thailand" and read reviews (1.9 start amongst 123 reviews). I shipped mine via UPS and I got same experience with them stated in their reviews. It is my regret that I did not read their reviews beforehand.

Useless to file your complaint afterwards.

I did for their improvement but the reality was that CS team is also in same team with brokerage import team.

Option one is possible, been using that for 15 years now here on Phuket.

Sorry, correction, my wife has a sole proprietorship.

Did you obtain WP under your wife's sole properitorship without any partnership?

I heard from associates that it is not eligible to apply the WP under sole proprietorship (even my wife is Thai nationality). Your kind advice will be greatly appreciated!

Only with a registered partner ship since their would be no registered capital with the other.

All you need is the 1 million required for the work permit.

    Hi Ubonjoe.

You are so knowledgeable in terms of visa and WP, please allow me to bother you some.

Myself, Korean nationality, I was thinking of opening up a ordinary partnership with my Thai wife (non-register), but I am seeing your comment saying that I might not be eligible to obtain WP under non-register ordinary partnership as its form is not required for 1M capital.

However, I am seeing a lot of postings that people who have Thai spouse but runs business with their WP. Could you advise what sort of form that I will have to consider to open? My business is a small Korean restaurant and I opt save as much taxation as I can by avoding from "company (juristic person)".

Thank you so much in advance

The Revenue Dept doesn't like this type of structure as it is used by highly paid individuals to reduce tax liability by setting up spurious partnerships. They have already stopped doctors from doing this and the structure may be phased out completely in future. For those who can't easily hide their income, like doctors, the structure is only good for reducing tax liability for a fairly narrow range of situations. However, it is quite effective for small cash businesses that have the ability to declare only a small proportion of their revenue for VAT and income tax. They can avoid a lot of the burdensome paperwork involved with a limited company or a registered partnership because they can opt not to file audited tax accounts and be taxed based on a flat rate of deductions set by the RD for each type of business. Thus an unregistered partnership that operates a restaurant business and reports revenues of B1 million in a year will be tax on profits of B700k, as the RD will allow deductions for expenses of 30%. Of course the costs of restaurants are much more than 30% but, if the partnership has only reported, say 20%, of its actual revenues, this is not a problem and a huge amount of income tax and VAT has been saved as well as the cost and trouble of keeping proper accounts. Most unregistered partnerships fall into this category, which is another reason why the RD wants to phase them out. Apart from facilitated outright tax evasion, unregistered partnerships, which are taxed like personal income, allow partners to have full personal tax allowances for each partnership and they can set up multiple partnerships to avoid ever getting into the higher progressive rates of personal income tax.

I think that Immigration and the Labour Ministry don't accept the concept of a passive partners. Therefore they assume that foreign partners are working and require a work permit which they are reluctant to provide, due to the nebulous nature and lack of formal documentation of the unregistered partnership structure, even though it is not prohibited. Apart from the unlimited liability risk mentioned by Sunbelt there can be huge difficulties in unwinding partnerships when one of the partners wants to get out or dies. The structure is best left to small Thai family business operators who can keep under the RD's radar.

I don't know if you will be able to read my query or not. I am going to open up a small Korean restaurant with my Thai wife. As I heard from many postings that foreigner married to Thai spouse can operate a restaurant business like sole proprietorship, I have searched over internet and assumed now it is a form of "un-registered ordinary partnership"-with my Thai spouse.

Is it possible to apply WP for myself under non-register ordinary partnership? And what is condition to obtain?

Thank you very much in advance

  5. There are some cases to open up a company with Thai wife and make less hustle in obtaining WP for foreign husband.

    - 2M Baht capital Company limited and hiring 4 Thai employee with full SSO payment,

    - Ordinary Partnership company with Thai wife (juristic person or non-juristic person),

    - Limited Partnership company with Thai wife.

Juristic person must be registered in V.A.T and will have to rely on professional account service on regular basis which might not be suitable for small merchant or startup. So I am seeking for cheaper costing form such like sole proprietorship under my Thai wife name but grants me to work legally in Thailand.

Having seeing other posts saying that sole proprietorship under Tha wife is possible to grant WP, I did some research over internet then I found it is likely formed as an ordinary partnership (non-juristic person). Has anybody opened a company with your Thai wife and granted WP? I assumed ordinary partnership (non-juristic person) is a sole proprietorship which many others are saying about.

    - I wonder whether I will have to go for the agent for business registration (assuming sole proprietorship) or register in DBD by ourselves,

    - Does it require 1M capital? I am still confusing as we are going to form a non-juristic person so capital requirement is still critical matter or not,

    - I checked with a couple of departments of labour in Bangkok and I got different answers from different branches i.e. sole proprietorship is not possible to issue WP, 2 Thai nationality must be registered in SSO, or some said 4. I really confused which is correct information and whom I should consult with,

    - If anybody already run your business with Thai wife in a form of ordinary partnership (non-juristic person), how do you deal with account matter?

Whilst seeking for your advice and suggestion, I'd to express appreciation to all of great posters sharing your exclusive experience and knowledge.

south korea no longer provides the non-o multiple based on spouse as of about a year ago. i went there 2 visas ago and was planning on going this last time, but i emailed them to confirm no-finances was still the case and they responded saying they no longer can provide the multiple entry, only single.

I also found that I am only eligible to apply for multi entry visa at Thai embassy in Seoul (home country only). Regarding proof of finance, I will keep all here updated once I obtain without it successfully.

    Thank you

    Thank you so much

I also checked requirement in the websites of Thai consulates but only Korea and HCM websites don't request for bank statement so I decided to go to HCM for visa obtainment.

It seems the website info. is correct.

    Many thanks!

For me going to Savannakhet is much less hassle and cheaper. I might try HCMC next year, only because my Thai wife is interested to go there.

Yes Vietnam is more interesting than Laos. But you have to pay more obviously.

I checked their e-booking website and the form there will ask you whether you have finance statement or not. If i am wrong, please correct me

  9. I am going to HCM city next week in order to obtain Non-O (Spouse visa) together with my Thai wife. As posted earlier I have prepared all except proof of bank statement (400K for 2 months), however I am still worrying a bit if anything changed recently. Any body has the latest update?

In addition, I wonder whether they will allow only 3 months visa or even it is possible to obtain 1 year visa with the stated documents.

Kind information will be greatly appreciated!
