  2. Hmmm, legally you should file, if you want to play strictly by the rules but not having any tax to pay means your liability is limited to a 2,000 baht fine that doesn't seem to be imposed on anyone.
  3. All my wife's business is conducted electronically, there is no cash involved on the sales side and all purchases are electronic payment. Consequently, there is no opportunity to under report earnings. I keep her books and I wont let her under report, The first time she filed, the Revenue lady juggled the numbers so she she did under report, so I sent her back and made her correct the return at the District office, which was a big deal at the time. Sales of 1,000,000 by a self employed person allow her to deduct 60% of her sales as cost, it's a fixed deduction. That leaves her 400,000 of profit that go to the Personal Income Tax calculation. She deducts 60,000 personal allowance for herself, 30,000 for care of her mother, 80,000 deduction for her RMF fund and 150,000 zero rated for tax, total, 320,000. That leaves taxable income of 80,000 which is taxed at 5% or 4,000 baht.....I said she didn't pay tax....I lied! Her true costs are around 31% of the value of sales or 310,000, leaving after tax profit of 690,000 or 58k a month. I said 65k a month, I lied again, because I used round number for the example. She files a return twice a year, July and January.

  5. Not true! The person has the option to form a company or to work as self employed, the choice is theirs based on whether they are willing to assume full liability or not. My wife advertises a business brand but she isn't a limited company.
  6. There's no costs to register and work as self employed, that's what most people, including my wife do.
  7. IMHO your friend destroyed her own prosperity, not the Revenue people. If she would have bothered to learn about the tax system, she would have understood that she can easily make a good living, without paying tax. My wife is registered for tax as self employed and clears 65k Baht a month on sales of 1 million and legally pays no tax.
  8. Hospitals here are legally allowed to charge non-Thai's in accordance with a table of costs approved by the government, there are four levels, native Thais, ASEAN members,tourists and expats. Each level is charged more but it is at the discretion of the hospital whether they do so or not. Most hospitals in non-tourist areas do not. Having addressed your point, let's get back on track with the topic, which is tax, not dual pricing and not the rights of foreigners..
  9. Tax treaties are different for every country, no two are the same. What happens in South America is not even remotely relevant to what happens in Thailand. Furthermore, a tax treaty does exist between Thailand and the US and for the very last time, it very clearly states that US SSc is taxable only by the US. We know those things to be true because several people, including US CPA's have reviewed those treaties which are explicit and unambiguous. Furthermore, some of us who have filed Thai tax returns here for many years and who also receive US SSc, such as myself, have been instructed by the TRD to exclude that income from our Thai tax returns. This is the end of this exchange, this aspect is closed, unless any future post is accompanied by supportive evidence from an official source (not a blog).

  14. I think you declare 2 mill. in assessable income and invoke the DTA which will give you a tax credit in Thailand.

  16. I'm sure you are correct and that some form of anomaly exists. I don't know anything about AP but I do know it will have to have permission to operate within Thailand borders, that means obtaining permission from BOT as a payments vehicle. AP says this: And when you use Apple Pay with credit, debit, or prepaid cards, Apple doesn't retain any transaction information that can be tied back to you. Your transactions stay between you, the merchant or developer, and your bank or card issuer. So, AP may not keep any record of the transaction but the merchant and the card issuer does because the merchant must be paid and the transaction must be reconciled and settled.

  20. You would assume incorrectly! The Thai Revenue Code states that only those who exceed the minimum assessable income threshold shall file a tax return.
