Hallo ,My wife Belgian 59,I Dutch 65 ,both retired ,visa non imm. o-a, we have build a house ( without building permit ) on land owned by a Thai lady married to a Dutchman.As the house was build in a very small village ( aprox 150 inhab.)there was nood need for a permit,so the lady and Dutchman told us.Head of village - PHUIAI BAN _ sorry iff mispelled , came to look at the site= o.K .

    The lease was signed for 30 years and registerd at the landoffice in Uttaradit.

    The owner of the land , is she also owner of the house ?

    In the blue book her name was mentioned and now she chaged it in the name of her daughter, the lease contract is still in her name ( mother )

    We live in the house now more than 1 year,and in Thailand almost 20 months.

    Can we obtain a " yellow book " and be recognised as owner of the house we build ?

    The house was build by the brother of the Thai lady in question.We payed him all the labour and labourers and have all the bills from first pebble untill last flower.No building contract ,just every 2 weeks the payout in the book and at the end the " contractor" wrote in Thai = finished.

    Please advice what we can do.I know and realise that we will propably need a lawyer but before that I want to investigate iff all can be done in " friendship " without a lawyer or even more.....

    Please explain iff you can what exactly the yellow book means and the " value " of it.

  2. If the lease is genuine then it would seem to me all you need to return to them is the land that you leased once the 30 years are finished. If it is bogus for whatever reason then the same reasoning stands. I have read stories backed up with photographs of new houses being demolished because some greedy local was trying to steal a house. The police came and were powerless to stop it, you own every part of the house, make sure you keep those receipts safe.

    If they try any funny business tell them that in no uncertain terms that if they fail to purchase the house off you at the end of the 30 years you will take it with you when you leave the land and all they will get back will be the empty land that you leased from them.

    If they have registered the ownership in the daughters name it does look like they are preparing for ownership of this house before the thirty years is up, take any steps required to make sure they don't borrow money against the value of this house as you own it and not them, as someone else said you don't own the land but you do own the house, every part of it.

    I would scrutinise the lease documents carefully, I'm not sure how these leases work in Thailand but I have had long term (25 year) commercial leases in Europe before, are they fully paid up for the full thirty years from the beginning or is it more like a western lease where you pay monthly or quarterly with five yearly rent reviews ? If it's the latter you could be in for a surprise at the first review if they try to con you.

    As it's a fellow Dutchman who arranged this for you in the first place - what does he have to say about all of this ?

    My " fellow countryman " replyed : I did worned you before -you knew it- I don't know - she does not know etc.etc.

    Returning the house to us after 30 years ??? My wife will be 89 and I 95 years !!!!! nice he ?

  3. The very first thing you have to find out is if you have a legal land office registered lease. If so, you have the right to live in the house until the lease expires. If the lease is bogus, you could indeed have serious problems.

    The land lease is legal and registerd at the landoffice in Uttaradit.

    But........ yesterday the " landlord " ,Thai lady of Dutchman ,changed the " BLUE BOOK " from her name to her daughters name .Does this means that we have to have a new lease contract with the new owner or.....

    Could it be that the house is registerd on the name of the daughter and that the land is still on the name of the mother ? Wher do we come in the picture ?

    Are we still " the leasers " or ????

  4. Why are you relying on TV to help you, get a good lawyer.

    without a threat and attempt to throw them out, I think there is no lawyer needed. I'd have somebody to take care if this couple can't move in for whatever reason at the moment.

    The owner ( Thai wife of Dutchman ) has given and registerd the blue book on the daughters name !!!

    This happenend yesterday!Is this legal !!! or.................

  5. did you talk with them? I think you have nothing to fear. The land belongs to you for the 30 years, so does the house. You can do with it whatever you want.

    Yes we have the plan to stay here in the house.

    But .... "" you can do whaterever you want"" ???????

    Can we , iff ,I say IFF we want sell the house ???? Whom would be interested in a house ( big ) house in a small village on leased land ????

    Yes it not only confusing but hard to understand how we could have been this blind and not seeing the con things !To good of believe ?? To keen to come to Thailand ????

    But yes we have the contract,yes we are paying for it,yes we built a( large )house and luch garden but NO ,there is no intention ( yet ) to trow us out,but now you mentioning it,yes the potential danger is there.

    To be complete my wife is 59 and I will be this year 65 ( and still stupid,me that is )

  7. Josef - was the lease ever registered with the Land Office? You should have a lease contract covered in stamps and a title deed for the land with your name on the back saying you leased for 30 years.

    If not, then you have a house that was built without any permission on land you haven't legally leased longterm.

    Yes indeed , the land - lease was registerd at the landoffice in Uttaradit.Stating the 30 years lease,price for the 30 years lease,my name,name of my wife and our former adress in The Netherlands.

    The lease have 3 round and 1 square stamp on the front page.

We ar living in a very small village .No need for building permit etc.The blue house book is on the name of the Thai lady-wife Dutchman ,also the lease.The house is build to high European standarts! Dubble glassing,doubble waals with isolation between teh 2 waals,roof tiles etc.etc.

    Can anyone advice PLEASE !!!!

    We live in Amhur Uttaradit,ver,very small village,NO one has ever build with a building permit.In this village ar now 4 newly buld ,by farang , houses.None have asked for a building permit.Question can I request now for this permit on our name ?????

My wife Belgian , I Dutch , we built last year a house on leased land ,lease for 30 years.After long investigation and a lot of wrong answers we finaly have an answer but is this correct ?We can NOT own a house because we ar farang.So the owner of the land is now the owner of our house !!!The owner , Thai lady married to a Dutchman is now a rich lady owning our house.

    Can we do something to get our house leagaly back !?

    All this is perhaps strange and stupid , but yes we believed and did all this in confidence to the Dutchman whom we new from our " home " village in the Netherlands ! This makes it even more bad !

    Can anyone give advice please ?

  12. My wife , Belgian national and I Dutch,both have a NON IMM. o-a Multy entry, went today to Nan immig.off. Our unpleassand surprise that my wife is 63 days overstay !!!!

    In Nan the very kind lady told my wife " big probleme " you have to pay 500 Bath X 63 but with a maximum of 20.000 Bath.And you have to leave the country!

    So ,she told us go to Vientiane and ask for new visa.So we have friend in Udon Thani but theye give us some information that iff you go out,pay the 20.000 B. and stay one night,cross again to Thailand you will receive at the border a " visa " for 9o days.

    This still renew not the original visa.We do not have the 800.000 but an montly income 100.000 +

    All documents are in Dutch.

    Option go for the solution our friends in Udon told us ( after to be informed by imm.in Udon and Thai consulat in Vientiane ) OR go simply back to Belgium where we got the original visa.

    To be complete : the visa of my wife expired at 09/07/2009 and by border crossing at MAE SOT prolonged with one year,but she went to Belgium and came back 22/11/2009 and got a stamp valid untill 21/12/2009 ( wich we overlooked ) !!!!!

    Please advice !!!!!!!!!

  13. Yes indeed ,this was a real disapointemend!!!!Next year it will be Chiang Mai !!!

    It was so crowded , nothing or very difficult to by a beer , no place to sit ,NO TOILETS !!!! :)

    and to go out ,taxis asked any rate they liked !No possibility to get on the metro in a " normal" way.Why not organising this in a real square or stadium ????? We had just a glimps of the fire works.

    Where was the count down ???? We where on the steps of ZEN ,but could see just a glipms of it !!!!

    No not for us any more ,back to Chiang mai!!!!!

I am flying with Thai Airways sathurday 19 from Chiang Mai to Bangkok to pick up friends comming from Europe and we return next dayto Chiang mai.So I have infact no laguage but just some handlaguage.Question : Is it allowed to take shaving cream,deodorant ,thootpasta etc in my handlaguage or........ :):D

  15. A strange post, you mention two British pubs, neither from what I can gather have given you bad service.

    I think you'll find the no riff raff sign is a bit of a joke on the owners part I don't believe he has ever ejected anyone from his pub for the way they look, if he had I'm sure he would have had started a big discussion about it here :)

    The pub I haven't been to in years so can't comment.

    What about Tuskers - you can't beat the couple who own this place for hospitality, I've heard the owner of the Olde Bell is a friendly gent though I've never spoken to him. All Brits. I'm sure there are lots of other examples.

    I have been a few times at teh OLDE BELL .Very friendly Inn keeper ,very friendly and ENGLISH speaking staff !Good food and drinks !Also snooker , and big screen TV's.The choise is easy I think.

  16. He can only stay a few weeks, Its good luck for his parents, many Lady's do the same , its a form of cleansing of the soul or spirit. It can only be good . pity some falang dont do the same .

    I am shure sme farang would like to do this but..... ,the farang does not speak or understand anuf Thai and......The monks dont speak any foreign language !So how can this work.Visit a few times the temple in the village I live but no result.Responce yes ,everybody is veru happy to have a farang but it does not work.Even in a big city like Ciang Mai , very hard to find a monk and or teacher !!!!!!

    My wife and I did folow teachings in our home country ( Belgium and the Netherlands ) so actualy we stay maround in our spiritual live.We had hoped to find the way in Thailand but......... no result so far.

    :) Perhaps you know how and where in the North ??? We would even go for longer period !!!

    INDEED !!! My wife and I " became " Buddist whyle still in the Netherlands.Many of our friends where pleasantly,charmed ,surprised.But a couple thold us litterarely " we never ever speak to you again " and they never did any more ! Who are the friends ????

  18. I just ( yesterday) returned from Chiang Mai.Have stayed 6 nights /days at the IMPERIAL MAE PING .

    Have been there many times , everytime FULL satisfaction! Very oustanding breackfast , standart rooms , bathroom could use some renovation , but o.k. ,4 restaurants at very reasonable rates , beer garden etc. etc. Very reasonable rates , but....... by the internet!!!

    Before the Mae ping stayed many times at Chiang Mai Plaza , also not bad but it is getting a little " outdated ' and under maintained.

    The Mae ping is very centraly located to night bazar etc.

  19. What do you do while retired? Well, I try to do what I could not do while I was working..I.E. NOT WORK! Exsercise in the gym, swim, eat well, relax, travel, have more sex and then some more, smile, not take risks with my hard earned money...Enjoy where I live, spend time with like minded non serious people.Not bogging myself down by buying a large property until I really know where I want to live.Most of all take pleasure in the fact i don't do what I used to do and do what I want to! Does that make me the odd one out?lol

    IDEED ,I SECOND THIS , start living !! forget bussines , enjoy living ! You mentioned it = retired so...retire ! relax and do nothing or... as little as possible and again enjoy ! In chiang Mai many oportunaties to enjoy !!!!! :D:partytime2::D:burp: Josef

    But if we want to go a bit far away..?

    I bin to pai already, so we are not going there...

    On the road from Chiang Mai to Chiang Rai ,indeed there ar some geysers ,closer to Chiang Rai the wonderful gardens of the King Mother , further the highest mountain of Thailand ,spectacular vieuws ,deep in the cave of the mountains ,very special Budda's,the " golden triangle " crossing the Mekhong to Laos on Longtail.All this can be done from Chiang RAI as base .DO NOT FORGET to vist the " WHITE TEMPLE " designed by a Thai architect - to compaire with GOUDI of Barcelona !!!

    Ansd of cource the mountain tribes and very special BUDDA'S LOST CHILDREN whom ar living in the mountain and at 5 AM they come down from the mountain on horseback !!!!!!!!!!!!!

    VERY - VERY special !
