  1. in Thailand, the paper that you sign means EVERYTHING.

    this is your private and legally binding contract between you and the office.

    did you actually sign anything?

    you have to be 100% sure of this.

    you can go to the office and ask to see your contract that you signed.

    they have no right to THROW YOU OUT and Keep your deposit.

    BUT: you have broken thai government law by subletting your room without permission from the owner.

    I know that in MOST cases you can sublet to friends casually. and nobody will know.

    BUT you did this through a website and you should have told the person that they must NOT tell the office about this.

    you should have made your "story" better between you and the person.. so then he knows what "story" to tell the office.

    also: in thailand it is illegal to rent a condo room for less than 30 days.

     

    i am pretty sure that your condo office would make you sign something, coz what protection do they have if you dont pay your rent on time? or if you pay your rent 5 weeks late ? or if you damage the room ?

    so i am sure there was "something" that you signed.

    you can ask the office to see their copy of what you signed.

     

    if you did sign something which talks about Losing your deposit for 'some reasons' then they can do it.

     

    another thing:

    It does not say on the contract that you will be thrown out of your condo if you use the room as a drug dealing place.

    but of course this would break Thai National Law and so its not necessary for them to put it in their contract with you.

    and its the same thing with Sub-Letting your room...  you cant do this without owners permission (by thai law) and even if you did have their permission, it is also illegal to sublet LESS THAN 30 days.

     

    so,, in the Same way as the drug dealing example, you have broken thai law and they can call the police.

     

    The truth is that you would still be entitled to asking for your deposit and belongings back, and the police may be able to help you with that too... but the police will also help the condo with your law-breaking!! so it may be risky for you to do this.

     

    if you really signed nothing. or if you signed a contract which says nothing about their rules or if you signed a contract which says nothing about the situations where they can keep your deposit, then you have every right to claim back your money from them because it will be stealing.

     

    if you had the right to live in this room at the time of the problem, then you are the tenant.

    and it is illegal for anyone to enter your room WITHOUT YOUR PERMISSION in thailand.

    and it is illegal to take someones property.

    (and if they did this at NIGHT TIME) then the punishment is bigger (section 365).

    i have ALSO attached these same 2 laws in Thai language at the END of my post so you can show it to the office.

     

    BUT:

    Realistically, even that you have this law on your side, you pissed them off by subletting,, and even they didnt tell you about it, it is actually against Thai Law. 

    They COULD tell the police or report you,, and you wont get put in Jail, but they can negotiate between you and the police.

    Also: to enforce these laws, you would have to go to court,, which can take MONTHS or even a YEAR !!!

    and once the judge makes their decision, then you need they can still ignore it and then you need to get the police to help you enforce the judge decision.

    this will also be the same process for the office to take you to court.

     

    but,, because the office has YOUR money,,, then you are the one who has to do this painful long process. so they dont care.

    and you can call the police,, but they may not help you.

     

    you need to see what you signed.

    thats the most important part.

     

    after you are SURE that you signed nothing which allows you to keep your deposit, then you can show them the law sections and that you want to NEGOTIATE with them.

     

    Tell them that you are sorry for subletting to this person and you didnt know Thai Law.

    but you can say they do not have the right to keep your deposit and kick you out suddenly because there is no mention of this in your contract,, and you can show them the thai law documents and you can say that you will REPORT this to the Police.

     

    you will need the THAI NAME of the person that entered your room and the Thai name of the person that authorized this event.

    you need to report it within 90 days of the event.

    when you report a theft or trespassing to the police, then it is up to the police if they want to file charges.

    if the police file charges against the thai person in your office they face going to court and going to jail.

     

    but you also need to know thai laws about Renting in Thailand.

    deposit money can NOT be used for paying electric, water or the final month rent. 

    That is a BIG LAW, because deposit money is ONLY for damages etc.

     

    i am not a lawyer, but i have had friends with similar situations before and my friend is a lawyer and she told me all this info before.

     

    But, do remember,, you also broke thai law with your subletting !

    so if you report them to the police, they can also report you and you can also be taken to court (by the thai police) and you can get a BIG FINE or something.

     

    your BEST method would be to be smart and Negotiate Politely with the office.

    Apologize for your mistakes and ask to negotiate the rent and show the law to help you.

     

    However, if you signed a contract, you need to READ IT EXACTLY.

    anything written in the contract will be 100% LEGAL.

    The situation is sorted out now.

    I told my friend to do the 'Wai Sorry-thing' to the Landlord and ask for a mutual understanding.

    so the Landlord agreed to let her stay until the end of her contracted month.

     

    in response to your question:

    a contract is a contract, and whatever words are written within that contract is the agreement between the people signing it. So if the contract allows tenants to pay rent lat (with a daily fine) up to a maximum of 15 days, then this is perfectly fine to do and the Landlord should not be angry with his tenant for following the requirements written within the contract.

    just as in Basketball, one knows that you cant travel more than 3 steps without dribbling the ball.

    so, even if she pays rent late several times, it is all within the boundaries of the contract.

     

    So, yes, you are correct about it being 2 weeks late.

    but also I am correct in saying that it was 1 hour late (from the contracted payment time) and it was an hour after the office shut.

     

    but anyway,, it has been sorted out now.

    Does anyone here know Thai Law ?   (I'm not really searching for assumptions that Thai Law is the same as UK or Australian Law).

    if so, then:  What would you suggest in this situation..  (regarding Rental Agreement of a Condo/Residence).

     

    Facts:

     

    Rental Contract is on condo room in a Managed Residence on a per/monthly basis.

    Contract states that more than 15 days 'late payment' terminates the contract and voids the deposit.

    Office closes at 7pm

    Condo owner sent an SMS to the tennant (on the 14th day) saying that rent needs to be paid by Noon the next day or her room will be locked.

    Her money didnt arrive until after noon. 

    there is no mention in the Contract that NOON is the deadline. (so i would assume that midnight on the 15th day would be the actual deadline??)

    She went to the Office at 6pm and said she can pay by Bank Transfer, because her money will arrive at about 8pm. and a Bank Transfer would ensure she has paid WITHIN 15 days.

    The said they dont accept Bank Transfer.

    Office closed at 7pm.

    Rent was paid at 8pm to the Sister of the Owner of the building. (the sister owns the restaurant within the condo) and she signed a receipt to show it had been received.

    The sister of the owner send a message immediately to the owner and confirmed that the rent has been paid.

     

    So: (in summary): The rent was paid to the owners sister who was on the premises 1 hour after the office had closed.

     

    The Owner is now saying that since the Sister is not the official staff of the condo, she is not a representative of the business, so this does not count as receiving the rent.

    and therefore it wont be officially "received" until the next day (which breaks the contract and terminates her rental and she needs to check out the NEXT DAY).

     

    (PS: the 2 sisters see each other daily as she runs the restaurant within her sisters building)

     

    I assume that its only reasonable that they let my friend stay in the condo until the END of her contracted Month. (2 more weeks).

    but they are trying to force her out tomorrow.

     

    I would appreciate any suggestions or helpful input ?

    My personal opinion:

    i assumed that Locking of doors is not legal unless backed up with a court order and enforced by the Police (if necessary).

    and since rent was actually paid to the sister of the owner and confirmed by a signed receipt, then the Tenant has not broken the contract really as the contract does not state a Deadline on the 15th day.

     

    an SMS message from the owner on the day before is not part of the contract that was signed. 

     

    My friend has been living there for 8 months and pays all her bills, and this is the first time it has been late.

    BUT: there is a personality clash between her and the owner, (hence the owner looking for a chance to evict her).

    i just think its unreasonable that she is being kicked out tomorrow when she has paid for another 2 weeks.

     

    Tomorrow is the big day, so i would appreciate any input from you guys.

    as an ex backpacker from 10 years ago and full time resident of bkk,, i often wondered this question.

    but now (from this thread)  it seems the answer is to do with the "Crown" owning much of the area around KhaoSarn Road.

    and also to do with Zoning of red light night life areas.
    and KhaoSarn Road is NOT one of these zones.

    that makes sense to me.

In that I had stepped forward even though this particular woman or man did not it seem need much care. But I am sure there are others in that troubled Plaza who do and I shall energetically seek them out.

    i have lived in bkk for a decade.

    i know where all the red light zones are...  but I am simply curious as to why KhaoSarn doesnt have it.

    its a curiosity question... nothing more.

    there is not a single hotel that requires a room key card to go to the swimming pool level.

    (go try it).

    key cards in elevators are specifically either for special floors or guest rooms.

     

    almost every pool has a bar (at the very least) and often a restaurant.

     

    it is COMPLETELY NORMAL that any hotel has guests from OUTSIDE dining at the restaurants within the hotel.

     

    if you go to ANY hotel in the world, and you ask Front Desk... how many restaurants and bars do you have here.

    and they will tell you the answer.

    and then you say you do not stay here but you would like to eat/drink at their restaurant or bar, they will not think twice about this.

    its a perfectly normal request.

     

    i regularly go to eat at the Holiday Inn (in Asoke) for their Lunch Buffet... and sometimes I just sit around the Pool.
    admittedly, the pool is not very nice there .. (my condo pool is much nicer).

    but the point is that its pretty standard for hotels to have eating faciilites around the pool.

     

    if someone FITS IN, then its hardly an issue.

    if a person turns up bothering guests and dirty clothes or smells or looks unclean, then of course this would be offensive to anyone that has paid to stay there.

    NO ONE uses HOT WATER for washing.

    they use HOT AIR for drying.

     

    actually:

    HOT WATER will make a stain harder to remove.

    stains remove better in COOL water.

     

    you just need to search for a laundry that has HOT AIR DRYERS.

    you do not need HOT WATER to kill dust mites or other mites.

     

    it is really just HEAT that kills them all.

    a good 40 mins of hot air drying will kill them.

     

    also:

    MANY CONDOS and MANSIONS have Laundry rooms on the ground floor (in the car-park area), 

    you can usually walk right in with your bag of laundry and wash and then HOT DRY your sheets.

     

    have a scout around your local area in the local small condos or mansions.

     

    PS: a Mansion (in asia) means a kind of guest house for permanent residents.

     

     

  10. if you are in ratchada then you dont want to go far.

    ignore posts about going to the park or sukhumvit.

    I suggest just popping into to ANY decent hotel in your local area of ratchada and walk in like you own the place.

    go to the elevators and go directly to the swimming pool level (it will be labelled on the lift buttons) and just put your bags on a sunbathing chair and go for it.

     

    act like you stay there.

    some pools may have special towels for the chairs, and you get the towels by showing a keycard or writing your room number or name on a sheet of paper.

    you can either use no towel, or you can sneak a towel when the staff are not at their post (which would be often).

    or you can put a fake name and room number.

    if you go to reception, you can ask what room mr smith is staying in,.

    odds are, there is someone called Mr smith staying at the hotel. Lol

    then you have a name and room number to use to claim your towel !!!

     

    also:

    outsiders are more than welcome to use restaurants or bars at swimming pools.

    they are not restricted to guests only.

    its just really the towels that are the issue

     

    once you are there a few hours,, it will be easy tthe next day as the staff will already recognise you.

  11. you should ask in some of the music shops around Bangkok.

    I know for a FACT that the music shop in COCO-WALK (near to Ratchathewi BTS station) has a Rehearsal room within their shop.

    Perhaps visit them and ask questions.  perhaps they know of a permanent location for you or a good suggestion.

     

    also: 

    around Pratunam...  opositte Panthip Plaza there is a PIZZA COMPANY.

    there is a small soi with an open square area for parking cars to the LEFT SIDE of pizza company.

    at the far back RIGHT side of this area is a 2nd hand music shop and repair shop.

    the guy in there seems the type of guy that may know about this sort of thing.

     

    other than that, you may try regular music shops, but staff may be limited knowledge.

     

    also:

    search and join a MUSIC BAND page on facebook and ask the question within the groups page.

     

  12. i would suggest you go to the Arabic Zone of Sukhumvit.

    a few of the Supply shops there sell Over-Sized bags for commercial usage.

    one shop you may have to ask around some of the lebaneese restaurants in Soi 3/1 and a nice manager or staff member may tell you where the supply shop is.

    its in the area, but is hard to find. so you should ask managers at lebaneese restaurants.

    chickpeas is something that hey buy in BULK in these types of restaurants.

     

    also:

    did you ever try JACK FRUIT SEEDS as an alternative?

    they are ridiculously similar in taste... and a zillion times cheaper.

    you can buy Bags of jack fruit stones/seeds in the night markets.. (ie: Mahana market or Klong Toei market).

    you boil them for about 20 to 30 mins, but you need to remove the husk.

    once boiled the taste of it is uncannily similar to chickpeas.

    i even made a pretty good Hummus with them ;)

    Poor child.

    evil adults.

    we also sometimes get this in our home countries too.

    i never understand why they cant just leave the baby on a temple entrance instead. - at least the baby get s a chance at life!

    there are temples EVERYWHERE in Thailand.

    perhaps the baby was born at home (still born). but then it would be normal to bring the baby to a hospital or temple.

    i feel so sad for this innocent baby that did nothing wrong to anyone.

  14. This is a general observation. (i am not seeking these bars), its just a question that has been on my mind.

     

    in the 10+ years i have lived in Bangkok, I have noticed that KhaoSarn Road has ZERO go-go bars.

     

    What reason is this?

    i can imagine that these sorts of bars would be so crowded if they were in KhaoSarn.

     

    so what reason they are not there ?

    My best guess is Maffia or Police ?

    Perhaps these Red Light Bars are limited to certain zones of Bangkok only ?

    Does anyone have a more definitive answer ?

    My British friend has been in Thailand for about a year....

    He did a few back to back "visa-exemptions" , ending about 7+ months ago.

    he has since been doing Tourist Visas (for the last 6 months).

    he is currently in Bali and the Thai Embassy in Bali is CLOSED until January 8th.

    But he wants to be back in Bkk before New Years Eve.

     

    Question:

    if he flys back to Bkk in a few days time, will they reject him (based on his prior back-to-back visa exemptions from 7+ months ago) ?

    or is it not a problem?

    he is wondering if he should fly from Bali to Lao and apply for a visa..

    but I told him to just fly to Bkk and if he gets rejected, then he can fly to Lao as a back-up plan.

     

    any thoughts ?

    I assumed that people getting refused were the ones with the 'free' (visa-on-entry) 30 day or 15 days stamp.

    i have never had any problems entering thailand with my 60 days tourist visa stickers.

    (ok, I did have one problem a few months ago, butt this was nothing to do with my visa status. it was because my passport was damaged and I had to get an emergency passport, and it worked out ok).

    but I have never had any visa problems with immigration, ever.

    i always get a new passport every 1.5 years (so my passport does not have too many visa-stamps in it).

    Vientiane immigration told me that they dont care how many times I have been in thailand,,, and that they just care that my passport is not full of stamps. so they advised me to get a new passport to keep it looking 'fresh'.

    i do not want to work here in thailand. the salary is low and also I homeschool my own son, so I dont have the time to take a real job here.

    I did try an "Education Visa" for one year (study thai language with a school in Bangkok), but it usually took about 4 to 9 hours at chang wattana and they usually only gave a 1 or 2 month extension, so it was a hassle, and I really got bored from the thai lessons.

    if worse comes to worse I can always change my name and get a new passport and start over again,, Lol

    Chaeng Wattana probably would tell you to take care of it at the airport on departure. If they did anything they would do a 7 days to leave the country stamp after you pay 1900 baht for an extension application.

     

    is there any option to transfer the visa at chang wattana without getting an extension do you think ?

    is the 1900 for the extra 7 days ? (or for for bringing it 'up to date') 

    I mean:  can I ask them to transfer the visa and not extend it beyond today ? (thus avoiding the 1900 extension fee)?

     

    i know the airport is possible,, but because he is overstayed 3 years,, i do fear them complaining (despite his age is under 15).
