  1. Hi ,

    My wife and myself live in the UK and have recently applied to bring her son (My step son) to the UK, We provided all the relevant documentation including a signed sole responsibility document.

    My wifes sister and son submitted the application to VFS on the 4th April 12 , on the 20th April both my wifes MUM and sister were contacted by the British Embassy and interviewed on the telephone.

    Since the 20th we have not heard anything (About 5 weeks since the original application)

    Does anybody know if it takes longer to process a child settlement visa than a normal settlement visa ?

    My wife is currently on FLR and has a biometric card , I'm assuming that her son will tag on to this , so everything will need linking up.

    Were hoping our son can travel back to the UK with us on the the 26th June .

    My Wife is currently on FLR for 2 years(until Dec 2013) , we intend bringing her 8 Year old son to settle in the UK , as i understood it if he was granted the visa he would tag onto my wifes visa I.E FLR until Dec 2013.

    We have all the evidence and documentation sorted including sole responsibility evidence

    I have just had a look on the UKBA website and it states to bring a child you must be on ILR !!

    From UKBA Web site = your child or children can join you in the UK if you are a British citizen, or if you have been given permission to settle here permanently (also known as 'indefinite leave to remain').

    I'm a bit confused as we were hoping to bring her son , so he could get a few years in at junior school and then move on to comprehensive school.

    Has any body else brought there spouses children to the uk for settlement on FLR.

    Your help would be much appreciated.

    Think I will raise my concerns with the UKBA case worker who handled the case.

    My main basis of my compalint will be highlighting the misleading information on the UKBA guidance notes and application form , Web site links that do not work, Web site links that do work but are out of date, and web site links that cleary should be included in the guidance notes.

    I will post more concise details when I have collated all my facts

    Can I just clarify that because my wife has been given discretionary leave , she will not be able to apply for indefinite leave for at least 6 years.

    I have spoken to the instituton where my wife took her A1 English (Listening and speaking), and they have confirmed that the new format of the English A1 (Listening , speaking and writing ) came into affect 1/4/2011 and the UKBA only accepted the old format up to 17th July 2011.

    I seems likely that the UKBA will not change there minds , so It now means that we will have to apply for indefinite leave in 6 years time , this seems highly unfair and a additional financial burden .

    I understand that they have shown discretion regarding our relationship , in that they have not sent my wife back to thailand, but I think they should have considered my wifes earlier A1 english achievement a little more.

    My wife was due to take her Life in the uk test next year , but we may hold off now untill 2014, as its seems like the UKBA can change the goal post without a lot of prior notice.

    I agree that they seem to have applied a bit of common sense .

    I have spoken to the UKBA this morning and they have confused me even more , they have said that because my wife applied for FLR this is classed as settlement and therefore she needed to have completed the Life in the UK test or done a ESOL course which is approved by UKBA , which is fair enough.

    However it cleary states that my wife was refused FLR because her A1 certificate provider was not on the approved list at 17 July 2011, this is factauly incorrect as the institution in which my wife got her A1 PBSET is still on the approved list.

    Its seems that now my wife has been given discretionary leave for 3 years , the next time she applys she will be given another 3 yrs discretionary leave, resulting in her not been allowed to apply for indefinite leave for at least 6 years, we were hoping to get FLR and the pass the Life in the UK test and then apply for Indefinite Leave.

    It seems because of this ruling this is going to cost me more money to get Indefinite Leave.

    Although I cannot appeal , I have been told by UKBA that i can write to the officer who made the decision for further clarification.

  6. Hi ,

    My GF sucesfully passed her A1 english test at a UKBA accredited centre in January 2011 , she then applied for a fiancee visa and was succesfull , she arrived in the UK in April 2011 and we got married in Aug 2011.

    We applied for Further Leave to Remain in September 2011, provided all the relevant supporting evidence including her English A1 (listening and speaking) Cetificate with a pass of 85%.

    We then recieved her passport back which had limited leave to remain until 5/11/2014, On looking through the supporting documents last night we have also found a letter in the middle of all the documents which States:

    'Your application has been refused , You sought further leave to remain as a spouse on 16th Sept 2011, However you have not provide an english test certificate from a UKBA approved provider as at 17 July 2011 (apparantly the palce my wife took her A1 English is not accredited as of 16th July 2011).

    You do not meet the the requirements of the immigration rules however you have been granted a period of discretionary leave until Oct 2014, the secratary of state is satisfied this decision does not breach your article 8 rights .

    It also states that " You are not entletd to appeal against this Decision"

    As you can imagine this is abit of a shock and I have a couple of questions.

    1) We intend to bring my Wifes 8 Yr old Son to the UK Early 2012 , do you think there will be a issue applying for settlemet for my wifes son, due to my wife been on limited leave

    2) As my wife is on Limited leave , does this now mean that she will have to apply for further leave in 2014 or can she apply for Indefinate leave (I must add my wife english is a good standard , and should hopefully pass the Life in the UK test)

    My wife has been give 3 yrs limited leave, My wife came on a fiancee visa for 6 months (March 2011) then we applied for FLR expiry date 5/11/2014.

    We are also going to bring my wifes son to the UK (settlement),

    We intend to send all documentation including the sole responsibility document via recorded post , to my wifes Sister, who will then accompany our step son to VFS , I just need to clarify if this is OK with the UKBA.

    Hopefully when the Visa is proceesed and approved , we will then travel to Bangkok to collect the little man.

    My wife has full responsibility /sole custody for her son (never married), and has got many letters/evidence from school, doctors ect and a witnessed and signed letter stating sole custody . my wife and family has brought her son up without help from her sons father as the father did a runner as soon as he was born and has never sent money or asked about his sons welfare ever.

    We all ready have this evidence as it was needed for her sons recent visit to the UK..

    I thought we may have to apply in Bangkok, but I am still confused about the following "if the child is already in the UK with temporary permission to stay they can apply in the UK.

    How can you get temporary pemission to stay in the UK, the UKBA website is a minefield

    Myself and my finacee have recently got wed in the UK (Fiancee Visa), My wifes family and her 8 year old son attended the wedding , and now her son has decided he would like to live with us in the UK which is fantastic.My Wife is currently in the proceess of applying for FLR and has just been called for her biometric assesment.

    Just a couple of questions re son's settlement

    1) As my wife is in the UK will we have to travel to thailand to sort out the settlement visa .

    2)On the UKBA website its states "if the child is already in the UK with temporary permission to stay, they can apply to settle here permanently using the SET(F) application form"-

    What does it mean temporary permission to stay ?????

    3) With regards to school , will this be free , bit confused as it states no Public Funds

    4) As the Boy is 8 years old , he doe'nt speak much english , will this be catered for in the school, has anybody got experience of this situation

    Myself and my fiancee are currently trying to complete a family visit visa for her Son and Sister to visit the UK for our wedding in Aug 2011.

    My Fiancee is now living in the UK , and we will eventually be applying for a settlement visa for her son in the next 18 months (this is all explained in the sponsor letter , as to the reasons he is coming on a visit visa 1st)

    We have have done my fiancees Sisters Family visit visa Ok , But we are a little confused about her 7 year old sonsfamily viisit visa .

    We have completed sections 1 -4 which are all about my fiancees son (I. e Name , address , Passport details, Parents Ect., but I am abot confused about

    4.14 Does your spouse / partner currently live with you at the address given in Q3

    4.15 will your spouse / parnter be travelling with you ??

    4.16 - 4.21 - these all talk about will any of your chidren be travelling with you

    As the visa is for my finacees son is any of the above relevant , do we just need to put N/A as section 1 -3 are all regarding my fianceees son.

  11. Family Visitor; the visa applicants (sister and son) are visiting the UK to see their family (your fiancee).

    Myself and my Thai fiancee are currently in the process of completing the Family Visit visa (VAF1B) for her Son and Sister who will be attending our wedding in the UK in August.

    I'm just a little confused about the following question .

    8.1 if you are not a national of the country in which you areapplying,what permission do you have to stay in that country?

    Is the answer N/A as my fiancee is a Thai National , or is it saying has she got permission to stay in the UK ? your help would be much appreciated, the guidance notes don't make much sense either.

    Myself and my Fiance have recently been succesfull in obtaining a Setttlement Visa (Fiancee), and we intend to get married in the next 6 Months.

    My Question is :

    We would like to invite her sister and Son to the wedding in the UK , does anybody know which form they need to complete , FAMILY VISITOR (VAF1B) or General visitor( VAF1A).

    As we are not married yet and my fiance has not got FLR yet I suspect it may be the general visitor applictaion form (Very confusing).

    My Fiance Arrived back to Udon last night, and guess what she got an Email this morning from VFS asking her to collect her revised passport.

    Bit annoyed as VFS told my Fiance that it would take a minimum of 2-7 days to sort , had they said they would sort it straight away my Fiancee would have stayed in a hotel overnight.

    My Fiance also asked about the courier service , and they told her that it was'nt available to any villages in the Udon thani provice.

    My Fiance is on her way back to BKK , so hopefully we will get some good news.

  15. If she applied for a fiance visa and they have given her a spouse visa then obviously something is wrong. They should not have issued a spouse visa without evidence that your are married; which you are not.

    The endorsement for a fiance should be "Marriage/ your name." For a spouse it should be "Spouse/ your name."

    All you can do at present is wait and see what happens on Monday. If they have issued her with the wrong visa then they should correct it without delay.

    This is the third post you have made on this, the other two being here, one of which I deleted as it was a duplicate of the earlier post. Please do not post the same thing in different topics as that will cause confusion and duplication with your answers spread between them and members not knowing that your question has already been answered elsewhere. Thank you.

    As you originally posted this in a UK visa topic, I am assuming that you are talking about a UK visa and have amended the topic title accordingly.

    Many thanks for your reply , you were correct 7by7 , the visa issued was incorrect.

    My Fiancee has been to VFS today and they have sent the Passport back to the British Embassy , who are going to sort it out over the next few days.

    The unfortunate thing is my Fiancee now has to travel back to UDON and wait to be contacted by VFS , very inconvenient and costly Flights,hotels ETC.

    Hopefully my fiancee was succesfull with her application , and it was just a case of the embassy putting the incorrect stamp in the VISA.

    Its just a waiting game again , hopefully latter in the week we will find out if we have been succesfull and the correct visa will be issued.

    We applied for a Finacee Settletment and I assumed that the Visa would be validfor 6 months and then we could apply for FLR after we got married.

    VFS also seem a bit confused about this and are contacting the British embassy, unfortunatly they are now closed , so my Fiancee will have to stay in BKK andreturn to VSS on Monday.

    The strange thing is they have let my Fiancee take the Passportt with her.

    Does this seem odd or is this normal

  18. Hi Everybody,

    Sorry its took so long to reply regarding my Finacees A1 English test , I've been in the LOS submitting our Settlement visa.

    As originally stated in my previous posts the UKBA would not give a definative answer to whether my Finacee could take the test whilst in the UK on a Visitor Visa , there final word on the matter was:

    'Please note that each subsequent application will always be assessed on its own merits. It is important to note that decision making on each application is at the discretion of an Entry Clearance Officer'

    As I did not not get a definative answer, My Finacee decided to Take the test at The Academy of Oreintal Cusine In Leeds and the Good new is she Passed.

    Hopefully we will now get our settlement Visa.

  19. Yes I agree with the reverse angle that VISA Plus has Highlighted.

    E.g If my GF were to say do a Online course in Thailand about the theory of Kniitting, but the only place she could sit the exam and get accredited was in the UK ,she could'nt apply for a student visa as she's not enrolled on a course (15+ hours per week) , the only option would be to do this on a Visitor visa.

    However I shall wait to see if the UKBA get back to me with a definative answer, as I would not want anything to jeopdise my GF's future VISA.

    You were correct 'RAZZ' ,they have not given a definative answer

    There answer is ' Unfortunate, we are unable to give you the exact information regarding to attend the test in the UK whilst she is in the UK '.

    I have emailed them back to to ask for a definative answer, and they have got back to me straight away and have stated said:

    Your enquiry requires specific information from the UK Border Agency, and has been forwarded to the correspondence team at the British Embassy in Bangkok. The correspondence team will respond as soon as possible, and aim to respond to all enquiries within 20 working days, in accordance with customer service standards.

    Hopefully they will get back to me soon, wil keep you all posted.
