  1. Thank you all for the above advice. They arrived at Manchester airport today with their aunt with no problems at all. Only required a letter from us at Bangkok airport and nothing else. The Ampor did not understand or know what to do and suggested we phone the Thai embassy London, they suggested two letters as we had already done one in Thai and one in English for Manchester. Only one was used as stated above. We also phoned the airline as suggested and they were not interested at all.

    Anyway job done and thank you all.

  2. One point I would make is if you want to avoid hassle in India or the Middle East book a direct flight.

    Also make sure your wife turns up at Heathrow and makes sure immigration are aware she is here to meet her children.

    Just go to the info desk and they will sort it for you.

    Thank you all for the above advice. They will change flights in UAE Abu Dhabi hope that wont be a problem. We will meet the children at Manchester airport. Just putting our letter togeather now and will sign and scan a copy to e-mail to her sister in Bangkok. One in Thai and one in English.

    PS to add they will fly on Etihad

    Will update how we get on.

  3. Children unaccompanied by parent’s immigration (Urgent)

    My wife who lives with me UK who has indefinite leave to remain, her two children have today been given their passports back from the Thai embassy Bangkok with Visa SETTLEMENT to join PARENT (S) her name after, not sure what the S in brackets is?, and at the bottom indefinite leave to enter.

    My question is, at the moment my sister in law her sister is on holiday there and is due to return on the 1st of August. Now is it possible for her sister to bring the children back with them as it will be cheaper than us flying out to get them. We can get flights for the children can this be done? And what do we have to do if so. I am at the moment composing a letter with our details and permission to help pass immigration.

    We have a small window of opportunity to do this so don’t have much time.

    Just started to fill out on line VAF4A for each child and also started appendix 2 not req on line is this correct? Also looks like I have filled out the wrong appendix should it not be number 1? as 2 looks like spouse.

  6. Having had more time today to read the link above it looks like I need an income pre tax? Of £24,800 to bring the two children here? I am self employed and last two years have shown taxable income of £22,224. this is under the min req for Partner and one child. My wife has been here a few years now so does this still apply?



    Also the link to application forms is a bit confusing If correct we need to fill in one for each child VAF4A, but there are a few on the right hand side of that page.

  7. My wife has now made the application for the paw kaw 14. Unfortunately we can’t change the names of her two boys to her family name from her ex husbands name unless we get permission from him. This is something she does not wish to do as he has had no contact with them for 9 years and he had violent tendencies. So will have to apply for passports in the names they have now.



  8. Need a little bit of help with brining my wife's two children here from Thailand. My wife got ILR Jan 2012. She has a planed trip starting Monday 11 March for a few months back in Bangkok. She will be applying for the two children's Thai passports but first has to change their sir names into her family name as they still have her ex husbands name. They have had no contact at all from the farther, any advice here? they both live in her brothers house looked after by her mother who is now aged 77

    They are aged 11 and 9

    My wife got her visa in August 2009 to live here with me and her ILR as above Jan 2012

    Next we wish to apply for the visas to come here, again any advice on what to do next forms etc. Things have moved on a lot since we last did any visa work. Can this be done from the UK or do we have to apply in person to the Embassy in Bangkok.

    I know its been a long time in starting the application but things here have not gone smooth for the last few years but we now feel we are ready.

  9. Chewy, I haven't seen an ILR endorsement since my wife got hers 10 years ago, and I'm sure they've changed since then. I'm also sure that it wont say "Resident Permit."

    Maybe there's some misunderstanding here and she has not got ILR but residence under the EEA regulations; what nationality is her husband?

    If she has indeed been granted ILR then she must have either:

    Satisfied the KOL requirement; unless she is exempt there is no way of obtaining ILR without doing so.

    or

    Obtained false documents to show that she has satisfied KOL and so obtained ILR through deception.

    If you suspect the latter, it is up to you what action you take.

    I know it’s a bit of a pain to bring this thread up again but it has taken a new twist.

    The visa my wife friend got did indeed say resident permit but underneath it says “limited leave to remain” with an expiry date of Jan 2015 they got the visa Jan 2012 so looks like I was correct and they only got an extension for 3 years and not ILR How do I know? Well he came to me in a panic today. So it looks like they will have to start the process again and do it the correct way.

    Be warned of these colleges promising false hope and taking £450 of your cash for a document that does not fit the requirements.

    I had a closer look at my wife ILR visa and it clearly states Permanent indefinite leave to remain with no expiry date it does look the same as theirs but the wording is different on the bottom

  10. Baby daughter Thai passport

    We are Just about to send off an application for our baby daughter first UK passport this week daughter born in the UK wife (mum)Thai with ILR. My question is this

    My wife wants to go back to Thailand for a few months maybe 6 later this year and we wish to apply for my daughter to have a Thai passport also. This would make it easy with an overstay? If our daughter went out on a Thai passport then she would not require a visa extension. (Am I correct in this thinking?)

    Would it be best to apply here in the UK at the Thai embassy London or can it be done in Thailand without me. I will be away in Germany so I won’t be able to go with them.

    We believe the farther “me” needs to be present in Thailand.

    Any other options or advice on how we can do the above would be grateful.

    I remember you from 2+ years ago when we were Waiting for FLR.

    Were did that time go i am sure it was only last week

    My wife got ILR in Sept so all is well

    Married 4 years Tommorow So might just treat her to a new Iron ( if I do I doubt we will make it to 5 Years )

    I remember you Ken.. Does my wife still hold the record for longest wait for a settlement visa???

  12. We got the visa today with RESEDENT PERMIT on the inside. biggrin.png

    I don’t wish to report the above as I think it would be bad karma; just think it is very wrong how they got it. Even found out her husband didn’t even send in his passport when it clearly states you have to unless you don’t posses one?

    Not sure the UKBA are doing the job properly and just taking the money,

    On a lighter note the UKBA sent with our paperwork someone’s letter that was addressed to a solicitor so I now have their details.ohmy.png

  13. Today I have seen the cert and it is an E1 test pass. He now believes this is enough to use for the ILR application is he right. I have read the UKBA site and it's not clear. I thought she would need to progress from level 1 to level 3.

    From ESOL course in English with citizenship

    A 'relevant ESOL qualification' is
    • an ESOL qualification in speaking and listening at Entry 1, Entry 2 or Entry 3 level approved by the Office of the Qualifications and Examinations Regulation (Ofqual); or
    • one National Qualifications Unit in ESOL at Access 2, Access 3 or Intermediate 1 level approved by the Scottish Qualifications Authority.

    'Approved awarding bodies' in England, Wales and Northern Ireland are:

    • Ascentis (formerly Open College of the Northwest)
    • Cambridge ESOL
    • City & Guilds (Pitmans)
    • Edexcel
    • Education Development International (EDI)
    • English Speaking Board (International) Limited
    • National Open College Network
    • Trinity College London

    In Scotland, the only approved awarding body is the Scottish Qualifications Authority.

    So, if by 'E1' he means 'Entry 1' then he may be right, but only if the awarding body is on the above list and the course she attended prior to taking the exam was provided by an accredited college and included citizenship materials; she will need confirmation of this from the course provider.

    See Question 5.3 and associated note 2 of form SET(M) as well as section 22 of the SET(M) guidance notes, especially 22M

    Just got an update on my wife friend who used the white chapel college to obtain a certificate and then applied for ILR, see previous post, She got her passport back this week with a “Resident stamp” on the inside. Does she now have ILR? If so they have got around the rules too obtain it.

Submitted our application for ILR on the 10th October application received on the 12th our last day of the visa was the 7th November money was taken out of the account one week after the application was sent, its now been 12 weeks. Have a letter stating case number and case started on the 12 October. Anybody have recent experience of how long they take to give a decision?

    I don’t know what has happened to our friend’s application they are also waiting for a reply so I don’t know if their application will be successful without the relevant documents as I posted above.

  15. As we know 25k is the average income before tax, but we are missing the point if as posted 70% of the sample taken of 500 applicants for sponsoring partners and family had incomes lower than this, then 7 out of 10 would fail the possibility of these new rules.

    If I have read correct it is about 40,000 a year spouse visas so about 28,000 could be rejected.

    Chaing mai makes some very valid points about the life in the uk test. I employ people and I ask them the odd question from the test only to be given a blank look.:blink:

  16. If this is true about the 31k required to give an after tax income of 20k then I suspect many applicants will fail if this is passed. Average income is around 25k in this country UK before tax.

    This does not take into account your disposable income. These 70% of cases could indeed be living very well on or below this amount. This is an unfair barrier, or is it just an easy way of cutting off future applicants.

  17. Good news today :D my wife passed the life in the UK test. We had it cancelled half way through the test last month as the UK computer network went down adding more stress and waiting. Just have to start getting the paperwork together ready to apply for ILR.

    My friend above applies 13th September I will keep you posted as too what happens.:ph34r:

  18. I am sure that the staff at the VAC, who play no part in the decision making process, have vary rarely, if ever, seen a certificate issued by a test provider in the UK: they are used to the ones issued by providers in Thailand. (What's the difference? No idea!)

    It is not the job of VAC staff to judge whether evidence submitted with an application is acceptable or not; they merely check that the evidence is there. Even if it isn't they can only advise that the applicant goes away and comes back with the missing documents. However, they must accept the application and forward it to the embassy if the applicant insists.

    The Entry Clearance officers at the embassy do know what is an acceptable test and what isn't; or at least should do!

    Don't worry.

    Not sure I have missed something here? is Malct wife back in Thailand now? Or does the application get passed to Bangkok from the UK? I have read this thread a couple of times and thought they were in the UK.
