Falang can not own Land only apartment. I have title books for all unit Can I seperate and sell them with out any land and make the land as a commen aria for all houses, so Falang can buy. Filer Posted July 8, 2007 Share Posted July 8, 2007 I have recently seen adverts for a small (total 30 units) upmarket development in Phuket, on the road from Kathu down into Patong, which has a mix of 2-storey townhouses and apartments and which seems to be doing exactly what you describe. They say that, because it's all set up as a condominium, a foreigner can legally buy and own the freehold of one of the semi-detached townhouses. TheChiefJustice Posted July 9, 2007 Share Posted July 9, 2007 The problem with setting the development up as a condominium is that you can only sell 49% of the units (by area) to foreigners. Another way to do it is to sell the unit to the foreigner (as foreigners can own the actual buiding located on the land) and then lease out the relevant part of the land to the foreigner via a long term lease.
