webfact Posted July 22, 2014 Share Posted July 22, 2014 Jatuporn and Nattawut given two-year suspended sentencesBANGKOK: -- Redshirt leaders Jatuporn Prompan and Nattwut Saikua were on Tuesday given two-year suspended jail terms after they were found guilty by the Criminal Court of illegal wire-tapping of phone conversation.Both Jatuporn and Nattawut were prosecuted by the state attorney-general for exposing in the public the illegal wiretapping of phone conservation between former PM’s Office Minister Pol Maj Gen Peeraphan Premphuti and Mr Viraj Chinvinichkul, former secretary of the Supreme Court and Mr Phairoj Vananuj, an Appeals Court judge on June 22, 2007.The conversation was exposed at a protest rally in Sanam Luang.Considering that the wiretapping and exposure of phone conversation was a crime and violation of the privacy of others, the Criminal Court sentenced both to three years in prison, and a 60,000 baht fine.However the court commuted the sentence by one-third to two years in jail and a 40,000 baht fine after confession of boh defendants was useful for the trial.But the court reasoned that since the two were never sentenced to serve prison terms in the past, and a plaintiff in the case did not wish to pursue the court case against them, the judge agreed to give them a two-year suspended sentence instead.Both Jatuporn and Nattawut refused to give any comments to the media representatives as they emerged out of the court room after the sentence.But their lawyer said currently all redshirt leaders have ceased their political activities but doing physical exercises every week together at a sports stadium.Source: http://englishnews.thaipbs.or.th/jatuporn-nattawut-given-two-year-suspended-sentences/ -- Thai PBS 2014-07-22 Link to comment Share on other sites More sharing options...

Didn't Jatuporn get a 2 year prison sentence(suspended) in May for defaming Khun Abhisit? Rhetorical question, yes he did. As we all know, members of the establishment(even though some of them frantically deny being part of this elite) do not get punished. This would have been a perfect chance for the junta to prove neutrality and give Jatuporn a fair and long sentence, instead we continue to live in anarchy with red criminals getting away with crimes ranging from this one, to the hacking off of an old man's arm with a machete and then shooting him dead. Wiretapping is technically illegal in Thailand, but there are no criminal penalties for illegally conducting a wiretap. There are only criminal penalties if you publicly disclose the illegally wiretapped conversations. Here, that is exactly what Jatuporn and Nattwut did. Yet, the court, in its infinite wisdom, suspended their punishments. Same way Thaksin's wife and her... brother, cousin, some other crook in her family? didn't get locked up for fraud, they didn't have a previous sentence so they were upstanding members of society, therefore suspended sentence. I don't say that of course because that would make me look silly and foolish. Attacking the courts when the make lenient decisions against violent criminals is not the fabric I am made of. Of course reform is needed in the judicial system without question, but under the current framework one cannot question the ruling. I won't throw sh*t at the judges, burn effigies of them, hand out their street addresses or throw blood at their front doors. You know what I will do? Would love to see a vid of that. As for the sentencing - incredibly disappointing. A 2 yr suspended sentence on top of another 2 year suspended sentence. Perhaps Jatuporn's amulets protect him after all and he looks after his buddy.
