  1. Hello, I entered the country yesterday on a single entry non-immigrant visa (thai spouse) with the plan to apply a 1 year extension before the end of the visa validity. However, I might need to leave the country for a unexpected trip outside the country very soon.

    My SENO visa has already been marked as "USED".

     

    Can I still apply for a single re-entry permit at BKK airport before I fly out?

    If yes, is the re-entry permit office before or after immigration desks at airport?

  2. Hello, I am currently holding a non-O 1-year multiple entry visa expiring July 10 2017 (married to thai wife, living in TH). I go often out of the country so I am trying to find the best timing for the first extension and future renewals. 

     

    - is July 9 the last day I can re-renter Thailand to get an additional 90 day entry?

    - if yes is it correct that I will be able to apply for first 1 year extension earliest on Sep 6 and extension with re-entry permit will be valid from October 6 2017 to October 6 2018?  Extension renewal can be then applied from Sep 6 2018 and be valid again from Oct 6 2018 to Oct 6 2019?

    - if I want to postpone extension month to nov-jan,  what are my options? I will not be in Thailand more than 5 weeks at once until my current visa expire.  Should I let visa expire and get non-o single entry abroad ? (more difficult these days I heard) or use 2-month extension + single re-entry permit (valid Oct 6 to Dec 6 2017) before applying for 1 year extension on Nov 6 valid from Dec 6 to Dec 6 following year? 

     

    Any hints would be highly appreciated!

     

  3. I have been working online for the past 15 years in Thailand. Some times I even take in Thai clients and pay 15% withholding taxes WHICH I NEVER CLAIM back every year in March. I even have around 4 million Baht coming in per year in my Thai Bank account and often transferred by reputable Thai companies.

    At times I work for 2-3 companies as a consultant in Thailand and they pay me all at the same time money in my Thai bank account. Never ever did I had a problem. Their is no way a farang can work for 2-4 companies in Thailand at the same time.

    As for tourist visa or 30 days stamps on the airport, I have never done it. My visas are always None B-O.

    So are you saying you are doing this without work permit?

  4. From Europe/German perspective you do not have to pay income tax in Germany if you can prove your main residence is outside Germany for more as 183 days a year.

    I know Naam will disagree with this smile.png since I am not a german citizen and I have already unregistered from Germany and provided my new foreign residential address in Thailand.

    I will anyway become tax resident this calendar year after 183 days spent here. What document would prove I am tax resident in Thailand?

    If you do not have a work permit in Thailand you are not allowed to work in Thailand, that includes working for companies in other countries. However, they have no prove of your work hours. Digi nomads stay under the radar as long they do not rent offices to work from.

    That's not exactly correct. You can work abroad and receive money abroad. It becomes only taxable if you bring the foreign sourced income into Thailand. How to prove or disprove this is a different question.

    Paul944 is correct. I am aware of the work permit situation.

    Pb 1: It is so broad that it would even apply to tourists answering work emails, or anyone volunteering or helping out for free.

    Pb 2: a work permit contains the physical address of the business and it is expected to always be at that location together with the WP holder in case of control. If I am not wrong, I read there is possibility to add a home office address for meetings outside, but WP holder is expected to be at main address most of the time.

    As far as I understood, as long as there is zero interaction with thai businesses/workers and the work is exclusively done from home for foreign client(s) using a offshore entity, the risk is minimal. Many people do this and until now no cases have been reported.

    Registering a thai company with home address would solve issue but is overkill for a 1 person company.

    Using an intermediate thai company run into pb 2 and would require to spend some time at office location.

  5. relax mate! you are neither a German citizen nor a resident of Germany that's why your German tax liabilities are zero.

    no German authority has the right to ask for anything!

    great to hear smile.png this makes sense now because people who told me to be careful are german citizens.

    to be on the safe side, avoiding any potential complications (because of your German bank account), bill your German client via your offshore company.

    caveat: check with your client whether he accepts to pay for your services billed by a company but transferred to a non-corporate bank account.

    I am planning to bill via offshore company and receive payment via offshore corporate bank account (same country).

    I didn't know it was possible to do a contract via offshore company and use an individual offshore bank account for payment.

    Main reason for corporate account was to have in the future a corporate credit card and use it for company expenses and online products sales..

  6. European citizen married to Thai Wife. Lived in Thailand for 4 years, first as employee later as online "freelancer" (software development) for one US client using off-shore company (no WP). Then wanted to move back closer to family for short-term, ended up in Germany for 2 years and worked as a freelancer (freiberufler) for few clients. Kept off-shore company dormant.

    Moved back to Thailand end of last year. Plan is to stay long-term. My wife is starting some home business, I will go back to online services for foreign companies. Deregistered from Germany, notified thai address to german bank. Had to fill with my german tax consultant a limited tax liability form from german authorities, with my thai address and stating I don't have german citizenship, no abode, no intention to return, no assets, no income in germany and what kind of income I will have abroad: I wrote that I will start a thai business and pay myself a salary.

    Here's my problem: I would like to consult for my last client in Germany. My german tax consultant said it's fine as long I am not an employee or freelancer and as long as I use a company to company contract. I am planning to use my off-shore company and if possible fixed-price packages to be on the safe side.

    I realized setting up a thai company is overkill for me (no plan for employees) so I am looking into 2 options:

    a) thai intermediate company to get a WP and monthly salary (not cheap and needs to be trusted, don't want to rush this)

    B) no WP and use remitted offshore income following year.

    Maybe I am too paranoid, but my concern is Germany may ask me for further proof of thai company and paying taxes in Thailand.

    If I use route B) I will pay little to no taxes (wife business will not generate much the first years).

    Just looking for a clean/legal setup so I don't run into any pb, Does anyone with first hand experience has any tips/suggestions?

    What if the OP find an intermediate thai company (with enough thai employees) willing to provide a work permit for a fee?

    OP would hire thai company services from HK company with 1 time cost including 1 year of minimum salary + work permit + extension of stay cost + overhead fee.

    The thai company would then provide work permit and repay minimum monthly salary. I would expect actual annual costs for OP to be then below 100K...

    PS: not sure why the elite visa has been proposed, it does not allow to work and is only for people who do not live in Thailand.

    Funny that's the last post before mine since...

    I run a Thai company with soon issued BOI approval meaning we will have spare work permits available beyond our needs. All legal, real Thai staff etc and could possibly hire a new employee to meet the work demands of our new HK customer...

    Wouldn't be worth our while less than around 10k per month, but could be paid monthly on a 1 year contract. Would need to figure out exact costs and rates.

    what could be the lowest minimum legal salary? (15000 THB ?) And the maximum duration for work permit duration (1, 2 year?)

    From what I read, the only requirement is 50K for europeans but only for extension of non-B visa.

    Since I will be entering with a Non-O (married to Thai), I would use the 400K balance on bank account to extend my stay.

  9. For second extension you will have to have the money in bank three months prior.

    With income method you must provide tax return receipts for 40.000 / month.

    P.N.D 91 = Tax return for last year.

    P.N.D 1 = Withholding income tax return (for the last three months.)

    Since my first extension was approved (feb 2010), I only started working on October 1st.

    Just before that, I worked under a non-b visa from jan 2009 to feb 2010.

    Is that gonna be a problem? You mentioned to bring the tax return from last year so does it mean they take into consideration only the past income?

  10. My permission of stay based on thai marriage will expire end of february 2011 (first extension).

    I understand that I will need to renew it 30 days before it expires, and bring the same documents as for my first extension.

    However, I was wondering if instead of having to transfer the necessary 400K from abroad two months before I apply, I could use my monthly income (working now in thailand) to fulfill the financial requirements.

    And if so, what kind of documents do I need to bring? (payslip, contract...?)
