Oz visa applications are handled by VFS, check their web pages for Oz application center. They used to take in mail applications and had instructions etc in their pages.

Being PR doesnt qualify her for an Aussie Passport, she needs citizenship for that.

In fact you you can have your visa cancelled for a lot less than that.
You can have it cancelled for serving no jail time at all although that's pretty rare.
I think it's if you're sentenced to 12 months in prison it can be cancelled under
"character" grounds and you can removed from Australia. That's sentenced so it does not just mean imprisonment.
Granted, Australian citizenship doesn't give you much as you have British.
It's a lot more beneficial for others who don't have US or UK citizenship though.

12 months as a sentenced prisoner may result in deportation, you dont get imprisoned unless you are convicted and sentenced unless the sentence is suspended....remand doesnt count.
PR can be cancelled for many reasons not always to do with jail time

Oh, and while I'm here I'd like to ask something else.
We are required to furnish a certified copy of the English translation of our Marriage certificate. But someone told me we also need to give a copy of the registry record too. Is this correct ?

You need the registry one.....the marriage certificate is not acceptable
You should submit a complete application or you may face processing delays later. To apply in Oz your wife will need to be in Oz on a visa that allows for further stay, otherwise she will need to apply offshore.
Whether you apply for a tourist visa at the same time as the spouse visa is upto you and yours but then that wasnt what you asked.

Gburns. I really dont know. I was just sharing my story. But why was it so easy for my now wife do you think if it was not for employing people.. do you think it was just luck? I dont know any other thai friends in oz who was given the okay to stay in australia after the 3 month touris visa ran out. There always sent home and had to apply of shore..
I know a few that have had that happen.....and they didnt use visa companies.

If you read the thread carefully, you will see that the OP has been advised several times that staying for 3 months
will have no affect on a spouse visa.
Now your having it both ways by saying "it may be harder for a future s/c 676 but as long as she complies it probably won't".
Also you've said "a notation on her file carries no weight unless she has signed or initialled it".
That's just plainly incorrect. Of course a notation on file carries weight. There were obviously
concerns to start with. You can bet 100% that said case officer will have documented their
concerns on both file and computer and it will be monitored and checked if another visa application
is lodged.

I didnt say "it probably wont"......I said if she complies then no offence has been committed. bit of a difference.
As I said it maybe harder to get a 676 visa in the future, I didnt say it wouldnt be possible...if a notation has been made then the next application will likely attract some extra questioning but at the end of the day no visa offences have been committed.

what visa was your GF on? It obviously didn't have condition 8503 on it. How long ago was it.

Yes.i have no idea why she did not have the 8503. Maybe it was because we used a visa company in chaing mai "starvisa" and she ticked all the right boxes like good bank account, employed ect. I have many friends who have failed with aplications buttnone of them used companies or lawyers. It was only 2 years ago now but i have been told that they have already changed. They are a lot tuffer now.
I had a lot at stake. I wanted my child bourne in oz so my advice to anyone wanting to bring a thai girl here even on a tourist visa is use a quality visa company in thailand and use a lawyer in australia for any further visa apps.
But i could have been just lucky aswell. Who knows.

She has a 3 month visa, she is entitled to stay for 3 months. There is no mention of a written promise to stay 1 month given by her, a verbal means nothing and can not be enforced.

The OP states that he was concerned about a Prospective Spouse visa (In his words "intent to marry visa" This will have no effect on that application.
It may make things harder for a future 676 visa but then again so long as she complies with the visa and returns within 3 months then no offence has been committed irrespective of any promise that was verbally given......this has been tested previously and although questioned on the next application it was still approved if I remember rightly.
For such an agreement to be enforcable she would have needed to sign a document of sorts and it ahould have been made a condition of the visa. A notation on her file still carries no weight unless she has signed or initialled it.

Thank you , gbums57au , you're a star ,,,, I will be taking out medical insurance ,,,but i am wondering if i have to place a tick against the mental illness box , and if this will will cause a follow up by the visa folks, ,,, I have to declare this , as we will be taking medication through customs .
If you tick the box then a letter from the doc outlining the nature and degree of illness maybe handy to put in the application.
The Immi and Government are only concerned about her needing emergemcy treatment in Oz and the costs coming out of the public purse.

You will be applying for the 309 and 100 visa at the same time.....the 100 visa or Permanant resident visa will be decided on after two years on the Temporary resident visa (309).
In regards to the forms.....fill it out honestly and apply the KISS principal...
regards other visas.....the 309/100 visa must be applied for offshore. You could try for a tourist visa and hope that it doesnt have a "no further stay" condition, but that is risky in that there is no guarantee it will not carry the condition.

The process will be a lot easier if your wife applies for the visa as the mother of an Australian national.
Misconception....each application is dealt with on its own merits.....As the child is travelling with the biological father then it wont make any difference to the mothers application.
Approx 5-6 working days to process a visitors visa and yes it may take longer at Xmas. Your wife will need to show that she has access to sufficient funds for the trip....

Your partner has to show she has enough funds or access to funds for the trip, the family dont have to show anything.
There is no medical requirement for a tourist visa, however a letter from her doctor regards medication may be useful when entering Oz.
Medical insurance is not mandatory, if you feel it is needed then go for it.

A lawyer will cost money, but if there are a few easy questions she might send them an email. Somtimes they do give simple advise that doesn't require any research.
In Switserland there might be free legal aid availelble. The child will probably have Swiss ationality also and must be registered ith the Swiss embassy. It is important to realize that the child has its own rights and can make a claim on child support (or somebody else will do that on its behalf). If the mother can not get free legal aid, the child itself might be able to get free legal aid.
For the child to have Swiss nationality, paternity will need to be established, he obviously doesnt want to know....doubt he will submit to a DNA test
She is in Thailand....Swiss legal Aid wont apply to her
For the mother to receive child support.....Paternity will need to be established.

My wife is 17 years younger with a son, the only scare of disease was an abnormal pap smear test which affects 750,000 US women per year(clear now). We have been together since 2004 and married for 4.5 years, she has been here for 4 years. She is not highly educated but after school here speaks reasonable english. As far as I know she hasnt been unfaithful but then I couldnt tell you if my ex farang wife was faithful or not, however it doesnt seem to be in her make up. 2 years ago I was diagnosed with terminal cancer, there is no thought of her bailing out in her mind even though she knows that our future is limited and some parts of our life have changed. I am not rich but we live a comfortable lifestyle. She can mix with people from all levels of society even attending a revue night with lawyers and judges attending. Shes had a bottle of Jacks in the cupboard untouched for 3+ months
She was BG number 2......She worked daytime in a bar but still went with guys that she chose to go with and was paid for her time.
So I guess I found a pretty good one.....mind you it took 11 years to find the "right" one with a few false starts along the way, it then another 3 years to get to know her including bringing her here about 4 times.
There is nothing wrong with marrying a BG.....just take the time to get to know them first....too many farang go and fall for the first girl they see (sleep with) and then try make a relationship out of it.

I would be interested to know how many BGs you have taken for testing?
I would suggest none, and that you are merely propagating nonsense.
I have taken 3 BGs to a local hospital, paid for the results, none of them had any disease.
Two of my friends have done the same, one with 4 girls, one with 3 girls, no disease.
So my personal survey of 10 BGs has found them disease free, a small sample but a significant result.
For the purpose of scientific medical field research, i did test 10, out of which 5 gave me gonorrhea.
My studies for the greater of man kind is thereby over with.

Not quite right.....
You dont need to show a relationship for a tourist visa....merely that you physically know the person.
Immigration dont care what you have in the bank.....they want to see that you have income, it is only required if you are supporting the application financially, fill out the relevent question on the form regards additional funds provider and provide payslips, tax return.
Stat decs are not required for tourist visas.....letter of invite covering plans is sufficient, The department dont generally do interviews for a tourist visa unless they want to confirm or clarify.
Would suggest that you follow the Immigration website for advice and information and not some unregistered companies website.
