  1. Thanks Ubon Joe - though actually she was born in Myanmar - and it was the Thai embassy in Yangon that refused to register her birth. There was no problem to register her birth at British embassy. It is her father that is dual British + Thai - her mother is Myanmar nationality.

    She has both Myanmar and British birth certificates - both show the father's name. Are you saying he can use one of these to show she is a dependent of Thai citizen and get a 1 year extension at CM immigration?

  2. Being the natural father does not automatically make him the legal father in Thai law.

    The Thai Embassy in the country where she was born has already refused to register her and has refused to process an application for Thai nationality. Their excuse was that the child must give written confirmation of consent - and, of course, she is still far too young to be able to give that confirmation.

    The immediate issue is how to clear her overstay and allow her to be in Thailand legally on a long term basis

    The child is a British citizen - not Thai. She was not born in Thailand and her mother is not Thai - only her father.

    She stays in Thailand with her Thai father

    Obtaining Thai citizenship and Thai passport for her is difficult - and so far all attempts have failed.

    Therefore she needs to clear her overstay and get the correct permission to stay in Thailand

    It is just complicated a bit by her British passport needing renewal at the same time

    I would appreciate advice about how to achieve what is required now - getting her Thai nationality is a longer term goal

    I am looking for some expert advice please

    My grand-daughter is 5 years old, has British passport and lives in Thailand

    She entered Thailand on 30 day visa exempt at BKK airport - but now has 9 month overstay.
    I understand already they don't normally enforce overstay penalties, etc. for children

    1.Her British passport will expire in January
    Can the passport renewal be done in BKK?
    If so, can her father do it by himself? - or does she need to go with him?

    2.In the meantime her stay in Thailand must be made legal -

    Her father is Thai nationality but her mother is not Thai nationality
    Can her Thai father get her some kind of extension at Chiang Mai immigration?
    If so, does she need to clear the overstay first by doing a trip out/in at a border crossing such as Mae Sai?

    Would they allow it with a passport just about to expire? - or would they need to wait for new passport?

    Or

    Would they need to get a visa at a nearby embassy/consulate?
    If so - what kind of visa? - The nearest embassy would be Vientiane from northern Thailand. Would my grand-daughter need to go? - or can it be done just by her father? I assume the new passport would be essential for this option?

  5. I have sought legal advice on similar matters on a number of occasions. My understanding is like this.

    Ownership of company shares can not be legally transferred without the written consent of the shareholder and using the appropriate forms. Even if his wife is Director of the company with sole authority to sign company documents, she can not transfer ownership of other peoples shares by herself. If his shares have been transferred without his knowledge or consent e.g. by forging his signature or by corruption at the DBD office - then that is surely illegal and he can and should challenge it in the court.

    If he is a Director of the company, he can be removed without his consent but not without his knowledge. A decision to remove a director must be made by majority vote at an AGM or EGM to which ALL shareholders must be invited. If he was invited but chose to not attend then that is up to him and nothing is against the law - but if there was no such meeting of shareholders or he was not invited to the meeting and he was removed without his knowledge, then that would be illegal and he can challenge it in the court.

  6. I have asked my wife and various other Thais about testing of drinking water quality. The usual response is something like - its drinking water so you can drink it !!! Typical Thai response. If I ask if anyone - e.g. government inspector - ever tests the water quality - I have never met anyone who ever even considered the possibility or who knew anything about it.

    Does anyone ever test the water? Is it possible to get water independently tested? - any drinking water. Does anyone know how or where to do it?

  7. Just done a multi Non-O based on marriage at Savannakhet. You only need completed application form + 5000 baht, passport + signed copy, signed copy marriage certificate, signed copies of wife's ID card + Tabian Bahn. Nothing else. I had original marriage certificate with me but they did not ask to see it.

    All very easy and no problems. Visa ready to pick up next day.

  8. Good post - you appear to have some real knowledge on this subject. If the current widespread use of some vaccines is not severely restricted or stopped altogether there will be a major public health crisis in the future - it is already starting because the genetically modified viruses from vaccines are mixing with the natural wild viruses and creating new and unpredictable mutations of the viruses against which the vaccines are useless and our natural immune systems really struggle to deal with them because they have never encountered the new virus strains before. Independent research shows this is already happening with flu, polio and measles viruses - but of course it will be denied and covered up as much as possible whilst billions of dollars are being made selling these vaccines around the world

    I previously asked a question about whether a Non-Working Director of a Thai company needs a Work Permit - the replies were ambiguous (predictably) - because the law and the interpretation of "working" in the law are not clear. The question arose because the company requested a renewal of its quota to employ foreign workers from Myanmar. For past 4 years the other Thai director of the company has done that by herself - even though normally for the company - for protection of my investment - 2 signatures including mine are required for everything. This year they demanded my signature as well. Ok no problem about that - but then demanded a copy of my Work Permit - which I don't have because the only "work" I have ever done in over 6 years is signing annual accounts and tax returns.

    Today, they have said if I don't have a Work Permit they will have me deported for working illegally in Thailand - so this is very serious - but they are willing to give me the time to get a Work Permit. However, according to the other Director - they also offered an alternative solution - which is to modify the company registration so that only one Director's signature is required - but to do this in a way that is specific to the quota application - so it does not mean I am giving away all my rights in the company. I don't know if this is possible - or if it is an elaborate ruse by the other Director to get me to give away my rights in the company - and lose all my investment - amounting to 10 million baht

    This is all very suspicious because the company is just about to sell some property assets worth about 12 million baht and make a substantial repayment to me

    So I need to know 2 things -

    1. is it possible to get an urgent work permit - and if so how to do and and how long would it atke and how much would it cost - and does anyone know of a lawyer in Chiang Mai who could help do it?

    2. I need to know if it is possible to change the company signature requirements in a very specific way as has been suggested - and if so how can it be done - to make sure I am not giving away all my rights.

  10. I have an important question which requires the correct answer according to the law please - I am not interested in anyone's personal opinions.

    It has always been my understanding for several years that a foreigner, who is a Director of a Thai company, but who does not do any work, paid or unpaid - and whose only activity is to sign any necessary documents such as annual accounts - does not require a Work Permit.

    Yes - I understand that signing a document can be considered technically as doing work - but from many years of experience and never once being asked to show my Work Permit (until today), from consulting various government officials and from questions and answers on this forum in previously - I have always understood that a Work Permit is not an essential and legal requirement for such minimal activity.

    Is this correct - or not? and is there any specific rule or regulation that covers this situation?

  11. There is a nice quiet moobaan in Nong Hoi usually with plenty of decent houses to rent or buy. It's called "Home in Town". Turn left off the main Chiang Mai - Lamphun road at the Police Station and you will see the entrance on the right-hand side after about 200m. If you drive around you can see some houses with for sale or for rent signs outside. My son had a good 3 bedroom detached house there for 12,000 per month. Another advantage is that it's relatively crime free because quite a lot of police live in the area

  12. You can not easily make a non-B visa at Hull now. The only service they provide is to "check' your application+documents and send it on to the embassy in London. I am from Hull and they know me for many years as I have obtained multi Non-B visas from them since 2003 but since last year they can not issue Non-B visas themselves - they can only refer the applications to tthe embassy in London. For my current non-B I just went to London and got the visa next day without any problem.

  13. Yes - it is very easy to be divorced without the other party knowing about it. I divorced my Thai wife here in Thailand whilst she was in the UK with her new partner and she knew nothing about it. It's a simple legal procedure as others have posted and I was in the court for about 5 minutes. You can check at any Amphur because everything is recorded on their national computer system. Just take your original marriage certificate and passport for ID and ask if them to check if the marriage certificate has been cancelled. If you don't speak good Thai, take someone to help you so they can explain why you are asking..

  14. Herbal remedies certainly can and do work. The traditional Thai herbal remedy is called Kwao Kreua Kao - the scientific name is Pueraria mirifica. It is very effective at balancing and regulating female hormones. If she is Thai - your wife will surely know about it. I know several women who have used it successfully. It is easily available at many pharmacy shops or shops that sell herbal products

    I am currently in Thailand on a multi Non-B visa issued in London and it expires on June 2nd. I intend to make a quick trip to MaeSai/Tachileik before it expires to get a final 90 days stamp

    It would be no problem to get another multi Non-B visa in London - but it's not convenient at this time and it would be a very expensive trip to London just to make a visa.

    So I am looking for advice on alternative options from those with specialist knowledge

    I am married with a Thai woman.

    Can I get a marriage extension on my current Non-B during the final 90 days stamp which will be valid until about the end of August - or is it too late after the visa expires on June 2nd?

    If it is possible - what paperwork do I need? and can I do that by showing average monthly income of 40,000+ baht
    as I don't have 400,000 sitting doing nothing in a bank account. If so, how do I do that if my money comes to Thailand on an irregular basis from business income - about 3 million baht over past year which averages to 250,000 per month - do I just show proof of overseas funds received in a Thai bank by letter from the bank ?- or do i need something from British Embassy? If the latter, how do I show British Embassy that money in UK was sent to Thailand?- as it is always done online so no paper receipts.

    If the marriage extension is not possible or too complicated - would the best option be to get a multi Non-O visa based on marriage from Savanakhet? - which I believe is still possible without proof of money or income. If so, can I do that at any time within the final 90 days I get at Maesai?

    Or is there any other option that might be better?

  16. I have a multi Non-B visa without Work Permit - did not have any problem last time when I went out and in again at Ranong despite reports that I might. No-one asked anything. Generally, a multiple Non-B visa issued from USA or UK will show that you are in Thailand for genuine business purposes representing an overseas company and that does not require a work permit. If they ask again, I suggest you just tell them that you are a visiting businessman and don't need a work permit. Of course, there's no guarantee they will listen or apply the normal immigration rules
