If child's father was British otherwise than by descent (eg via birth in UK, naturalisation or registration) when child was born, then child is automatically British (2(1)(a)) and may apply for a Consular Birth registration (optional) and either a British passport or a Certificate of Entitlement to the Right of Abode.

To be consistent, the UKBA should have scrapped the marriage visit visa and 41(x) when they scrapped the COA.

Note that a British citizen has the Right of Abode and cannot be subject to leave (46).
