  1. Greetings from AMAING Phuket!

     

    I have a driving license nearly for 5 years already and is the time now to renew it. Do anyone knows if i am holding an international driving license avoids the 1 hour watch video?  Before 5 years ago when i show my international driving license from Europe to Thai employees in the government office  all was good i have avoided. The rest of the papers i have (medical visa etc) i just want to pop in do the traffic light test (or how it is called) and renew it. 

     

    Anyone had a recent experience. Please do not write what you think of only if you have recently renew your driving license recently.

    I am exploring the possibility to install Wall Paper in some walls of my boutique resort in Rawai. From my quick search online it seems that nobody does this in Phuket (meaning not even one website is advertising that can do this job professionally). Kindly advice if you have used a professional team and you were satisfied.

     

    I am aware that i could try myself but i prefer to give this task to someone that can do it perfectly fine. I know the drawbacks of installing wall paper, i am ok with that i just need to find someone to do this job.

    I can't remember the clause number but one of the clauses in the Thai land law states that any attempt to circumvent the Thai land laws can lead (I think) to forfeiture. Forming a company that does not in fact do any trading and pays tax each year based on fictitious 'income', simply for the purpose of owning land is quite clearly, circumvention.  It would be quite easy to prove that in court.  There will be, I have no doubt, no receipts, no bills and probably no bank account.

     

    Why does is go on?  Who knows, maybe because a whole industry has grown around such 'company formations' and therefore, money is being made. The powers that be have 2 arms, 2 eyes and 2 legs just as we do, so to think they are not aware of such 'company formations' would be asking rather too much - the internet is full of Thai legal specialists, lawyers etc. offering such services.  But, I doubt any one of those outfits would, if asked, give a cast iron guarantee, in writing, that the holding is 100% secure.  I can only think that the authorities, bouyed by the fact that these 'companies' do not actually own any precious Thai land, simply leave their cronies to make money out of the situation - no harm done and everything to gain - so to speak.

     

    A good friend, now sadly deceased, made me aware of a case in Pattaya around 8 to 10 years ago where a foreign guy had 'bought' a house, as thousands have, through the formation of a Thai Ltd company.  Said owner was caught playing the field by his wife who then filed for divorce.  She was aware of how the house was held and her father was a police captain - long story short, the foreigner lost the house.  In court it was shown that the company did not in fact trade. All that happened was that his lawyer, who was also the company book-keeper, filed a tax return each year so the company paid a little tax.  The company was not set up as an investment holding with a portfolio of properties.

     

    You ask then, how can it be done legally - because I stated that its not that difficult to comply.  Well, there are several options and I'll leave it to you to explore others, of which there are several but consider this:

     

    Mr. A sells his house in Farangland, forms a Thai Ltd Co, for the purpose of property investment (of course taking all the necessary steps to ensure he controls the company and that the company complies with company law). He invests the proceeds of his house sale in the Thai company which then buys several houses and rents them out - one to himself.  There is nothing I know of in Thai law that prevents a director from renting a house from his own company which Mr. A does. He has a proper lease and pays rent each month.  I believe that is fully legal.  The company has been set up to invest in property, it is trading, making a return on the investment and pays tax on real accounts.  As such it can be shown to exist as a real company, set up as any other, with the intention of making money.  If enough houses are owned, the company would surely need staff for maintenance etc. - further proof of its genuine existence.

     

    A property investement company clearly needs to have something to invest in and so has a reason to own land. A guy owning a sweet shop can only show a need to own that shop - not a 5 bedroom house with a swimming pool.

     

    I  know of 2 guys in Hua Hin that each own a property through a Ltd company but each lives in the house owned by the other's company and rents it from him.  A little more difficult to show realism but providing the i's are dotted and the t's crossed, I see no reason why that would not be legal.  I ran that past a Thai barrister a couple of years ago and she said it was legal - there are no set minimum incomes for a Thai company.

     

    As I say, there are several ways but the bases need to be covered.  If I was involved in any such scheme, I would not simply pay a Thai lawyer to concoct fake accounts each year and file tax returns.

     

    The test on any such 'ownership' is whether the prosecution could prove circumvention if it went to court. With most of the 'companies' I've seen, that would be easy.  It is not illegal for a foreigner to be a director of a Thai company nor is it illegal for that company to own land. But if it can be shown that the company was simply 'created' to facilitate land ownership by a foreigner and nothing else, I'm pretty sure the foreigner would lose - its clear circumvention.

    What you have written above all make sense. I just want always to hear different opinions (like brainstorming) and always be aware how the people handle this complicated matter. 

     

    After the banks bankrupt in Cuprus/Ireland/Greece any investment is not safe. Only if you own a land in your own country under your own name. And i can refer many MANY other bankrupt cases of trustworthy investment companies etc. Reducing the risks of losing your investment or property is the point of this discussion here.

     

    p.s for the particular case of your friend in Pattaya you do understand that a Thai wife was involved plus a high level police officer was involved....is too risky no?I read a lot of stories with Thai wifes and old age Farangs.....so very normal to me.

How you can 100% comply if the company is not really trading anything but owns an asset (like land and house)?because you write is not that difficult i want to hear more. In Thailand you can always be challenged as you are NOT in your country(this is EXACTLY how it is either we like it or not) BUT 99% of farangs residing here do exactly the same (set up a Thai company if they want to own land and house). This a VERY long discussion topic  but you wrote 'is not that difficult' and i am talking about the particular cases that a Thai company is being established in reality to own land and a house only. The real estate industry in Thailand is being feed from this 'scheme' no?and then we will start the 30 years leasing discussion....BUT no let's stick on the 'is not that difficult'. cheers

  5. trying to help, visit freedom beach, a bit of hiking to go down(and steep to go up!) but you will get your beers and some food (small vendors directly on the beach). You talked about beach and this is a real secluded beach although hard accessible. On the other hand, as the Phuketians mentioned above Yanui (has few restaurants and vendors across the road) and Naiharn (10 meters from the sand there is few restaurants Thai style) are good options.

    Ao Sane beach also is perfect for what you are looking (google it restaurant DIRECTLY on the beach)....or nui beach but still difficult to access it (you need to get to a SUV)

  7. I have recently done home isolation. I had symptoms and i went to do a pcr. I was positive. I have done home isolation. I have informed the government through line app and i did also registered online (i google the info and got some links on PhuketNews). They have called me and they asked if all are ok and if i need medicine or anything. Nothing else. I pass it like a flu. My question to all the people here in this post is , how i can get a medical certification that i had covid so as to be able to travel around Thailand with no issues? Called the hospitals Bangkok and Patong but they just do not know and they did understand surprising English. I am not going to pay another 2.700baht or 2.400baht for a pcr only to get the certificate BUT i do have the PCR proving that i had covid, i survived no? so how i shall get this medical certificate? The clinic that i have done the PCR does not know and they have directed me in the hospitals but the staff in the hospitals  do not know....i am used to this kind of Mickey Monkey situations does not bother me but it would be good to get the certificate if somebody knows kindly write me here. cheers

    Few weeks now i am considering to go ahead and install a water filter not only in my house but also in my businesses. I have 2 boutique hotels in Phuket. The one has 2 water wells and the other one is in Patong with the quality of the water being very questionable. Now i make the thinks clear:

    ----For the waterwells (rawai area) i just need a recommendation what kind of filter to use to avoid the dirt come into the kitchen, showers etc.(i assume the installation is very easy you just plug it beside the water pump).The resort is very close to the beach so there is also salt coming up with the waterwell (the shower equipment are getting rusty). I checked on lazada PLENTY of options but i am getting lost although i made my research already. Can someone give me a recommendation? Nothing fancy not the best but something fair that does the job and i do not need to change the filter very often.

    --Water filter for Patong now....I have seen and read online that there are some filters that they can purify the water and be drinkable....can someone that have used this kind of water filter post a reply in this topic?It seems to be inexpensive to set up a water filter for drinkable water and i want to provide this service for my clientele (only in the roof top kitchen so as to be able to make their coffee or just drink water, so only for one tap).

     

    I would appreciate very much some responses that are being written from people that they have used the water filters themselves.

My lady can translate, my lawyer or my accountant can also BUT they can not translate it specifically and they can not understand the importance of the wording. I can translate a document online but still will not be done properly. Is there any RELIABLE translation service in Phuket? From Thai to English.     I would like to plant some trees for privacy reasons in my backyard. What would be good ones? I have already a mango one. Please note that i do not want to buy a big one to avoid paying for transportation. I want to plant some trees that can grow quickly and they are thick and strong. As height of 6 meters in approximately 2 years time would be great (can be longer but i should not wait 15 years)

    *i am not interested for 'chirstina' like plants only for trees that can grow quickly within few years time.

  11. Thank you guys for your answers but what i got (red soil) worked perfectly fine in my garden. I have not used it to grow lawn though. Nevertheless, if you can help on the question (can you share a contact that can deliver red soil at a fair price) would be great if not there is no need for spamming.

  12. Last time the below came in my house and unload the red soil. I paid 900baht for it. As i can not find the contact for similar truck i consider a pick up full of soil at a fair price. If you have any contacts please advice. By the way i was driving back home yesterday and i stopped to ask a garden shop for red soil and they have given me ridiculous pricing this is the reason that i post here.

    Has anyone of you bought some soil for his garden? Before few months ago i ordered one small truck to come and unload a good quality soil (red colour) into my yard. I have just paid 900baht for this, i lost the contact and i am wondering if anyone of you knows someone.

    I have planted these flowers (or how there are called) nearly 8 months already but they do not grow as they should (1cm every month). Does anyone of you know what kind of plant food or fertilizer i have to spray on them and how often?
