  1. JCC buyers received full-colour brochures which showed the panoramic sea view and an artist's representation of the low rise hotel & water sports facility which were to be part of the package. Believing that anyone who issued such photographic and printed matter and then failed to deliver would (of course) be busted big time for fraud - people bought in. The deal of selling out to VT7 was done so covertly it was a done deal before anyone could react. The JCC developer also sold off areas that were stated & illustrated on the drawings to be "common areas".

    Thank goodness that with the introduction of the new Condominium Act that this can't happen anymore. The developer must deliver what is shown in advertisements, brochures, on the internet, etc.

    And it was a done deal that VT5 got built. Grand Condominium Juristic Person Manager told co-owners who went to him to question the building of VT5 so much in front of them that "law can be changed every 5 years. VT5 is legal". BS.

    Very important things are done without the Manager and Committee referring back to the co-owners. I just heard today about a co-owner who recently came on one of her frequent visits here to stay in her condo and was horrified to learn that various things had been done including raising the maintenance fee. She is taking JPM and committee to court. I presume she has looked into the matter(s) and believes all done illegally.

    I hear that committees are now taking out liability insurance to protect themselves - again done without reference to the co-owners.

    IMHO it's a rats' nest.

  2. Have been reading thro another topic and am horrified to learn that blackened skin could be a bad thing. Help!!!

    18 months ago I got a pale skinned, light haired, Shihtzu - all the better to check for fleas and ticks. She was clipped pretty close about a week ago and I was a bit put out to see that she has got a lot of black skin showing thro, particularly on one side, but didn't think too much about it - thought it was maybe just natural ageing.

    Have looked it up on the internet and now am very concerned that she could have any of the following: Cushings disease, hypothyroidism, chronic skin infection, reproductive hormone disorders. This dog came on heat at about 4 months old and never really went off heat. I wanted her spayed but vets wouldn't do it. Eventually she settled a bit but on operation was found to have a uterus full of blood and an ovarian cyst. Everything was removed and she recovered well and has been playful, alert, interested, loves walks. But she is always looking to have her fanny rubbed by any convenient foot!

    So what to do? She is supposed to be travelling soon.

    It never rains but it pours! Any advice gratefully received.

  3. What do you do on an airplane? Did you know the bathroom of an airplane tends to have fecal matter strewn about due to the flushing mechanism blasting it out? Baby spit? Big deal....

    I went to an airplane loo for a wee and honest to God it wasn't till I turned round to find the flush button that I noticed a huge dump right at the back of the toilet seat. Since then I inspect the seat very carefully and if it looks OK I lift it and "hover".

    What if the person who had obviously crouched on the seat had slipped into the bowl and in the process had pushed the flush button. Is the suction enough to do damage? :o

    And those of you thinking of taking that Rocky Mountain train from Vancouver to Banff do be careful in the loos - to my own certain personal knowledge they do spit faecal matter back at you.

  4. jpm76, I know I shouldn't be nasty but I really, really hope that someone builds an entertainment complex with 100 floor hotel/condo in the sea right in front of you. And don't think it can't happen - that's what condos outside the 200 meters thought.

  5. Tammi mentions that her condo committee takes no notice of the will of the co-owners. How did THAT happen? What's the story?

    Browsing the Condo Act & pondering one thing sticks out like an ulcer - the scope for misuse and corruption by a committee which now needs to be only 3 people. Decisions being made and rate increases enabled by second call meetings not requiring a quorum.

    When you have a good committee (possible - after all, these people are volunteering their time & energies) the new law enables them to protect and improve the building. But what about the scoundrels? No protection from them should they achieve those committee seats. In at least one building the committee has got themselves an insurance policy (paid for by owners) protecting them from lawsuits. When you think of it, the sky's the limit.

    I'm afraid the time has come for condo owners to become more active. Do you think this is possible to happen?

    The paradise we invested in can turn into a ghetto if owners don't become aware and participate in governance. Tammi - what's your story? Might be an object lesson for us all?

    Ripley, two days since you posted and not a co-owner with anything to say. Maybe they are all quite content with how their condos are being managed! But probably they are just not interested and will not be interested in the Juristic Person Regulations and the Conda Act until the condition of the condo can no longer be ignored. At this condo the accounting is not yet on the bulletin board - it should have been there on the 15th as per the new Condo Act. And there has been no committee meeting for 4 months.

  7. I just completed sale of condo unit held less one year: total tax and fees paid at Land Dept office on a declared transaction value of 7.25 mil baht was 45,400 baht. These taxes included specific business tax, withholding tax, stamp duty, and transfer fee, all in, everything. This computation was under the reduced rates introduced in April 2008 and effective for one year.

    Therefore if I sell a condo for 8.5m I should be looking at a total bill from Land Office of about 53,200?

    Tammi addresses a point which emerged recently regarding the new Thai Condo Law & its effect on AGMs & "second call" meetings. Alarming that a handful of people might be entitled to make decisions & demand money from the owners, etc. - even, taken to the extreme - one person who happens to be the only one attending a second-call.

    In April, J. Fishback gave a speech & later held a kind of seminar for the ExPat's club on the new Thai Law. Later, he said he'd have to retract some of what he'd reported because his English translation of the new law was inaccurate. I think it's important that condo owners find an accurate translation and educate themselves. This Thai Law takes precedence over individual condominium rules and regulations. How much room does it leave for abuse? What & where are the loopholes?

    All of this is off the subject of "Condo owners sue for sea view", which is why I tried to start a new Topic. Maybe mine was too specifically JCC. How about one on Thai Condo Law and how it effects us, where we find the real deal, etc.? "

    Statements/Law should always be taken to the extreme to prove them.

    Agreed. How about also including House Law?

    The two year moratorium on Company Owned houses ends soon (October). What is going to happen to those companies which do not comply with the FBA and Land Act? We could all do with some facts and proper official information about the plans and intentions of the Land Office.

    A new thread covering these legal issues and other ongoing areas of concern such as the multi-ownership of condos by foreigners would be useful.

    OK. Somebody start the thread and let's see if it takes off. I'm in!

    In our building, I've heard that the plan - based on new law - is to have the AGM and the second call meeting on the same day "to avoid inconvenience". Don't know if that's true. Have also read an opinion that the second call meeting does not require a quorum.

    As far as I know new Law states that another general meeting shall be announced and held within 15 days from the published date of the previous meeting.

    Some condos, when sending out notification of AGM, have stated in the notification that if no quorum then 2nd called meeting will be held in the afternoon of same day as 1st called meeting. Saves on committee members having to turn up on 2 different days! We wouldn't want our committee members to be inconvenienced!

    BTW, new Law says that committee members cannot hold proxies. Also, it is worth noting that a committee member is elected for a 2 year term and may be reelected for a further 2 years but shall not be entitled to be on the committee longer than 2 consecutive terms except when no replacement can be recruited. The Manager has to submit the appointment of the committee to the competent official for registration within 30 days after the resolution is approved at the AGM.

  12. There has been a long term problem that many condos could not get a quorum for AGM so, for example, fees could never be increased causing substantual problems.

    The new condo act reduced the quorum from 33% to 20%. In addition, if there is no quorum at a general meeting, a second meeting can be called within 15 days and there is no quorum for this new meeting.

    Notice of a meeting must be sent to co-owners at least 7 days before the date of the meeting

    I understood that new Act reduced quorum at 1st called meeting to 25%. At 2nd called meeting any number makes a quorum.

My understanding is that the Amendments to the Condominium Act that come into effect on July 4th 2008 both impose further legal responsibilities on Committee members and also change the rules on voting at AGM's and EGM's amongst other things, I recently took on a post on our Management Committee and would like to know where I stand, despite asking the juristic person for a translated version nothing has been forthcoming, I have searched Thaivisa and read dozens of posts on and off topic but nothing definitive....does anyone have further info on the changes or better still a link to an English Version.

    I believe the new law states that the accounts must be on the notice board by the 15th of each month and must remain on board for 15 days. Has this happened in your condo?

    New condo law says that for 2nd called meeting "the constitution of a quorum shall be irrelevant." Does this mean one person can turn up and propose and pass resolutions? Mind you, where I stay, co-owners are not allowed by the committee to pass resolutions and resolutions that had been passed in days gone by were ignored by the committee.

  15. Bad headline. The price of gold hasn't 'surged'.

    It has crept back to the level that it surged to in March 2008 (in response to the Bear Sterns shock, and from which it retreated very quickly) and has now gone just a touch higher to bring it to its record level in Thai currency.

    Having said that, some of us are not surprised. Review the thread 'Get out of $dollars$ now' that started in July 2006, for instance.

    Where can one find this thread? Unfortunately "get out of" are not recognised in the search because they are all words of under 5 letters. "$dollars$" brings me back to this thread.

    BTW should one get out of dollars now?
