    Thanks everyone for your responses!

    I missed most of this thread as I was getting ready to move to Thailand.

    I now live in Isan with an "O" visa based on my marriage to my Thai wife.

    She has a sole proprietorship which she just started and my questions are in case I want to work here. I prefer to keep things legal and taxes low....

    It seems that with two employees I can get a work permit and she can hire me if I have a reasonable salary.

    Basically, I would be helping her communicate with her customers outside of Thailand mostly in the USA, on the phone and via email - thats it.

    So maybe a salary of 8,000 baht might work?

    Isn't the OP married to a Thai? Why does he need the work permit - except if it's just to cover his working for his wife's company if the police come around, and totally unrelated to the visa extension?

    On the salary quoted he wouldn't get permission to stay on the basis of his working, and would have to have the money in the bank and/or proof of income for the extension of stay on the basis of supporting his wife.

    Or am I missing something?

    I was traveling and did see the whole thread. It was quite helpful, thank you for the link. I will continue on tha thread.

    As I did not understand:

    Article 7. The criterion under paragraph one shall be reduced by one half in the case where the permit applicant alien has a Thai spouse in a lawfully registered marriage and in open cohabitation.

    What is the paragraph in this case? With English legal documents I always read slowly and usually understand - but with a translation I wonder....

    It shouldn't take anywhere near that long if you have the paperwork with you.

    I know someone who got a B extension there last Friday. He told me he was finished in about 15 minutes.

    I believe him because I had a similar experience extending my O there last year.

    My wife is pregnant and due the first week in January.

    We will probably combine a prenatal visit in the afternoon to a Khorat hospital with a morning trip to the immigration office. The local Buayai public hospital is ok for small matters but for a baby a bigger hospital seems like a good idea.....

    What time does the immigration office open and how early should I be there to be first in line? Allow say 2 hours for the visit?

    If you are coming into Korat by train, you will need to take a Tuk Tuk to the new Immigration office, and make sure he takes you to the correct office. There are many TOT offices in Korat. This one is on the No 2 road about 12Kms out of the City heading towards Bangkok. Quite a long Tuk Tuk ride!

    There are now a small number of Taximeters in Korat, better and cheaper than Tuk Tuks, the call centre number is 044-342255.

    I have a new non immigration "O" marriage visa and the first 90 days expires Nov 29th.

    I would like to get a one year extensition as soon as possible. I have a US embassy certification of income and can put 400,000 baht in a bank account if that helps.

    1) What is the closest immigration office to Bui Yai that I can use? Address hours & phone number please.

    I am about one hour and 20 minutes from Khorat (and in Nakonratchisima province) and around 2 hours from Khon Koen, by train. I am walking distance from the Bui Yai train station and do not have a car. I prefer to go to Khorat.

    2) Special advice?

  6. I need to extend my 90 day marriage visa (issued in the USA) before November 29th. No income currently in Thailand and I am a US citizen with a Thai wife. Next year we will have Thai income and tax receipts etc.

    I will be living in Khorat.

    1) Do I need to go in person to the US embassy to get the income certification of 40k per month?

    2) Where is the immigration office for Khorat and what is the phone number?

    3) When should I start the renewal process? Now?

  7. I am moving to the town of Bua Yai next week and my wife will be having a baby in January. I will check out the local private hospital in person, but I was wondering how far we will need to go if there are any complications anticipated in the birth such as a c section and to have a specialist available for administering the needle in the spine (I forget the process name..).

    We are an hour and a half by train from Khorat and not to far from Khoen Ken by train although I am not sure exactly how far.

    All help and advice will be greatly appreciated!

    Great information! Thank you. I am moving to a small town about aan hour and a half from Khorat next week and have heard from the local internet cafe that two ISPs are available: TOT and one other which I forget.

    I plan to subscribe to the best home package. Without paying too much more are the business packages much better? And what is a SME package?

    Now that I know that the import license and permit are the same the process seems more reasonable.

    We will be moving to Bangkok next month and sending by ocean raw materials for our business. I have not yet setup a Thai corporation.

    Do you think that perhaps it will be best if I put my goods in storage for a month while I get the corporaton and permits set up?

    On a side note did you set up your corporation yourself also?

    (I've applied for ethylene and agricultural based based products from Malaysia)

    1) Can our minor children (dual citizenship Thai US) be stockholders as part of the required seven stockholders?

    2) Can we issue preferred stock with no voting rights and have part of the required seven shareholders only have preferred stock?

    3) Can we have a token shareholder as part of the required seven with only on share worth say 100 baht?

    4) Are there restrictions on dividends related to authorized capital and profits?

    5) Does Thailand have the equivalent of a US S corporation which eliminates double taxation at the corporate level?

    To be a pendant, the connexions are not faster, but have greater capacity. To answer this, if you are able to purchase a corporate or SME package the advantage is primarily less contention {not so many users sharing} but you are bound by the poor international connectivity from Thailand to the big {according to the various Minsters here} bad world out there.

    Your connection within Thailand should be fine. It's just the non-Thai bandwidth...

    Also, depending on your distance from the exchange, they may tell you that you can only get 512K...

    That is not good news for me as most of my email will be outside of Thailand, Also my business website is based in the US and I need to upload photos and text all the time.

    I am thinking about moving to a suburb like Minburi will that area be a problem as it is not in the city-center?

    My current speed is: 1.5 Mbps up and 8.2 Mps down is that possible In Bangkok and if so what would that cost?

    What about the companies having to show the 600k+ is available to fund the WP for the year ? How would a sole proprietor get around that or indeed have to ?

    Good questions.

    Having 600.000 in the bank is not a problem, but I do not need to draw a salary, I wonder if the 50,000 salary is a strict rule?

  15. Sole Proprietorship ands work permits

    If a Thai citizen sets up a sole proprietorship with three Thai employees and the sole proprietorship, can a work permit be sponsored for one foreigner?

    Or is a corporate structure required?

    If you are married to a Thai, you can be employed with a work permit.( 2 Thai employees are required) Otherwise they need to hire one more Thai for you to be able to apply for the work permit. ( 4 Thais are required to be employed)

    My Thai wife will be the sole proprietor. We currently have a US corporation but I do not like the Thai requirement having roughly 7 shareholders.... So a sole proprietorship will work better for us.

    So:

    1)The business can be a sole proprietorship and does not have to be a corporation.

    2) She needs to have two employees (she does not count as the owner. or does she?)

    Have I understood you correctly?
