  1. Also once we had a guy pull over on a motorbike and take a picture of my daughters when we were out shopping .If the pictures he took had been commercially used could compensation be claimed ?

    In the US I think so yes, out here it may just be a case of shaming the people involved, which is fine :o

  2. KK, you do have a very thin skin. You posted originally in a manner which led me and others to assume that there were some privacy concerns. Ultimately we seem to be in a situation that if you'd been paid you'd be perfectly happy to have your son's visage placed for all the world to see, which is a little different in construct. Apparently, you required a macro capable camera to create images, which would imply that your son is very young indeed, and has already been to a number of casting sessions. So in short, this is an actively pursued area of commerce.

    If this is your son, and with all due respect children of that age are not so singular in appearance, then you have to look at how you managed, or not, these activities, before jumping to accuse others of unethical behaviour.

    I'm not totally sure of how to take your post A_Traveller, I already explained how we came to be in some castings.

    erm, yes, erm, we went to these castings as we'd been asked to and didn't quite know what to expect to be honest.

    erm, nothing came of them(to our knowledge) and we left it at that, quite some time ago as they weren't as much fun as we'd been led to believe.

    As far as the billboard goes, it was my mistake to use the title that I did, I should have entitled the thread 'I think my son is on a CP billboard', my mistake, don't think that's a shootable offence, still ,shoot away.

    Anyway, my point now is that IF it is my son then it's cheeky, is it not? That is my only point, I'm not really after compensation, just IF it is my son then surely either we've missed something in the details page whilst at one of the few castings we attended or someone is taking the pi55...

    You've even gone into it later and edited in the 'tiara' bit you thought it was so important a comment :D

    , which means that you will have signed release forms, in Thai, which may well have granted to the agency or photographer rights over the images. I have heard of that happening and in that situation you will have no case, unless it can be shown that the authorisation was inappropriate {e.g. Nanny} but the rebuttal argument would be she was 'in charge' and you didn't revoke the permission at the time.

    At sometime in the past the OP has thought that there are bucks to be made selling photos of his child, now it might just be there is a photo out there that he's not getting paid for.

    Did any agency 'lure' you or where you eager to sign on the line?

    We dipped out toes into it a bit before, not me but our son and his mum had a few castings together but it ended up a waste of time and not much fun, lots of waiting around and the last time we went to a casting they tried to put makeup on my sons face and he didn't want that at all so I decided he'd made his own mind up and didn't have fun at these kind of places, mum didn't either, lots of lies and waiting.

    And to asnwer your last question GH, we were approached several times about our son but most times just brushed it off but we spoke to some friends who'd really pushed their children into it and they said they had a lot of fun so we thought it might be a nice way to waste some spare time when we had it, when it suited us.

To be clear I'm not accusing anyone of impropriety here, it may be a genuine mistake, {wrong folder of shots shown to CP} it may be that the release gave the studio rights {questionable but difficult to over turn, you need to review the papers for such activities}. Once you have seen the image, which might not be your son, you can reconcile to the casting sessions that you have been to, e.g what he was wearing etc..

    Will do, I'm just trying to find out where Yommarat is and then where this billboard is, it may not be my son, if it's not then fine, I don't particularly want it to be him...

    Anyway, surely this billboard is not unique, surely they wouldn't bother printing one of them up, there must be more! keep your eyes out for a pasty little boy who looks rather like a girl, hair down to his chin :D

    My son is quite easy to spot, his looks are unique and our friend said he wasn't mistaken, actually this friend is a lawyer so if it is my son I'll know who to talk to :o

    Stop getting so excited and go and find out if it is or not.

    I'm no expert on the position in Thailand, but back in the UK the rules are very specific as to whether a model-release is required for the use of your image. For example, a 'face in the crowd' likely would not. In this case as the person is clearly recognisable then someone should have signed permission.

    As previously noted, "Task A", is to go and verify that is really is your son.

    Assuming it is take a good photo of the billboard making sure the date/time in your camera is correct, ensure there are recognisable landmarks in the frame too. Then go and see your lawyer.

    that's the kind of response I was hoping for in the beginning, thank you very much Crossy, but saying it is my son, would I have a case in this country? Would we just get laughed at by CP or the agency that supplied the photo?

  10. I'm confused, is the OP saying for a fact that an image of his son is being used on a billboard, or is he saying that he has been told this and doesn't know if it is a fact? If the second, then the advice to get in a taxi and find out is relevant.

    Secondly, in many places one doesn't own the copyright of your face in a public place, so if an image is being used which was taken in public, even without your {presuming your son is below age} knowledge it may still be used in this manner. In France I believe people do 'own' such a right. I don't think this is the case here. However, if you had studio shots done, maybe for a portfolio, and these are being used you probably have a 'case' against the photographer, assuming you contracted for the shots for no distribution.

    We've been for a few castings but not for CP so I'm wondering if he was in a department store with his nanny sometime and there may have been a CP promotion or something...

    It's apparently a photo of my son, standing against a studio background holding up a CP egg??

    So what part of BKK is Yommarat anyway?

    And yes you are right, hi-res images don't come without photo shoots, I'm aware of that, that's why I'm mentioning it...

  13. I have a verified paypal account linked to my krungsri savings account.

    I can:

    - Receive payments

    - Make payments

    - Withdraw money from the paypal account to the krungsri account.

    I could not manage to easily credit my paypal account from my krungsri account. I had to send myself a money request and use another credit card to do this.

    1. Reading this thread i think many of you must be tourists. Why would you tip the taxidriver? Want to show off?

    2. This includes NOT asking if i want to go to massage, singing, begging, talking to me like a tourist. I just let the driver round up the small change no problem there.

    3. Maybe some of you forget that thailand has a feudal society. Cab drivers, employees in 7-eleven and so on, should not treat you as equals and you should not either, doing so would be showing lack of respect or be confusing for thais.

    Ridiculous.

    1. I'm not a tourist, I've been living here for 7 years and not once wanted to show off, I tip when I think I've received a decent service.

    2. I've never ever ever been asked if I want any of the above, I get in the taxi, tell him where I want to go, speak a little bit of Thai to let him know that I'm no fool then we're off to my destination.

    What kind of taxi do you get into? The type that sits by the side of the road poncing tourists for expensive journeys to the airport, by the sound of your comments you are no more than a tourist in essence!

I couldn't give a monkeys for 'feudal' societies, maybe you mean a 'hierarchical' society but that too, I couldn't give a monkeys, as I said above, lots of my Thai friends tip just as well as me. As far as your point 'doing so would be showing lack of respect or be confusing for thais' I think that is just silly, showing a lack of respect by tipping?? Surely that is showing repsect as you appreciate the service you've received... And to say you m ight be confusing them!! I've never been met with confusion when offering a tip, I don't tip in 7eleven because they're generally servicing the masses and going through the motions but I do tip in restaurants all the time, I don't tip in my local shop, I did once but she looked at me like I was mental, that was one lesson learned but even then I didn't disrespect her or confuse her, I simply surprised her!

    I try not to come on this forum for a row but I frequently end up having one because I can't stop myself - it's the ridiculous and swathing comments that some people leave without a thought. :o

    Why do you care what a total "stranger", a taxi driver, whom you will probably never meet again in your lifetime thinks of you? Personally, I couldn't care less if I am labeled tight-arsed or a nipple-ring wearing farang ladyboy. I simply don't care what strangers think of me. I only care what my closest friends and family think of me but hey bud,each to their own... :D

    I'm not really interested in what they think of me, I'm more interested in making people feel a little bit happier during their days work, same as when I go into McDonald's and smile and say thank you after ordering or saying 'no problem' when they tell me I have to wait 2 extra mins for my chips... for example :D

    It's a little bit sad that you think I'm interested in what they think of me, I was talking about all of us Falang as one... Our collective reputation.

    Tipping a nice/decent/funny taxi driver(I never said I tipped the mental drivers) or a taxi driver who took the quickest route or one who's got an old banger of a car will certainly make their day better, it'll either buy them a plate of food next time they are hungry or maybe they can treat themselves to a bottle of beer when they've finished their B300/18 hour days work.

    Just like to make someones day.
