  1. I am someone who will be affected by these new requirements in a couple of years when I will be 50 and my foreign wife nowhere near that age, we also have a 3 year old kid that will need full time schooling by then.

    My plan was to get the Retirement Visa so my wife and daughter can get visas also and enable us to stay here. Now that plan might need to be amended a little but we have a fallback position with a property in my wife's country where my daughter could go to International School.

    In that case I'd just rent out our flat here and come back to it for holidays, as I had planned to do with the otehr property.

    Alternatively if I can still get her a Class O Visa then my wife can do border runs every 90 days, or just go home to visit family and get a new visa. (I'm assuming that my daughter would get an education visa.)

    In any case I don't think there's any need to panic and plan to sell up and quit the country for other places which quite frankly are nowhere near as good to live as Thailand.

    Ok; you can apply for your retirement extension with the 800,000 in the bank for 3 months.

    Put your daughter in an offical school ( here in Phuket there are 2, (BIS is one) they will then give your kid a education visa and your wife can then apply for a 1 year extension to take care of her ( will need to leave every 3 months)

    But I would bet that, if 100,000 Thai men suddenly showed signs that they were going to take (relatively) rich Indian wives (or English, or....), that rule would be changed pdq.

    Maybe in such a hurry that the 'grandmothering' of those American ladies would get overlooked!

    Apart from no need for the 40K per month requirement, visas are annual, 90 day reporting mandatory, re-entry permits needed, and a yearly visit to immigration is necessary. A work permit is still needed, and the compnay who issues it is subject to all the same requirmenets when hiring a non-thai.

    How do I know, I am thai and my wife a foreigner.

    I stand corrected if that is so BUT I know 2 american ladies, one teaches school and one used to run a bookstore here in Phuket/

    both married to thai men, both had 1 year extensions (did not need to report to immigration every 90 days) did not need to leave the country, that were renewable by just showing up at immigration, (and of course paying 1,900 baht) both did NOT have work permits, and yes both needed re-entry permits.

    Like i have said many times I think each and every thai immigration interperts the law as they see fit.

    I just got my 1 year extension based on i have a thai daughter, divorced and sole custody and Immigration required 500,000 in the bank for 3 months while the law states no money required.

    What ya going to do arque with them :o:-)

  3. I dont get this at all. If they have Thai children then surely he/she can have a marriage visa, assuming they are married that is. I know a 38 year old lady married to a Thai man with no children and she has a 1 year marriage visa although I do not know the rules she abides by.

  4. I got a 1 year retirement visa last year, but still have to do 90 day reporting, no hassle, just do form show passport, they stamp it, 1000bht i think it was,

    After a year, apply for a new retirment visa, im pretty sure this is all it is, hope im right for your mums sake, Cheers Lickey.

    They have given her a non "o" good for 90 days, then she goes back before it expires and applies for the 1 year retirement extension.

    piece of cake if all the paper work is in order.

    1 year extensions need to be applied for EACH year. 800,000 in the bank for 3 months or the equivlent of 65,000 baht PENSION/month.

    It amazes me some of you all that post here. Many seem to have just gotten out of the crib and are clueless yet you all say you live here.

    heheheh good one, 20,000 baht maximum

    BUT if your caught up in some sort of a round up in bar check or have an accident and they want see your passport and your overstayed then its off to jail ( with all the Cambodians and Burmese) then deported.

    I agree that this is taking thailand backwards again. For years i have been waiting to see a sign at the airport,

    "Welcome to thailand, please deposit your money here and have a safe flight home"

    mine was approved with the divorce papers but like i said, here in Phuket they asked for 500,000 in the bank 3 months.

    I had previosuly 5 years on a retirement extension. They asked me why I wanted to change and i told them the truth, that i did not have the full 800,000. I did not show any photos or have my daughter with me.

    I was issued a one month extension and just on Monday went back and had it exteneded another 11 months.

    I wonder if they will ONLY issue you the extension in Bangkok if ur living there. Sunbelt had told me before they could do it for me but now I wonder...

  7. Thanks Loburi, I was granted permission under this law. I am married, 50 years of age with a Thai born child 3 months old. A friend of mine is 57 and has a 5 month old Thai child but is not married. I was wondering if it would be possible for him to get permission to remain under the same law. Reading the order, or the English translation of it does not actually say the couple must be married, but then I could be wrong.

    No you are only allowed to support the wife (and the wife supports the kids) unless you have legal custody of the child, in which case maybe they would throw you both out. :o

    I am Divorced from my thai wife and had to have a court order for the divorce ( since we were married in the states NOT in Thailand) At the same time i was granted full custody of my daughter. This is what immigration needed to see here in Phuket

    Gjones; where did u apply for your extension? Here in Phuket I had to show 500,000 in the bank for 3 months and it was a real inconvience.

    I think you will find that you do not need any money in the bank for that extension as you are over 50.

    Yea I know that BUT as i have said, each immigration is a law unto itself.

    I took the sunbelt version of the law/the thai version as well 4 months in advance. they looked at it and smiled

    They told me 500,000 so 500,000 it is. Otherwise at least for Phuket. forget applying.

    I still have not heard from ANYONE that has applied for this extension except without Sunbelts help which is 6,500 Plus airfares/hotels/taxi's etc.

  10. I belief that most computers which will be seized are breaking some sort of law, illegal software, outside Thailand proxy server setting and …..etc.

    If an officer seize your computer it is unlikely that you get it back, and there is even a change of deportation. The Thai government will love to point the finger to the expat community as the source of the IP violations. (Not forget this is amazing Thailand, everything can happen)

    So time to get legal software or change to an open-source operating system….. Anybody interested in a original (free) Ubuntu Release 7.04 Linux CD, I have stock of 32 and 64 bit CD’s

    I can't see how they will enforce this any more than they will enforce the new law u can't talk on ur mobile while driving a car, ( note this does not apply to talking while your carrying your 5 kids and talking on your honda dream) with no license

    The banned utube yet my daughter, who is 13 uses it all the time as her and all her friends know how to get around the block. Are they libale to be arrested?

  11. Florida, do not panic. What immigration office are you using?

    There hasn't been even one report here of immigration enforcing the three month in the bank rule on people doing subsequent renewals, as you are doing. If you know of one or it is happened to you, please speak up. There is strong evidence they are indeed enforcing it on first time extensions. This indicates you will be fine and get your extension. Please report back!

    Lopburi feels this may start to be enforced in October on subsequent renewals. I strongly question this. Of course, nobody can predict the future.

    I keep trying to suggest that everyone doing these extensions based on bank account ask their officer about this, so I do see this as another opportunity to open this can of worms again, but people don't seem to be biting. Funny that.

    everyone HERE IN PHUkET for retirement EXTRENSION needs to show 800,000 in the bank for three months ( be this your first extension or your 12th) or 65,000 baht/month pension, ( for americans a notorized note from the US Embassy backed up by the bank book showing that the 65,000 comes in ) or combination of the two

    This is STRICTLY enforced!!!

    My wife could get a Thai passport pretty easy, but the thing that worries me is that we could end up in a real mess trying to explain why the Thai passport only has entry stamps with no evidence of exit from Thailand.     Who e ver told you the thai goverment does not accept dual citizenship? Many thai's liivng down south have Malay and thai pp.

    My daughter holds a thai passport and an American passport,

    She enters thailand on her Thai pp and leaves Thailand on the same.

    When she arrives anywhere else she uses her us passport. This is common for many of my friends with dual pp as well

  13. Ok; this goes for Phuket;

    If u have kids at either of the 2 international schools here (BIS and QSI)

    the school will issue you all the papers you need to apply for a one year extension. Check with the school your kids will be going to in advance to make sure ALWAYS

    Immigration will change your visa for you here.

    They will also give BOTH of you visas also ur kids ( if over 12) Once you get the first one your wife can apply as she is married to you.

    U need 500, 000 in the bank for 3 months

  14. Anyway, moaning does not help the matter. I don't wish to relocate to another area of the world because my baby son is in Thailand and I need to try to get custody of him, (and I'm sure that's not going to be an easy task).

    easy way... Go to a lawyer and get them to appeal to the thai court to have you given legal custody of your child. ( It cost me 50,000 baht to get a legal divorce and legal custody here in Phuket)

    Put him in a good international school, making 500,000 a month..u can afford it.

    ALL international schools will then issue you papers to apply for a 1 year non o visa no matter your age to remain with your son while he is in shcool ( this is not the same as living with your kid if your over 50).

    500,000 in the bank 3 months

    all your problems solved as far as imigration goes

    BUT before you do that check out Cambodia

    I have been in thailand 22 ++ years and i love Cambodia. I wanted to move there and get things going but my daughter prefers thailand ( she is part thai/part american). People super friendly and although its not cheap as Thailand as far as i can see. Visas are no problem and plenty fo good things .

    Shinkoville will be great in 5 years and with your money you could go there and build a great place for the future

    All airlines offer this service

    kids 5-12 will be accompinied with staff from first check in, thru immigration and then someone that u designate will meet them after immigration and customs and they will be handed over.

    For Thai it is not cheap, runs $50/kid/sector.

    My daughter last flew to the states when she was 11 and i let her go alone but she speaks english and thai and has flown a lot

    They treat them very good and at elast on Thai and Singpaore really look after them
