  1. "Silence may be a virtue - but after years as a trial judge, the president of the top court, Chat Chonlaworn should have learnt that keeping mum can, under certain circumstances, be construed as an admission of guilt."

Even judges have the right to remains silence. Just keep your mouth shut and no one can question you; because in Thailand, no one can question a judge.

  2. The free milk scheme was introduced under the Thaksin regime. You will find that the scheme is still working I speak from seeing our youngest (10 years old ) son actually bringing home as his friends do the surplus milk each week.

I also see our primary kids getting their free milk each day in the school were I work.

Heavens forbid Hanuman1, but I have the feeling that perhaps someone in the school your child attends has possibly branched out into commerce as a dairyman or dairywoman.

The free milk allocation has not stopped however I am aware there are areas where due to massive mismanagement ( corruption) the free milk scheme has had to be temporarily shelved.

Children cannot vote. Why give them the free milk? A waste of tax payer money.

Adult however can vote; 2000 Baht per head hand out was nicely distributed.

  3. I often wonder why we see non native English speakers employed in schools to teach English.

55,000 a month for a qualified English or general class teacher ?

Good qualified staff do not even get out of bed for that salary.

And schools with EP/MEP still provides a Thai-style environment, so students do not adopt "Western values".

Therein lies the cause of failure, one needs to understand the culture of the language and the adoption of those Western values so as one can actually enhance the use of the language one is learning so as to become proficient in the use of the target language.

Teachers from other cultures and countries are expected to jump through hoops via the T.C.T.

Sad to say the quality of the T.C.T. Thai lecturers is very poor, a poor command of English an inability or reluctance to actually answer question when posed as it is seen as an insult to the lecturers ability and of course standing. The idea of teaching is based on an information exchange system, that information which a lecturer gives out returns as an answer or a question to actually drive home the salient point.

The ability to dance, the inevitable question do you like Thai food the inane conversations, questions that are indeed far removed from the reality of the classroom all combine to make the T.C.T. course even unworthy of being implemented in a kindergarten programme.

Yet again another example of ''squeeze as much money out of a foreigner as you can'' mindset.

55,000 per month, please tell me where. I know of some universities that only pay 25, 000 to start and then really lousy yearly increases - after 6 /7 years you might be lucky to be paid 35,000.

I have been at the same university for 11 years and am still receiving the same pay.

However the baht have strengthen. Take that as a pay increase.

  4. So did we all see the new video clips released on Friday?

Not much the news so far.

    http://www.youtube.c...ohmygod3009#g/u

Just more of the same. k. Jatuporn mentioned clips last month, k Prompong confirmed a day before clips were posted. I normally don't put much faith in 'conspiracy theories', but this time it all seems so neatly timed. Less respect for the constitutional court, suggestions of corruption, helping Dem's. In other words, 'dear PTP/UDD/red-shirt supporters, we told you this government can't be trusted', 'const. court is prejudiced', 'let's burn Bangkok again'.

When in 2001 k. Thaksin was cleared from his 'honest mistake' case with clear pressure orchestrated by TRT, I didn't hear them say anything about prejudice.

Still waiting for k. Pasit to return from his convenient absence.

This doesnt have anything to do with Thaksin/TRT/PPP/PT/UDD. Dont try to spin off topic.

You can jail whoever recorded & released this clip. But the FACT will remain the same.

When you serve such an significant role, people expect you to be 'clean'.

Showing bias against one party, calling 'mun' ( impolite ), setting up a case trying to fool media etc. is totally unacceptable.

"A classic job of misdirection and blame the whistle blower".

  5. http://www.nationmul...cs_30109681.php

Democrat Party Songkhla MP Sirichok Sopa, a close aide to Abhisit, has continued to expose allegations that police positions were being traded for personal gain.

Interesting that Sirichok is "exposing allegations" and is also being blamed for "co-ordinating" the process.

It would seem because he is exposing this pay for positions business,

they attempt to expose him as the mastermind to stop his expositions.

A classic job of misdirection and blame the whistle blower,

    with the testimony of Lieutenant Sacrificial Lamb ;

one cop tethered to a stake to bring the 'alleged smaller carnivores' to the killing ground,

tethered by the even bigger monster actually doing the eating of all who arrive.

"A classic job of misdirection and blame the whistle blower".

Exactly. just like the case about the corrupted judges being secretly filmed.

    The judges: business as usual.

The whist;e blower: On the run like a fugitive overseas, if return, will be arrested immediately.

So more conjecture, I'm not sure that 'dear PTP/UDD/red-shirt supporters, we told you this government can't be trusted', 'const. court is prejudiced', 'let's burn Bangkok again' is the reasoning behind the release of the videos. Perhaps, just perhaps, once the dust has cleared from the distraction techniques used by the Courts e.g threatening the media with lawsuits for discussing the videos , arranging for Pasits' passport to be revoked, etc the facts may come out.

In these new clips there is apparently another "allegation" regarding the leakage of exam papers to prospective applicants for recruitment (close to the Judges, in one case a Judges son). They are heard clearly talking about what they would do, should knowledge of the alleged exam fraud become known. The answer? Dismiss the tapes as doctored and blame a former court official.

And they worry that their reputation may be damaged?

Yes. The tapes as doctored and blame a former court official. if the judges said so, no one can contest it. It is against the law to contest judges.

  7. BANGKOK: -- Judges of the Constitution Court yesterday resolved to take legal action against people....

    [/b]

So the judges have something to hide.....as long as you are not with Ahbisit government you are enemy of the state..

Interesting conclusion. From "The judges decide to take legal action against people accusing them of favouring the Democrat Party in the dissolution case and the unidentified people behind the release of damaging videos of a confidential meeting of the judges in their chambers." to 'they have something to hide'

In most countries filming in judges private rooms without permit would be illegal and punishable by law. K. Pasit seems to have known he did something at least controversial having fled. The slideshow is unrelated, but used to 'suggest' a prejudice for the Dem's. To just ignore these slights would cause even more to say 'see they think they're above the law'. To take legal action against unlawfull activities seems proper.

As for 'not for Abhisit, you must be against', keep in mind that k. Thaksin recently won a defamation suite against k. Sondhi. The judicial system works.

The fact that the judges were discussing the case is not necessarily of itself wrong. Surely in a complex case one would expect the judges to share their individual rational on how they have individually analysed the evidence and their own rational on why the law (in regard to the chrges) was framed (constructed) as it stands in the law books, or in other words analyse together the deep underlying intent of the law. I say again, discussing the case is not necessarily of itself wrong.

That depends who the judges are discussing it with. Go watch it a second time before they ban it:

  8. I don't agree. I do know that in Australia, if the guy had a genuine belief a girl was of age then the law allows for a defence of genuine belief and the jury is directed to give a not guilty verdict.

Of course you just can't say that you thought she was of age, you would need other indications to substantiate your belief (such as false ID etc).

Most laws in the civilised world regarding underage sex allow for such things as a defence because of young girls setting up, or being forced to set up, unsuspecting men.

Why do you think that when police conduct a sting on a 'predator' on the internet they actually make it clear the the 'girl' is underage.

To simply say that he broke the law and deserves to be punished is simplisitc in the extreme. There are many examples of breaking the law being acceptable.

Like killing of 91. Thank you for supporting me.

  9. "A key concern is that the pool of qualified native English speakers in Thailand is very limited"

    - Not a concern. A big cocern only if the native Thai speakers in Thailand is very limited.

"We have found that hundreds of native speakers have used fake certificates in applying for teaching jobs,"

    - In Kao San Road such cert is being sold openly on the street at 200 Baht a piece. Also fake driving license, fake student card, fake press ID, etc.

Every qualified teacher from England will be registered with the British general teaching council, they have a website, they answer emails.

How hard can it be to check? GTC

or they could write to a previous WESTERN employer for a reference!

Speaking as a properly qualified UK teacher (Honours degree, postgraduate certificate of education specialty maths, 8 years experience in UK comprehensive schools) who is living near ChiangMai. It's very hard to get a teaching job here because the TEFLs and unqualified will work cheaper and have flooded the market. Very few schools in Thailand appear to want properly qualified teachers, schools happily accept fake qualifications ...... only the ministry of education ever checks, the schools want cheap!

many people can claim that English is there 1st language. Liberia, Nigeria, Rwanda, Sierra Leone, Sudan, Uganda, etc. Also TEFL cert are openly sold in Khan San road. Don't believe me, just go and have a look. The sales is not conducted in the back street, but the vendor openly display it on the main street. I'll try to capture some images if I happens to go there again.

  10. "Somphol, a homeless scavenger living near Hua Lamphong, was arrested on 16 May"

My English must be bad, but how can someone homeless live near Hua Lamphong?

"The date of the arrest as claimed by the military to be on the night of 15 May contradicted to the testimony of the defendant who said that he was arrested late in the morning of 16 May, and the court found that in the indictment the date had apparently been erased and changed."

Who do you think change it? Was he arrested on the 15th or 16th?

  11. It really weakens the assessment put forth by the OP writer and academics when the last 80 posts basically boils down to a flip-flop seller being detained for a few hours.

If that's the most egregious mistake of the government in this nation of 68 million regarding the security laws, it would seem they're doing pretty good.

Where are all these other examples of "The exceptions are now the rule." ???

It would have appeared from the tone of the OP that there were dozens, if not hundreds.

Well, as Monkfish tried to point out in another thread, there is the case of the homeless scavenger having his case dismissed after 5 months in prison. If it's taken 5 months for this case to appear there's a chance that others may follow. Despite assurances from some posters, the government and CRES that you have nothing to fear from the use of the Thai Security Laws if you're innocent, it appears that some people do indeed have cause to be fearful.

    http://www.prachatai...t=Google+Reader

I am sure you will be very happy and proud of your government if they release you after been held in the prison for 5 months without even a compensation. Not to mention how many times you could have been raped with been held against your will.

  12. If this was a police setup and the prostituting minor looked as if she MAY have been of legal age, a good defense case could be made in many countries that the perp was unfairly entrapped. I don't know what the minor looked like, but this is Thailand, and aspects of "fairness" are not the same here.

She was 14 and could have passed for a 12 year old. It was splashed all over the local news here. She wore a ballcap that did a poor job of covering up her features.

I didn't see that detail. If that it is so, it may have still technically been entrapment but of a different kind.

Entrapment or not, if he broke the law, he must be punished, regardless.

Else Thai judges can just claim entrapment too, even though there are video recording that caught them red handed.

  13. The People's Alliance for Democracy must abide by the law while protesting tomorrow at Parliament House against a diplomatic framework for resolving territorial issues with Cambodia, Prime Minister Abhisit Vejjajiva said yesterday.

I thought the law say :NO PROTEST OF MORE THAN 5 PEOPLE, as BKK is in SOE? Or did I misunderstand the law?

No you did not misunderstand the law, it is just not enforced.

Isn't there a law to penalize a government office for not carrying out his/her duty?

  14. He swore to be telling the truth, or else be dead within seven days.

i don't think that will be left to fate anymore.

Good on the guy, he was doing his job properly it seems and he was removed for touching the untouchable

If he is telling the truth, he will probably be dead in seven days.

    Good luck to him.

If he is not dead by next week, he is telling the truth. A week is not too long to wait.

Sopa better get pack by next week, because the whole world will know if this police is telling the truth or not by then.
