No Payment For Sick Days...

Featured Replies

Hi,

I would like to know if my Thai-employer has to pay me for a certain amount of sick days per year by law, if I have a work permit.

Thanks a lot!

Thai labour laws says that everyone can have a generous 30days sick leave per year, whether your company has to pay you or not will come down to what is in your contract

The contract doesn't say anything about sick days. It only says that when I miss days that the daily rate will be cut for those days, but there is nothing about sick days in particular. Does that mean that I don't have any rights for getting them paid?

Your contract is kind of clear. If you miss work, for unspecified reasons, then you don't get paid for those days.

under thai labour law every employee is entitled to 30 days sick per year - but must be accompanied but doctor letter after more than a 2 day absence - i u have and questions you should address them to the labour office or check the reg online - with the ministry of labour- do u have a work permit and visa -?? sometimes thai companies will write anything in a contract thinking that the farang concerned has no ideas about regulation here - wrong -

According to my work contract a Doc's cert is required for an absence of 3 consecutive days or more.

Mate, I would probably tread lightly. If your not sure what your work contract actually states, I would get it check out by a solicitor to make sure your work contract is legal. On the other side of the coin, for the sake of a few days here or there, if you start to make a fuss about it, your employer may simply fire you for a number of reasons that you may not be aware of, this is Thailand after all. Don't rock the boat....

You're both right.

Thanks for the link! So it seems that my employer has to pay me sick days after all. I might give it a shot and talk to them about it.

THX @ ALL for your help and replies!
