Democrats pondering legal action against Pheu Thai: Chuan

Chuan Leekpai, who is leading the Democrat Party's defence in the two dissolution cases, said yesterday that his party was thinking about taking legal action against other parties that are resorting to unlawful methods against the Democrats.

He said the party's legal team was considering action that could lead to the dissolution of the Pheu Thai Party or any others involved.

"The law exists and people who violate this law must be held responsible for their actions. If the [Democrat] party is the damaged party, we have the right to file a complaint," Chuan said. "As for seeking the disbandment of Pheu Thai or other parties because their members are violating the law, we have a legal team looking into the matter separately from the team dealing with dissolution cases."

He was referring to video clips leaked on the YouTube website. One of them showed Democrat MP and defence-team member Wiruch Romyen talking to Pasit Sakdanarong, secretary to the Constitution Court president, about the Democrat Party's cases. The other three clips are recordings of Constitution Court judges discussing the Democrat dissolution case in their office.

Pasit was removed from his post on Tuesday, a few days after the videos became publicly available.

The clips were released amid allegations from opposition politicians that the Democrats were lobbying for leniency.

Chuan, former Democrat leader and two-time prime minister, said he did not think the videos would affect the cases, though he pointed to the constant attempts to pressure the court.

"Please be reminded that the accuser in this dissolution case against the Democrat Party is the Pheu Thai Party. It has the right to support its case, but the use of methods outside the judicial procedure is unacceptable," Chuan said.

Meanwhile, Pheu Thai MP and red-shirt leader Jatuporn Promphan yesterday continued questioning the Constitution Court's credibility.

Jatuporn said the third man seen in the clip showing Wiruch and Pasit conversing was businessman Worawut Nawapokin, who was involved in a joint venture that won a Bt66-million contract to install security cameras inside the court's compound and a Bt15-million deal to set up a computer system there.

He said police should focus on the relationship between the people in the videos instead of concentrating on where and whom the clips came from as instructed by the prime minister.

Police legal adviser General Ek Angsananont has been assigned to coordinate with the Constitution Court in building up the case related to the video-clips scandal, national police chief General Wichean Potphosree said yesterday.

"I have asked him to consult with the high court to determine the criminal violations committed and charges that can be filed," he said.

Wichean said that before starting police investigation, Ek had to pinpoint whether the case was an individual crime or an offence against the state. If it were deemed an individual crime, the police would need the injured party to file a complaint. Should it be considered a crime against the state, the police can initiate the criminal proceedings with or without a complaint, he said.

In anticipation of the Democrats getting acquitted of all charges,

Jatuporn is hedging his bets. Why is this serial violator of his own bail agreements still an MP and free to talk to the press about court business?

Oh see, 'the court is corrupt, so they are going to let the Dems off'.

Say it now, since he can't say it later, knowing it is against the law

and they DO take those charges seriously.

I'm not saying it's corrupted, but Jatuporn is saying it's credibility is questionable, and no law says he can't say that BEFORE a verdict,

only after a verdict. So a preemptive strike, while preaching to the red choir.

So the accuser, not having an adequate case, tries to add 'charges', at least in the Red Court of Public Opinion, in advance of their case falling apart.

Remember only the PTP have made these transactions an issue.

The lower house didn't come close to a censure motion over these same charges, despite all of Chalerm's bloviating.The EC didn't think there was a case until Arisaman and his reddened crew 'terrorized' the EC during an invasion and take over of the EC offices last spring. Interference with the Election Commission, without a doubt.

This week, interference with the court, most likely. But by which side in reality?

Defense councils often talk with secretaries of judges as normal practice.

So convenient that Pirat has exited the country to Hong Kong, and can't be reached. He can't tell anyone, for the moment, who is behind him putting the tongs to his own bosses of 10 years. Bets on whether he returns BEFORE the next election?

And whoever took those vids of the judges discussing the case in chambers,

is little doubt guilty of some crime against the Court, and whoever instigated them to do it.

The slideshow clip contains a few pictures of Privy Council President Prem Tinsulanonda meeting with the Constitution Court president, Chat Chonlaworn, and a number of senior judiciary figures, with a caption saying that Prem was seeking Chat's help to spare the Democrat Party from being dissolved. The photos were later found to have been taken during an award presentation to Thammasat University's outstanding law graduates two years ago.
